RESOLUTION NO. 169
A RESOLUTION OF THE PALM DESERT REDEVELOPMENT
AGENCY DECLARING CERTAIN REAL PROPERTY
NECESSARY FOR PUBLIC PURPOSES AND
AUTHORIZING THE ACQUISITION THEREOF.
THE PALM DESERT REDEVELOPMENT AGENCY DOES HEREBY FIND,
DETERMINE, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The Palm Desert Redevelopment Agency
is a public body, corporate and politic, in the City of Palm
Desert, County of Riverside, State of California. A certified
copy of an ordinance duly adopted by the legislative body of
the City of Palm Desert, declaring that there is a need for
such agency to function in the City of Palm Desert, has been
duly filed in the office of the California Secretary of
State as provided by Health and Safety Code Section 33102.
Section 2. A redevelopment plan for Project Area
No. 1 in the City of Palm Desert has been duly adopted by
ordinance of the City Council of the City of Palm Desert
entitled, "An Ordinance of the City of Palm Desert Approving
and Adopting a Redevelopment Plan for Project Area No. 1 in
the City of Palm Desert, California as the Official Redevelop-
ment Plan for Such Project Area," adopted on July 16, 1975.
Amendments to said redevelopment plan have been duly
adopted by ordinance of said City Council entitled, "An
Ordinance of the City of, Palm Desert, California Amending
Ordinance No. 80 Known as the Redevelopment Plan for Project
Area No. 1 (Case No. RPA 01-77)," adopted March 24, 1977,
"An Ordinance'of the City of Palm Desert, California
Amending Ordinance No. 80 known as the Redevelopment Plan
for Project Area No. 1 (Case No. RPA 03-77)," adopted on
August 25, 1977, and "An Ordinance of the City Council of
Palm Desert, California, approving a Redevelopment Plan, as
Amended, Adopted November 25, 1981. The acquisition of the
real property herein described is within said Plan and
Project as amended and such acquisition is necessary for
purposes of redevelopment.
Section 3. The property hereinafter described is
to be taken for a public use, namely, for redevelopment as
defined in the Community Redevelopment Law, Health and
Safety Code Section 33000 to 34152, inclusive, and in
particular, in Section 33020 and 33021, pursuant to the
authority conferred upon the Palm Desert Redevelopment
Agency to acquire property by eminent domain by said Community
Redevelopment Law, and in particular by Health and Safety
Code Section 33391.
Section 4. The property to be taken is that
certain parcel located on the west side of Monterey Avenue,
near the corner of Monterey Avenue and Palm Desert Drive,
Palm Desert, California, situated entirely within Palm
Desert Redevelopment Agency Project Area No. 1, and described
as follows:

The easterly 50 feet of the northerly 50 feet of
that portion of the Southeast quarter of the Southeast
quarter of the Northeast quarter of Section 19, Township
5 South, Range 6 East, San Bernardino Base and Meridian,
in the County of Riverside, State of California, as
shown by United States government Survey described as
follows:
Commencing at the Southeast corner of the Southeast
quarter of the Northeast quarter of said Section;
thence North 00° 21' 20" East, along the Easterly line
of said Section 250.00 feet; thence North 89° 15' 40"
West, parallel with the southerly line of the Southeast
quarter of the Northeast quarter of said Section, 30.00
feet to a point on the Westerly line of Monterey Avenue
(60.00 feet wide) said point being the true point of
beginning; thence continuing North 89° 15' 40" West,
270.00 feet; thence south 00° 21' 21" West, 250.00 feet
parallel with said East line of Section to said South
line of the Southeast quarter of Northeast quarter,
thence south 89° 15' 40" East, 150.00 feet on said
South line; thence North 00° 21' 20" East, 200.00 feet;
thence South 89° 15' 40" East, 120.00 feet to the West
line of Monterey Avenue; thence North 00° 21' 20" East,
50.00 feet on said West line to the Point of Beginning.
Except that portion within State Highway 111 as
described in Deed to the State of California, recorded
August 5, 1930 as Instrument No. 236 of Official
Records of Riverside County, California.
Also except that portion thereof, as conveyed to
the County of Riverside in Deed recorded June 17, 1970
as Instrument No. 57648 of Official Records of Riverside
County, California, described as follows:
Commencing at the Southeast corner of the Southeast
quarter of the Northeast quarter of said Section;
thence North 89° 15' 40" West, 150.00 feet along the
South line of the Southeast quarter of the Northeast
quarter; thence North 00° 21' 20" East, parallel to the
said East line of the Northeast quarter 40.00 feet to
the True Point of Beginning; thence North 89° 15' 40"
West, parallel to said South line, 150.00 feet; thence
North 00° 21' 20" East, parallel to said East line
40.00 feet; thence South 89° 15' 40" East, parallel to
said South line, 150.00 feet; thence South 00° 21' 20"
West, parallel to said East line 40.00 feet to the True
Point of Beginning.
Also except the Easterly 40.00 feet of the Northerly
50.00 feet of the Southerly 250.00 feet of the Southeast
one quarter of the Southeast one quarter of the Northeast
one quarter of Section 19, conveyed to the County of
Riverside by Deed recorded July 1, 1970 as Instrument
No. 63164 of Official Records of Riverside County,
.California, lying within the Westerly 40.00 feet of
Monterey Avenue.

Section 5. The governing body of the Palm Desert
Redevelopment Agency has found and determined, and hereby
finds and determines that:
(a) The public interest and necessity
require the proposed project;
(b) The proposed project is planned or
located in the manner that will be most compatible with
the greatest public good and the least private injury;
(c) The property hereinabove described
is necessary for the proposed project;
(d) The offer required by Section 7267.2
of the Government Code has been made to the owners of
record.
PASSED, APPROVED and ADOPTED this 24th day of
February, 1983.
