C30802, A ONE-YEAR EXTENSION WITH ALL SEASONS LANDSCAPE & DESIGN, INC., FOR LANDSCAPE MAINTENANCE AREA NO. 19 (LARKSPUR SITE & DESERT WILLOW LOT PAD E), IN THE AMOUNT OF $38,052, AND INCLUDE REPAIR WORK AND SERVICES AT THE SPECIFIED CONTRACT AMOUNT NOT TO EXCEED 20 PERCENT OF CONTRACT AMOUNT OR $7,610 (PROJECT NO. 919-11) RECITALS: A. Pursuant to Health and Safety Code Section 34179(3), all actions taken by the Oversight Board for Successor Agency to the Palm Desert Redevelopment Agency (Oversight Board) shall be adopted by resolution. There has been presented to this Oversight Board for approval Contract No. C30802, a one-year extension for Landscape Maintenance Area No. 19: 1. Authorizing Contract No. C30802 in the amount of $38,052 to All Seasons Landscape & Design, Inc. for Landscape Maintenance Area No. 19; 2. Authorizing repair work and services at the specifk d contract amount not to exceed 20 percent of the contract amount or $7,610; and 3. Authorizing the Chairman to execute the finalized Agreement as approved by Successor Agency Counsel. An obligation listed on the Recognized Obligation Payment Schedule (ROPS). NOW, THEREFORE, THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY, HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The above recitals are true and correct and are a substantive part of this Resolution. Section 2. The Oversight Board hereby adopts Resolution No. OB -081 for Landscape Maintenance Area No. 19 for landscape maintenance services associated with the Larkspur Site and the Desert Willow Lot Pad E, an obligation listed on the Recognized Obligation Payment Schedule (ROPS). Section 3. The staff of the Successor Agency is hereby directed to provide the State Department of Finance ("DOF") written notice and information regarding the action RES. NO. OB-081 AIR taken by the Oversight Board in Section 2 of this Resolution. Such notice and information shall be provided by electronic means and in a manner of DOF's choosing. Section 4. The officers of the Oversight Board and staff of the Successor Agency are hereby authorized and directed, jointly and severally, to do any and all things which they may deem necessary or advisable to effectuate this Resolution. OB-081 SECOND AMENDMENT TO AGREEMENT CONTRACT NO C30802 WHEREAS, the City of Palm Desert (' City") and All Seasons Landscape & Design, Inc., ("Contractor"). entered into an agreement, dated June 23, 2011, to provide landscape maintenance services for Landscape Maintenance Area No 19 ("Agreement"), the parties wish to amend the Agreement effective June 12, 2014. NOW, THEREFORE. the parties agree as follows: A. Term is amended to add the following paragraph to the end of the existing section as amended. "The term of this Agreement is extended, and shall include the time period from July 1, 2014, through June 30, 2015." B. All other terms and conditions of the Agreement shall remain unchanged, and shall remain in full force and effect.
