A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, AMENDING AND ADOPTING LOCAL
GUIDELINES FOR IMPLEMENTING THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) (CALIFORNIA PUBLIC
RESOURCE CODE §§ 21000 ET SEQ.)
WHEREAS, the California Legislature has amended the California Environmental Quality
Act ("CEQA") (California Public Resources Code §§ 21000 et seq.), the Natural Resources
Agency has amended portions of the State CEQA Guidelines (California Code of Regulations,
Title 14, §§ 15000 et seq.), and the California courts have interpreted specific provisions of CEQA
and the State CEQA Guidelines; and
WHEREAS, Section 21082 of the Public Resources Code requires all public agencies to
adopt objectives, criteria, and procedures for the evaluation of public and private projects
undertaken or approved by such public agencies, and the preparation, if required, of
environmental impact reports and negative declarations in connection with that evaluation; and
WHEREAS, the City of Palm Desert ("City") must revise its local guidelines for
implementing the CEQA to make them consistent with the current provisions and interpretations
of the CEQA and the State CEQA Guidelines.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS
FOLLOWS:
SECTION 1. The City adopts "Local Guidelines for Implementing the CEQA (2019
Revision)," a copy of which is on file at the offices of the City and is available
for inspection by the public.
SECTION 2. All prior actions of the City enacting earlier guidelines are hereby repealed.
PASSED, APPROVED, AND ADOPTED by the City Council of the City of Palm Desert,
California, at its regular meeting held on the 27th day of June 2019, by the following vote, to wit:
