A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT AUTHORIZING THE EXECUTION OF A PURCHASE AND
SALE AGREEMENT WITH THE SUCCESSOR AGENCY TO THE PALM
DESERT REDEVELOPMENT AGENCY TO PURCHASE ONE ACRE OF
PROPERTY LOCATED ON THE NORTH SIDE OF COUNTRY CLUB
DRIVE, EAST OF PORTOLA AVENUE, PALM DESERT, CA (APN 620-
430-024 AND 620-430-025, PROPERTY 12g OF THE LONG RANGE
PROPERTY MANAGEMENT PLAN)
RECITALS:
A. AB X1 26 and AB X1 27 were signed by the Governor of California on
June 29, 2011, making certain changes to the Community Redevelopment Law (Part 1
(commencing with Section 33000) of Division 24 of the California Health and Safety
Code), including adding Part 1.8 (commencing with Section 34161) and Part 1.85
(commencing with Section 34170) ("Part 1.85").
B. The City Council of the City of Palm Desert (the "City") made an election
to serve as the successor agency for the Palm Desert Redevelopment Agency (the
"Agency") under Part 1.85 (the "Successor Agency").
C. The City Council, acting as the governing board for the Successor
Agency, established rules and regulations applicable to the governance and operation
of the Successor Agency, and pursuant to such resolution provided that the Successor
Agency will be governed by a Board of Directors consisting of the members of the City
Council of the City.
D. Pursuant to the approved LRPMP, the City of Palm Desert authorizes the
execution of a Purchase and Sale Agreement with the Successor Agency of the Palm
Desert Redevelopment Agency for 1 acre of Property 12g of the LRPMP (APN 620-430-
024 and 620-430-025).
E. The City Council of the City of Palm Desert is adopting this Resolution to
direct the execution of a Purchase and Sale Agreement with the Successor Agency of
the Palm Desert Redevelopment Agency in the amount of $305,000.00 (appraised
value) as directed by the approved LRPMP.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT
HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS:
Section 1. The above recitals are true and correct and are a substantive part
of this Resolution.
RESOLUTION NO. 2016-32
Section 2. The City Council hereby authorizes and directs the Mayor to
complete the execution of the Purchase and Sale Agreement with the Successor
Agency of the Palm Desert Redevelopment Agency. The Mayor is hereby authorized to
execute the Purchase and Sale Agreement and to complete the disposition of the
property.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the Palm Desert City
Council held on this 14th day of April, 2016, by the following vote, to wit:
