HomeMy WebLinkAboutCC RES 2012-23RESOLUTION NO. 2012-23 (04/26/2012) ADOPTED BUT NEVER EFFECTUATED REQUEST FOR ADOPTION OF RESOLUTION NO. 2012-23 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, VACATING A PORTION OF THE FRONTAGE ROAD ALONG THE EAST SIDE OF HIGHWAY 74 AS PART OF THE APPROVED HOTEL AND CONDOMINIUM PROJECT KNOWN AS ROSEWOOD, UNDER PROVISIONS OF DIVISION 9, PART 3, CHAPTER 4 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA (PDH Partners, LLC, Applicant). Resolution No. 2012-23 — Vacating A Portion Of The Frontage Road Along The East Side Of Highway 74 As Part Of The Approved Hotel And Condominium Project Known As Rosewood, Under Provisions Of Division 9, Part 3, Chapter 4 Of The Streets And Highways Code Of The State Of California Motion to continue the public hearing UNSUCCESSFUL on a 2-2 vote (Harnik, Spiegel AYE; Benson; Finerty NO; Kroonen ABSENT). The matter still requires adjudication; therefore, it will continue to the April 26, 2012, meeting for this purpose. APRIL 26, 2012 — Waived further reading and adopted Resolution No. 2012-23. 3-2 (Benson, Finerty NO) - Agreement for Purchase and Sale and Joint Escrow Instructions — never effectuated - Resolution No. 2012-23, will be finalized when building permits are issued. OCTOBER 27, 2015 — Document Preservation Notice Received from BB&K. JANUARY 16, 2019 EMAIL REPLY FROM KEVIN SWARTZ (PLANNING) The Development Agreement has expired and the project has lost all entitlements.
