HomeMy WebLinkAboutRDA RES 144RESOLUTION NO. 144 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF PALM DESERT, CALIFORNIA, CERTIFYING ENVIRONMENTAL IMPACT REPORT EIR 81-2 FOR A PROJECT DESCRIBED AS THE PROPOSED EXPANSION OF THE REDEVELOPMENT AGENCY BOUNDARIES FOR THE PURPOSES OF FINANCING THE CONSTRUCTION OF FLOOD CONTROL FACILITIES AS MEETING THE REQUIRE- MENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, STATE AND LOCAL GUIDELINES FOR PREPARATION OF ENVIRONMENTAL IMPACT REPORTS. WHEREAS, the City of Palm Desert Redevelopment Agency is the lead Agency pursuant to California Environmental Quality Act Guidelines Section 15030 for this project described as the proposed expansion of the Redevelopment Agency boundaries for the purposes of financing the construction of flood control facilities; and WHEREAS, the Redevelopment Agency of the City of Palm Desert, California, did, on the 22nd day of October, 1981, hold a duly noticed Public Hearing to consider certification of a final Environmental Impact Report, herein after referred to as Environmental Impact Report 81-2, for a project commonly referred to as proposed expansion of the Redevelopment Agency boundaries for the purposes of financing the construction of flood control facilities; and WHEREAS, a draft Environmental Impact Report on the flood control works for Palm Desert, Rancho Mirage, and Indian Wells was prepared for Coachella Valley Water District by J. B. Gilbert and Associates of Berkeley, California, in August, 1978, (hereinafter referred to as the Gilbert Environmental Impact Report); and WHEREAS, Coachella Valley Water District did hold a Public Hearing in October, 1978, to review the Gilbert Environmental Impact Report; and WHEREAS, Coachella Valley Water, by its Resolution No. 79-29 dated February 13, 1979, adopted and approved the final Gilbert Environmental Impact Report; and WHEREAS, Coachella Valley Water District, by its Resolution No. 79-66 dated March 13, 1981, adopted certain mitigation measures to mitigate impacts identified in the final Gilbert Environmental Impact Report approved February 13, 1979, by Resolution No. 79-29; and WHEREAS, Coachella Valley Water District by its Resolution No. 79-66 dated March 13, 1979, adopted a Statement of Overriding Consideration for certain environ- mental impacts which were identified and which could not be adequately mitigated; and WHEREAS, Environmental Impact Report 81-2 recognized the direct relationship between the construction of the actual flood control facilities analyzed in the Gilbert Environmental Impact Report and the present project for the proposed expansion of the Redevelopment Agency boundaries for the purpose of financing the construction of the said flood control facilities; and WHEREAS, the information purposes Environmental Impact Report 81-2 incorporates by reference the Gilbert Environmental Impact Report and the mitigation measures set forth therein adopted by the Coachella Valley Water District on March 13, 1979; and WHEREAS, the Redevelopment Agency did receive and review copies of Environ- mental Impact Report 81-2; and WHEREAS, the Redevelopment Agency in its copies of Environmental Impact Report 81-2 did receive copies of written comments received on the Draft Environmental Impact Report from the following agencies: 1. City of Palm Springs. 2. California Regional Water Quality Control Board. 3. Coachella Valley Resource Conservation District. 4. Desert Beautiful. 5. State of California, Department of Resou WHEREAS, the Redevelopment Agency in its Report 81-2 did respond to the above noted written corr WHEREAS, the Redevelopment Agency at its 1981, did receive all oral comments on Environmental thereto; and WHEREAS, the impacts of the environment w construction of the flood control facilities have alreac mitigation measures adopted and a Statement of Ovf Coachella Valley Water District by its Resolution No. 7 WHEREAS, the following are potential impac were identified either within Environmental Impact reports, or comments and responses pertaining to Env which had not previously been identified in the Gilbert A. Public Services/Facilities and Utilities. Impacts - There may be some fiscal impact as tax increment on the following Public Services/F 1. Recreation. 2. Library Service. 3. Desert Hospital (Palm Springs). 4. Fire Department Programs. 5. Coachella Valley Water District Water Se 6. College of the Desert Programs. 7. Desert Sands Unified School District Progrd 8. Riverside County Superintendent of Schools 9. County of Riverside, General Fund & ProgrE 10. Physically Handicapped Programs. 11. Severe Mentally Retarded Programs. 12. Juvenile Hall Program. 13. Regional Occupation Programs. 14. Public Cemetery. 15. Mosquito Abatement. 16. Resource Conservation. The Redevelopment Agency does heret Impact Report has been completed it Environmental Quality Act of 1970 as guidelines implementing said act, with 2-2 RESOLUTION NO. 14• Report as complete to include: a) The draft Environmental Impact Report and the adoption by reference of the Gilbert Environmental Impact Report and the mitigation measures and Statement of Overriding Consideration completed by the Coachella Valley Water District. b) Comments received on the draft Environmental Impact Report and related responses by the Redevelopment Agency; and c) Public testimony regarding the Environmental Impact Report during the Public Hearing and related responses. d) The list of persons, organizations and public agencies commenting on the Draft Environmental Impact Report. e) The Minutes of the Redevelopment Agency of the City of Palm Desert Meeting of October 22, 1981. BE IT FURTHER RESOLVED that the mitigation measures proposed for the impact resulting from the proposed expansion of the Redevelopment Agency boundaries are hereby adopted.
