The Agency hereby authorizes and directs Agency staff to transmit by certified mail, return receipt requested, the information required by Health and Safety Code Section 33327 and 33328 to the County Auditor. the County Assessor, the County Tax Collector, the legislative or qoverning bodies of all local aqencies which receive a portion of the property tax levied in the Pro.ject Area pursuant to Part 6.5 of the Revenue and Taxation Code (commencing with Section 50) end to the State Board of Eaualization. INTRODUCTION This Preliminary Ptan (the "Plan") has been prepared under the authorization of Resolution No. 89-101 passed by the City Council of the City of Palm Desert (the "City Council") on August 24, 1989. This Resolution established a Redevelopment Survey Area for the City of Palm Desert (the "Survey Area") which includes all area within the corporate boundaries of the City of Palm Desert (the "City"). This Resolution also authorized the Planning Commission in conjunction with the Palm Desert Redevelopment Agency (the "Agency") to study the feasibility and select a Redevelopment Project Area ("Project Area No. 3") from within the Survey Area. The adoption of the Plan and the selection of the boundaries for Project Area No. 3 initiate the proceedings for the adoption of a Redevelopment Plan. This Plan has been prepared in accordance with Section 33324 of the California Community Redevelopment Law (Health and Safety Code, Sections 33000 �t. �.) which states that the Preliminary Plan should: (a) describe the boundaries of the project area; (b} contain a general statement of land uses, layout of principal streets, population densities and building intensities and standards proposed as the basis for the redevelopment of the project area; (c) show how the purpose of the Community Redevelopment Law would be attained by such redevelopment; (d) show how the proposed redevelopment conforms to the general plan; \pelmdat\orcp�en 1 revlsed 10/22/90 Resolution No. 237 (e) describe, generally, the impact of the redevelopment project upon residents of the project area and surrounding neighborhoods. II. PROJECT AREA NO. 3 LOCATION AND DESCRIPTION Project Area No. 3 is located in the City of Palm Desert, Riverside County, California and generaNy includes that area of the City bounded by Portola Avenue and Cook Strest to the west, the corporate City boundary and Carlotta Drive to the east, Hovely Lane and Running Springs Drive to the north and the Whitewater River Channel to the south. The Portoia Country Club is nQ a part of Project Area No. 3. The proposed boundaries for Project Area No. 3 are outlined in Exhibit A. III. GENERAL STATEMENT OF PROPOSED PLANNING ELEMENTS A. LAND USES As a basis for the redevelopment of Project Area No. 3, it is generally proposed that the uses be permitted in conformance with the Ciry of Palm � Desert General Plan (the "General Plan"), the Zoning O�dinance of the City, and all other state and local building codes and guideli�es. The following uses are presently permitted by the General Plan: 1. Core Commercial: Including retai{ stores; professional and personal service shops; professional, personal and business offices; shopping centers; and restaurants. 2. �ervice Industrial: Including industrial/business parks oriented toward storage, distribution, assembly, service commercial, and research and office facilities. \pa�mdst\preplen 2 revised 10/22/90 Resolution No. 237 3. Residential: Including residentiai and other related uses as permitted by the Genera! Plan and as approved by the Agency. 4. Other: Inciuding open space and parklands, pubic utilities, and rights-of-way. B. GENERAL STATEMENT OF PROPOSED LAYOUT OF PRINCIPAI. STREET The principal streets within Project Area No. 3 are as shown on Exhibit A. These include Portola Avenue, Hovely Lane, and Cook Street. The layout of principal streets and those that may be developed in the future shall conform to the Genera! Plan Circulation Element as currently adopted or as hereafter amended. Existing streets within Project Area No. 3 may be closed, widened or otherwise modified, and additional streets may be created as necessary for proper pedestrian and/or vehicular circulation provided they are consistent with the General Plan. C. �ENERAL STATEMENT OF PROPOSED POPULATION DENSITIES Permitted densities within Project Area No. 3 shall conform to the General Plan as currently adopted or as hereafter amended, and applicable ordinances and local codes. D. GENERAL STATEMENT OF PROPOSED BUILDING INTENSITIES As a basis for the redevelopment of Project Area No. 3 it is proposed that, in general, building intensity be controlled by limits on: (1) the percentage of the building site covered by the building (land coverage); (2) the ratio of \palmdst\preDlan 3 revlsed 10/22/90 Resolution No. 237 the total floor area for all stories of the building to the area of the building site (floor area ratio); (3) the size and location of the buildable area on the — building site; and (4) the heights of the building. The limits on building intensity shall be established in accordance with the provisions of the General Plan, Zoning Ordinance, and local codes and ordinances, as they now exist or are hereafter amended. The land coverage, sizes and location of the buildable areas wi11 be limited, as is feasible and appropriate, to provide adequate open space and parking. E. GENERAL STATEMENT OF PROPOSED BUILDING STANDARDS It is