A RESOLUTION OF THE PALM DESERT REDEVELOPMENT
AGENCY DECLARING CERTAIN REAL PROPERTY NECESSARY
FOR PUBLIC PURPOSES AND AUTHORIZING THE
ACQUISITION THEREOF
THE PALM DESERT REDEVELOPMENT AGENCY DOES HEREBY FIND, DETERMINE,
ORDER, AND RESOLVE AS FOLLOWS:
Section 1. The Palm Desert Redevelopment Agency is a public
body, corporate and politic, in the City of Palm Desert, County of
Riverside, State of California. A certified copy of an ordinance duly
adapted by the legislative body of the City of Palm Desert, declaring
that there is a need for such agency to function in the City of Paim
Desert, has been duly filed in the office of the California Secretary
of State as provided by Health and Safety Code Section 33102.
Section 2. A redevelopment plan for Project Area No. 1 in the
City of Palm Desert has been duly adopted by ordinance of the City
Council of the City of Palm Desert entitled, "An Ordinance of the City
of Palm Desert Approving and Adopting a Redevelopment Plan for Project
Area No. 1 in the City of Palm Desert, California as the Official
Redevelopment Plan for Such Project Area," adopted on July 16, 1975.
Amendments to said redevelopment plan have been duly adopted by ordi-
nances of said City Council entitled, "An Ordinance of the City of Palm
Desert, California, Amending Ordinance No. 80 Known as the Redevelopment
Plan for Project Area No. 1 (Case No. RPA 01-77)," adopted March 24,
1977; "An Ordinance of the City of Palm Desert, California, Amending
Ordinance No. 80 known as the Redevelopment Plan for Project Area No. 1
(Case RPA 03-77)," adopted on August 25, 1977; "An Ordinance of the
City Council of the City of Palm Desert, California, Approving ,3
Redevelopment Plan, As Amended," adopted November 25, 1981; "An Ordi-
nance of the City of Palm Desert, California, Approving and Adopting the
Amendment to the Redevelopment Plan for Project Area No. 1, As Amended,"
adopted October 13, 1983; and "An Ordinance of the City Council of Palrn
Desert, California, Approving and Adopting an Amendment to the Rede-
velopment Plan for Project Area No. 1," adopted November 29, 1984. fhe
acquisition of the real property herein described is within said Plan
and Project as amended and such acquisition is necessary for purposes of
redevelopment.
Section 3. The property hereinafter described is to be taken for
a public use, namely, for redevelopment as defined in the Community
Redevelopment Law, Health and Safety Code Section 33000 to 3415?,
inclusive, and in particular, in Section 33020 and 33021, pursuant to
the authority conferred upon the Palm Desert Redevelopment Agency to
acquire property by eminent domain by said Community Redevelopment Law,
and in particular by Health and Safety Code Section 33391.
Section 4. The property to be taken is fee ownership in those
certain parcels located on the north side of Fred Waring Drive between
San Pablo Avenue and San Pascual Avenue, except the southwest corner of
the property in Palm Desert Redevelopment Agency Project No. 1 in the
City of Palm Desert and described as follows:
PARCEL A:
Parcels 1 and 4 of Parcel Map No. 14768, in the City of Palm
Desert, as shown by Parcel Map on file in Book 88, pages 10 and 11
of Parcel Maps, Records of Riverside County, California;
EXCEPTING from that portion of said Parcel 4 lying within the
Northwest quarter of the Southeast quarter of Section 17, Township
5 South, Range 6 East, San Bernardino Base and Meridian, all oil,
gas. other hydrocarbon substances, minerals, and accompanying
fluids, including all geothermal resources from below the depth of
500 feet from the surface of said property, as reserved in deed
recorded September 14, 1978, as Instrument No. 193782 of Official
Records of Riverside County, California.
Also excepting therefrom those portions of Parcels 1 and 4 which
lie within the boundaries of Tract No. 19074-1 as shown by map on
file in Book 1 4 1 , pages 58 through 64 of Maps, Riverside County
Records.
Also excepting therefrom that portion lying East of the West line"
of San Pascual Avenue as conveyed to the City of Palm Desert by
deed recorded November 12, 1982, as Instrument No. 196895, Official
Records.
PARCEL B:
Lots 1 through 80, inclusive. Lot 82, Lettered Lots C through I,
inclusive, (private drives) and Common Lots J, K, L, M, N, and 0,
and Lettered Lots P, Q. R, S, T, U, V, W, X, Y, and Z of Tract
19074-1 in the City of Palm Desert as shown by map on file in Book
141, pages 58 through 64 of Maps, Records of Riverside County,
California.
Section5. The governing body of the Palm Desert Redevelopment
Agency has found and determined, and hereby finds and determines that:
(a)
project;
The public interest and necessity require the proposed
(b) The proposed project is planned or located in the manner that
will be most compatible with the greatest public good and the least
private injury;
(c) The property hereinabove described is necessary for the,,,
proposed project; and
(d) The offer required by Section 7267.2 of the Government Code -
has been made to the owner of record.
PASSED, APPROVED, and ADOPTED by the Palm Desert Redevelopment
Agency this 14th day of November, 1985, by the following vote, to wit:
