HomeMy WebLinkAboutCC RES 08-058RESOLUTION NO. 08-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA AMENDING AND/OR APPROVING THE ENGINEER'S REPORT FOR THE PALM DESERT DRAINAGE BASIN MAINTENANCE BENEFIT ASSESSMENT DISTRICT NO. 1 FOR FISCAL YEAR 2008/2009 WHEREAS, the City Council of the City of Palm Desert, California (hereafter referred to as the "City Council"), pursuant to the Benefit Assessment Act of 1982, Title 5, Division 2, Part 1, Chapter 6.4 of the Government Code of the State of California commencing with Section 54703 (hereafter referred to as the "Act"); did by previous Resolution order the Engineer, MuniFinancial, to prepare and file a report in accordance with the Act in connection with Drainage Basin Maintenance Benefit Assessment District No.1 (hereafter referred to as the "District") and the proposed levy and collection of assessments related thereto for fiscal year 2008/2009, said fiscal year starting July 1, 2008 and ending June 30, 2009; and WHEREAS, the Engineer has prepared and filed with the City Clerk of the City of Palm Desert and the City Clerk has presented to the City Council such report entitled "Engineer's Report for Drainage Basin Maintenance District No.1, fiscal year 2008/2009" (hereafter referred to as "Engineer's Report") in accordance with the Act; and WHEREAS, the City Council has carefully examined and reviewed the Engineer's Report as presented, and is satisfied with the items and documents as set forth therein, and finds that the levy of assessments has been spread in accordance with the special benefits received from the improvements, operation, maintenance and services to be performed, as set forth in said Engineer's Report; NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL OF THE CITY OF PALM DESERT, THE LEGISLATIVE BODY FOR SAID DISTRICT, AS FOLLOWS: Section 1. The above recitals are true and correct. Section 2. The "Engineer's Report" as presented, consists of the following: (a) A Description of Improvements (b) The Annual Budget (Costs and Expenses of Services, Operations and Maintenance). (c) A Description and Diagram of the Assessment District. (d) The Method of Apportionment and the proposed amount to be levied and collected against each property within the Assessment District for Fiscal Year 2008/2009. RESOLUTION NO. 08-58 Section 3. That the Engineer's Report, as presented or modified, is her by approved and is ordered to be filed in the Office of the City Clerk as a permanent record and to remain open to public inspection. Section 4. That the City Clerk shall certify to the passage and adoption of this Resolution and the minutes of this meeting shall so reflect the presentation and final approval of the Report.
