That certa i n Agreement between the Paim Desert Redevelopment Agency and the Coachella Valley Housin4 Coalition, substantially in the form and content pre5ented to the Agency at this meeting and now on file in the office of the Executive Director, is hereby approved, and the Chairman is herebv autt orized and directed to execute such Agreement for and on behalf of the Agency. and to approve modifications to such Agreement which tiave been recommended hy the Executive Director of the Aqency. Section 2. Jn consideration of the conveyance by the City of tl e parcels of real property shown on Exhibit A, attached F ereto, in furtherance of the Self-Help Housing Program of the Aqencv. the Agency hereby approves reimbursement to the City for the value of each such parcel in an amo nt not to exceed 26,U00 per parcel. Such reimbursement shall be made concurrent.ly witt the conveyance of each such parcel by the City. Sect.ion 3.. The Agency hereby approves the construction f i nanc i nq to be prov i ded by F i rstbank of Pa 1 m Desert i n accord nce with tl e letter attached hereto as Exhibit B. The Executive Director and other appropriate officials of the Aqency are herebv authorized and directed to execute such agreements and att er documents as rnay be necessary or desirable to effectuate tfie transaction described in such letter. The amount of the loan shall not exceed $700,000 for a term of one year. The loan will be dispursed directly to the Redevelopment Agency as a line of credit. The rate of inCerest shall be 2.0� below the FirstBank Commercial Base Rate as adjusted on the first business day of each month. The current FirstBank Commercial Base Rate is 10.0%. Interest will be due and payable monthly. Funding of the loan is contingent upon loan documentation saCisfactory to the bank and its legal council. The primary purpose of the Affirmative Marketing Program is to promote a condition in which individuals of similar income levels in the same housing marketing area have available to them a like range of choices in housing, regardless of the individual's race, color, religion, sex or national origin. The use of Federal funds to assist a housing project and the correlated coverage of the Fair Housing Act places an obligation on the Sponsor/Developer + to advertise in such a way as to insure that the potential purchasers or tenant population will not be limited to those who have had some prior association with the project or some early information about it. Accordingly, the Department has set forth the following procedures which you are required ta follow pursuant to the goals of the program, the Department's regulations and the approved AFHMP for subject project. (1) The approved AFHM Plan must be available for public inspection in your office. (2) There must be prominently displayed in all offices, in which sale or rental activity pertaining to the project takes place, the Fair Housing Poster approved by the Department. Resolution No. 236 �'•� (3) Post in a conspicuous position on all FHA project sites a sign displaying prominently either the Department's � approved Equal Housing Opportunity logo or slogan or statement. (4) Ensure that all advertising material related to this housing contains the Equai Nousing Opportunity logo, slogan, or statement, in conformance with the Department's Fair Housing Advertising Regulation (24 CFR Part 109 } . (5) The "Notice of Intent to Begin Marketing" is to be sub- mitted to this office no later than 90 days prior to engaging in marketing activities. Please Note: For Section 202 projects, the Notice of ntent to egin Marketing is to be submitted 180 days prior to the estimated date for occupancy of the first unit, (6) Marketing activities are to begin as stated on the approved AFHMP. If changes or modifications to the Plan are necessary, a revised AFHMP should be submitted to this office for approval. (7) No intake of applications is to occur prior to the -- beginning dates for advertising as indicated on the approved AFHMP. (8) If this office has approved the use of a lottery in order to select tenants, the drawing shauld be opened to the public in such a way as to assure accountability and reliability against potential allegations of unfairness. In no instance is the drawing to be he]d in the privacy of the management agent/owner's office, with the only participants being management company personnel. Mbst of the current residents of the Palma Vi11aF :ighborhood are white.
