RESOLUTION NO.2019- 20
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING PARCEL MAP NO. 37157 AND
VACATING EXCESS PUBLIC UTILITY EASEMENT LOCATED NORTH
OF DINAH SHORE DRIVE AND EAST OF MONTEREY AVENUE IN
THE SOUTHERLY PORTIONOF PARCEL 1 OF CERTIFICATE OF
COMPLIANCE, WAIVER OF PARCEL MAP, PMW 15-147, RECORDED
AS DOCUMENT NO. 2015-0450535, OFFICIAL RECORDS OF
RIVERSIDE COUNTY, LOCATED WITHIN PARCEL MAP NO. 37157
WHEREAS, the subject vacation is made pursuant to the requirements of the
California Streets and Highways Code, Division 9, Part 3, Chapter 4; and
WHEREAS, the City Council of the City of Palm Desert considered such matter
and finds from the evidence submitted that the easement described in Exhibit "A" and
depicted in Exhibit "B", attached hereto and made a part hereof, is iri excess and is
unnecessary for present or prospective public purposes and that there are no in -place
public facilities within the described area.
BE IT HEREBY RESOLVED, by the City Council of the, City of Palm Desert,
California, as follows:
(1) Parcel Map No. 37157, City of Palm Desert, California, is hereby approved
as the official map of said parcel, subject to the conditions of the Tentative
Map.
(2) The City Engineer is directed to process the Parcel Map for Recording
upon receipt of the required payment of all fees.
(3) That the Public Utility Easement located north of Dinah Shore Drive and
east of Monterey Avenue in the southerly portion of Parcel 1 of Certificate
of Compliance, Waiver of Parcel Map, PMW 15-147, Recorded as
Instrument No. 2015-0450535, Official Records of Riverside County be
vacated as described and as set forth in Exhibits "A" and 'B", attached
hereto; and
(4) That the City Clerk of the City of Palm Desert, California shall cause a
certified copy of the Resolution and order to be recorded in the Office of
the County Recorded of Riverside County, California; and
(5) That from and after the date that this Resolution is recorded, the subject
portion of the public utility easement will no longer constitute a public
service easement.

Subject: Request for Approval of Parcel Map No. 37157 and Vacation of
Excess Public Utilitv Easement Located North of Dinah Shore
Drive and East of Monterev Avenue
At its regular meeting of April 25, 2019, the Palm Desert City Council considered the
subject request and took the following action:
Waived further reading and adopted Resolution No. 2019-20, approving
Parcel Map No. 37157 and vacating excess Public Utility Easement
Located North of Dinah Shore Drive and East of Monterey Avenue in the
southerly portion of Parcel 1 of Certificate of Compliance, Waiver of Parcel
Map PMW 15-147.
Enclosed for your records are fully executed copies of Resolution No. 2019-20 and
Subdivision Improvement Agreement for Parcel Map 37157. If you have any questions