proposed that, in general, the building standards shoutd conform to the building requirements of applicable State and national statutes and local codes and ordinances. The Agency may consider more restrictive requirements and may incorporate such requirements into the _ Redevelopment Plan in the interest of the public health, safety and welfare. IV. ATTAINMENT OF THE PURPOSES OF THE LAW The purposes of the California Community Redevelopment Law are to protect and promote the sound development and redevelopment of blighted areas and the general welfare of the inhabitants of the communities in which they exist. The purposes of the California Community Redevelopment Law would be attained by redevelopment of Project Area No. 3 and by facilitating a higher and better utilization of land thereby contributing to the public, safety and welfare. Redevelopment activities include the planning, development, replanning, redesigning, reconstruction or rehabilitation, or any combination oi the foregoing, and the provision of such residentiai, commercial, industrial, public or other structures or space as may be appropriated or necessary in the interest of the general welfare, including recreational and other facilities. \pplmdst\preD�en 4 revised 10/22/90 Resolution No. 237 Redevelopment of Project Area No. 3 would also attain the purposes of the California Community Redevelopment Law by stimulating construction activity and increasing � employment opportunities in commercial and industrial areas of Project Area No. 3 and in the City of Palm Desert. Financial assistance would also be provided in association with the construction and reconstruction of curbs, gutters, sidewalks, streets, and other public ;mprovements. Such purposes would also be attained by the attraction of residential, commercial and industrial uses to stagnant and unproductive areas, including recycling of land uses into viable and productive uses consistent with the General Plan. It is further anticipated that the Agency will provide �inancial assistance for the development of additional residential� commercial and industrial construction and rehabilitation in a manner which will make such development economically feasible. The selection of the boundaries of Project Area No. 3 was guided by the existence of blight, as defined by the California Community Redevelopment Law, and the following facts and principles. A. The City's desire to revitalize and upgrade the residential, commercial, and industrial uses which are included in Project Area No. 3 in order to: increase sales and business tax revenues; improve public facilities, services and infrastructure; improve drainage facilities; provide adequate parking; reduce the cost of providing City services; create jobs for City residents; assure social and economic stability; and promote aesthetic and environmental actions and improvements that will make the City of Palm Desert a better place to live, work, shop and enjoy leisure time. B. The City's desire to remove or rehabilitate physically obsolete or substandard structures and other blighting influences; to eliminate illegal or nonconforming \palmdst\flreplen �j reviSed 10/22/90 Resolution No. 237 land uses; to rehabilitate, through owner participation, existing buildings; to instail, construct, reconstruct, redesign, or reuse streets, utilities, curbs, gutters, -- sidewalks and other associated public imp�ovements; to construct and/or reconstruct drainage facifities; to assemble land into parcels suitable for modern integrated development with improved off-street parking and loading facilities; to improve and provide additional, if feasible, adequate recreation facifities. V. CONFORMANCE TO THE GENERAL PLAN OF THE CITY The proposed redevelopment described in this Preliminary Plan conforms to the General Plan. The Plan proposes an identical pattern of land uses and includes all highways and public facilities as indicated by the General Plan. VI. GENERAL IMPACT OF THE PROPOSED REDEVELOPMENT PROJECT UPON THE RESIDENTS OF PROJECT AREA NO. 3 AND SURROUNDING NEIGHBORHOODS _ The impact of the Project upon residents within ProJect Area No. 3 and surrounding neighborhoods outside of ProJect A�ea No. 3 will generally be in the areas of improved public utilities and services, improved living environment and economic activity. Redevelopment of the Project Area wilf provide for the improvement, modernization, planning, development, replanning, redesign, reconstruction and rehabilitation of the Project Area and the provision of residential, commercial, industrial, public and other structures and open spaces in the interest of the general welfare. It is also anticipated that redevelopment activities orchestrated by the Agency will provide additional employment opportunities and enhance the environmental quality of Project Area No. 3 and surrounding areas. Thus, the impact of the project upon residents of the Project Area and the surrounding neighborhood will be positive. \ pa�mdsl \ preplen C� revised 10/22J90 Resolution No. 237 Plan implementation activities will occur as suffic+ent financial resources are available. Therefore, redevelopment activity is intended to be phased over a period of time, with on(y a limited amount of direct activity at any one time. Therefore, during — redevelopment, impacts of the redevelopment project upon residents of the proposed Project Area and surrounding neighborhood wil(, in generai, be minimal.
