A RESOLUTION OF THE PALM DESERT REDEVELOPMENT
AGENCY DECLARING CERTAIN REAL PROPERTY NECESSARY
FOR PUBLIC PURPOSES AND AUTHORIZING THE
ACQUISITION THEREOF.
THE PALM DESERT REDEVELOPMENT AGENCY DOES HEREBY FIND, DETERMINE,
ORDER AND RESOLVE AS FOLLOWS:
Section 1. The Palm Desert Redevelopment Agency
is a public body, corporate and politic, in the City of Palm
Desert, County of Riverside, State of California. A certified
copy of an ordinance duly adopted by the legislative body of
the City of Palm Desert, declaring that there is a need for
such agency to function in the City of Palm Desert, has been
duly filed in the office of the California Secretary of State
as provided by Health and Safety Code Section 33102.
Section 2. A redevelopment plan for Project Area
No. 1 in the City of Palm Desert has been duly adopted by ordinance
of the City Council of the City of Palm Desert entitled, "An
Ordinance of the City of Palm Desert Approving and Adopting a
Redevelopment Plan for Project Area No. 1 in the City of Palm
Desert, California as the Official Redevelopment Plan for Such
Project Area," adopted on July 16, 1975. Amendments to said
redevelopment plan have been duly adopted by ordinance of said
City Council entitled, "An Ordinance of the City of Palm Desert,
California, Amending Ordinance No. 80 Known as the Redevelopment
Plan for Project Area No. 1 (Case No. RPA 01-77)," adopted
March 24, 1977, and "An Ordinance of the City of Palm Desert,
California Amending Ordinance No. 80 known as the Redevelopment
Plan for Project Area No. 1 (Case RPA 03-77)," adopted on
August 25, 1977. The acquisition of the interests in the real
property herein described is within said Plan and Project as
amended and such acquisition is necessary for purposes of
redevelopment.
Section 3. The interests in the property herein-
after described is to be taken for a public use, namely, for
redevelopment as defined in the Community Redevelopment Law,
Health and Safety Code Section 33000 to 34152,inclusive, and in
particular, in Section 33020 and 33021, pursuant to the
authority conferred upon the Palm Desert Redevelopment Agency
to acquire property by eminent domain by said Community
Redevelopment Law, and in particular by Health and Safety Code
Section 33391.
Section 4. The property to be taken is fee
ownership in that certain parcel situated at the northwest
corner of Palm Desert Drive and Monterey Avenue in Palm Desert
Redevelopment Agency Project No. 1 in the City of Palm Desert,
and described as follows:
The land situated in the State of California,
County of Riverside, City of Palm Desert, described as
follows:
That portion of the Southeast quarter of the
Northeast quarter of Section 19, Township 5 South,
Range 6 East, San Bernardino Base and Meridian,
according to an official plat of said land approved
by the Surveyor General on July 15, 1856, described
as follows:
COMMENCING at the East quarter corner of said
section;
THENCE Northerly 40 feet along the Easterly line
of said section to the Southeast corner of that certain
parcel of land conveyed to the County of Riverside by
Deed recorded March 29, 1965 as Instrument No. 35497 of
Official Records of Riverside County, California;
THENCE continuing Northerly, 160 feet along the
Easterly line of said parcel and said section to the
Northeast corner of said parcel conveyed to the County
of Riverside;
THENCE Westerly 30 feet along the Northerly line
of said parcel to the TRUE POINT OF BEGINNING;
THENCE continuing Westerly 120 feet parallel with
the East-West center line of said section;
THENCE Southerly 120 feet parallel with the
Easterly line of said section to a point on the
Northwesterly line of said parcel conveyed to the
County of Riverside;
THENCE Easterly 94.83 feet along the Northwesterly
line of said parcel to the beginning of a tangent curve
concave Northwesterly having a radius of 25 feet;
THENCE Northeasterly along said curve to a point
30 feet Westerly of an measured at right angles from
the Easterly line of said section;
THENCE Northerly 94.83 feet along said Northwesterly
line of said parcel conveyed to the County of Riverside
and being 30 feet Westerly of and parallel with the
Easterly line of said section to the Point of Beginning
Section 5. The governing body of the Palm Desert
Redevelopment Agency has found and determined, and hereby finds
and determines that:
(a) The public interest and necessity require
the proposed project;
(b) The proposed project is planned or located
in the manner that will be most compatible with the greatest
public good and the least private injury;
(c) The property hereinabove described is
necessary for the proposed project.
PASSED, APPROVED AND ADOPTED by the Palm Desert
Redevelopment Agency this 23rd day of July , 1981 ,by the
following vote, to wit:
