RESOLUTION NO. 255 A RESOLUTION OF THE PALM DESERT REDEVELOPMENT AGENCY APPROVING A REVISED REPORT REGARDING EXCESS TAX INCREMENT REVENUES AND MAKING FINDINGS THAT SUCH EXCESS TAX INCREMENT REVENUES ARE NOT AND WILL NOT BE NECESSARY TO MEET CERTAIN HOUSING REQUIREMENTS THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The Palm Desert Redevelopment Agency has caused to be prepared a revised report regarding excess tax increment revenues, which revised report is attached hereto as Exhibit A. The revised report indicates the last equalized roll of taxable property in each of the Project Areas of the Agency, the projected assessed value of such taxable property, the projected amounts to be set aside into the Low and Moderate Income Housing Fund of the Agency pursuant to Health and Safety Code Sections 33334.2(a) and 33334.6(c), the housing requirements specified in paragraph 1.a, b and c of that certain Stipulation for Entry of Judgment in Case No. Indio 51124, the projected housing needs included in the requirement set forth in paragraph 1.d of the Stipulation, and the estimated amounts of money necessary to meet the requirements of paragraph 1.a, b, c and d of the Stipulation. The revised report includes evidence and analysis reasonably supporting and substantiating the projections therein. The revised report is hereby approved. Section 2. The Agency hereby finds and determines that (i) the amounts of tax increment revenues proposed to be paid to taxing agencies and the amounts of surplus described on pages 18, 19 and 20 of the revised report constitute "excess tax increments" within the meaning of that term under paragraph 2 of the Stipulation, and are not and will not be necessary to meet the housing requirements set forth in paragraph 1.a, b and c of the Stipulation with respect to Project Areas Nos. 1 and 2, and are not and will not be necessary to meet the housing requirements set forth in paragraph 1.d of the Stipulation with respect to Project Area No. 2 of the Agency, and (ii) long-term obligations (including, without limitation, bonds, notes and other evidences of indebtedness) of the Agency to finance redevelopment activities unrelated to affordable housing which are payable on an annual basis from the amounts described in the foregoing clause (i) will constitute "prior indebtedness" within the meaning of that term under paragraph 2 of the Stipulation. 920206 ajh 0320485 RESOLUTION NO. 255 PASSED, APPROVED and ADOPTED this 13th day of February , 1992. KELLY, CHAIRMAN RESOLUTION NO. 255 PAGE 3 REPORT REGARDING EXCESS TAX INCREMENT REVENUES (REVISED) This revised Report (this "Report") has been prepared pursuant to paragraph 2 of the Stipulation for Entry of Judgement in Case No. Indio 51143, entitled City of Palm Springs v. All Persons Interested (the "Stipulation"). The purpose of this Report is to set forth facts and projections upon which the Palm Desert Redevelopment Agency may make a finding that certain amounts of tax increment revenues, as identified in this Report, are not and will not be necessary to meet the housing requirements set forth in the Stipulation and more fully described below, and that such tax increment revenues may be pledged on an annual basis to pay annual debt service requirements on long-term obligations of the Agency to finance redevelopment activities other than housing. 1. According to the last equalized assessment roll of the County of Riverside, the assessed value of taxable property in each of the Project Areas of the Agency is a follows: Project Area No. 1, As Amended (Original Territory) - $499,006,235; Project Area No. 1, As Amended (Added Territory) - $ 1, 530, 242,143; Project Area No. 2 - $ 517, 242,143; and Project Area No. 3 - $152,824,265. (The foregoing amount is the 1990-1991 base year assessment roll for Project Area No. 3. The 1991-1992 assessment roll is not available for Project Area No. 3.) Attachment No. 2 to this Report are documents received by the Agency from the County which confirm the assessed values of secured and unsecured property. The average percentage increases in assessed valuation of taxable property over the six -year period described above are as follows: for the Original Territory, 8.8%; for the Added Territory, 8.2%; and for Project Area No. 2, 24.7%. Project Area No. 3 was established in 1991; therefore there is as yet no historical basis for comparison. For purposes of this Report the growth within Project Area No. 3 is assumed to be the gradual buildout of undeveloped areas in accordance with the City's general plan by fiscal year 2006-2007, together with a growth rate of 4%. The projected rates of growth for the Original Territory for the first several years were selected at levels which are less than either the Added Territory or Project Area No. 2 because the remaining undeveloped land in the Original Territory is much Tess than that which remains in either the Added Territory or in Project Area No. 2. Also, the Original Territory may be characterized as primarily commercial, and therefore not subject to the same frequency of resale and reassessment as residential property. The expectations of City and Agency staff are that more undeveloped land in Project Area No. 2 will be developed in the near future than will be the case in the Added Territory. Because of the lack of historical information related to Project Area No. 3, and because there is relatively lithe undeveloped land in Project Area No. 3, a more conservative growth rate of only 4% has been assumed. For purposes of this Report, a basic tax rate levy of only 1.00 has been assumed for the Added Territory, for Project Area No. 2 and for Project Area No. 3. In the Original Territory, however, where there are no existing pass -through agreements with taxing agencies and where there are certain override tax rates which should be applied on behalf of the Agency, a tax rate of 1.09 has been assumed until fiscal year 2003-2004. Attachment No. 7 to this Report are tables which set forth the projected tax increment revenues and the amounts to be set aside on an annual basis into the Low and Moderate Income Housing Fund. 4. Under paragraph 1 of the Stipulation, the Agency is obligated to acquire by December 31, 1992, not less than 21 housing units to be occupied by and available at affordable housing costs to very low income households and not less than 78 housing units to be occupied by and available at affordable housing costs to lower income households. To date, the Agency has acquired 148 of such very low income units and 148 of such lower income units. In addition, the Agency is obligated to acquire, develop or rehabilitate by December 31, 1995, 366 housing units to be occupied by and available at affordable housing costs to very low income households, 367 housing units to be occupied by and available at affordable housing cost to lower income households, and 367 housing units to be occupied by and available at affordable housing cost to moderate income households. In addition, upon completion of the acquisition, development or rehabilitation of the required housing units and upon their reaching a 90 percent occupancy level, the Agency is obligated to acquire, develop or rehabilitate 100 housing units to be occupied by and available at affordable housing cost to very low income households and 60 housing units to be occupied by and available at affordable housing cost to lower income households. 920206 ajh 0320486 (6) RESOLUTION NO. 255 PAGE 14 5. Attachment No. 3 to this Report is a copy of the existing and future housing needs for very low, lower and moderate income households in the City of Palm Desert as forecast by the Southern California Association of Governments. Attachment No. 4 to this Report is a copy of the existing and future housing needs for such households as set forth in the Housing Element of the General Plan of the City, which has been revised in accordance with Government Code Section 65588(b). Attachment No. 5 to this Report is an analysis which as been prepared with the cooperation of the Riverside County Housing Authority. Exhibits 1, 2 and 3 to Attachment No. 5 are operating "pro formas" which reflect actual experience of the Housing Authority. Exhibit 4 to Attachment No. 5 sets forth the total estimated amounts necessary to subsidize housing available at affordable cost to households at the more restrictive income levels for applicable time periods set forth in the Stipulation. Those income levels require that for housing units to be made available to very low income households, at least one-third of the housing units shall be affordable to households with 35 percent or Tess of median income, with the remainder affordable to households with 45 percent or less of median income. Those income levels require that for housing units to be made available to lower income households, at least one-third of the housing units shall be affordable to households with 55 percent or less of median income, one-third to households with 65 percent or less of median income and the remainder to households with 75 percent or Tess of median income. These income levels further require that for housing until to be make available to moderate income households, the units shall be at least affordable to moderate income households who cannot afford housing at market rates. The estimates set forth in Exhibit 4 to Attachment No. 5 are in turn based upon the actual experience of the Housing Authority as reflected in Exhibits 1, 2 and 3. The analysis in Exhibit 4 to Attachment No. 5 also takes into account the costs of developing, maintaining and managing the housing units. Exhibits 1-4 of Attachment No. 5 provided the basis for such column. The column on the previous page labeled "Annual Set -Aside" includes a beginning surplus balance of $7,846,741. Because of the difficulty in estimating the cash flows in and out of the fund, no investment earnings have been assumed. Attachment No. 6 to this Report is a present value calculation of the projected cost of the housing requirements of the Stipulation together with a present value calculation of the projected available revenues from the Agency's Low and Moderate Income Housing Fund. As shown on Attachment No. 6, from both a cumulative total and present value standpoint the Agency will have more than sufficient funds to meet the housing requirements. Based upon the foregoing analysis of past, current and projected future assessed values of taxable property in all Project Areas of the City, tax increment revenues set aside into the Low and Moderate Income Housing Fund of the Agency will be more than sufficient to meet the obligations of the Agency under the Stipulation. The Agency proposes to amend its existing pass -through agreements with the taxing agencies in the Added Territory. Among the tables set forth in Attachment No. 7 are tables which show the distribution of tax increment revenues from each of the Project Areas, taking into account the set -aside requirements, the provisions of the proposed pass -through agreements and the 920206 ajh 0320486 (6) - 17 - RESOLUTION NO. 255 PAGE 20 growth rates described on page 4 of this Report. For example, the Agency may issue long-term bonds and place a portion of the proceeds in an escrow. The proceeds placed in the escrow would only be withdrawn by the Agency in the future if the future tax increment revenues allocated to the Agency met the projections. If the projections were not met, the tax increment revenues would not support the debt represented by the proceeds of the bonds placed in the escrow, and those proceeds would then be used to call and redeem a like principal amount of bonds prior to their stated maturity date. Pending their withdrawal from the escrow (either for the purpose of expenditure by the Agency or for the purpose of call and redemption of bonds) those proceeds would be invested at a rate of interest sufficient to pay interest on the bonds from which the escrowed proceeds were derived. The amounts of tax increment revenues proposed to be paid to taxing agencies and the amounts of surplus described on the foregoing tables constitute "excess tax increments" within the meaning of that term under paragraph 2 of the Stipulation, and are not and will not be necessary to meet the housing requirements set forth in paragraph 1.a, b and c of the Stipulation with respect to Project Areas Nos. 1 and 2, and are not and will not be necessary to meet the housing requirements set forth in paragraph 1.d of the Stipulation with respect to Project Area No. 2. Exhibits 1, 2 and 3 are specific housing project pro formes prepared by the Riverside County Housing Authority for the three apartment complexes which have been acquired to date in furtherance of the Palm Desert Redevelopment Agency's affordable housing program and in furtherance of the Agency's efforts to meet its obligations under the Stipulation. These projects are One Quail Place (384 units, of which 77 will be made available to very low income households, 77 will be made available to lower income households and 77 will be made available to moderate income households), Las Serenas (150 units, of which 50 will be made available to very low, 50 to lower and 50 to moderate income households), and Desert Pointe (63 units, of which 21 will be made available to very low, 21 to lower and 22 to moderate income households). Exhibit 4 is a pro forma of the Agency's long-range program and goals to meet its obligations under the Stipulation based on (i) the subsidy costs derived from Exhibits 1, 2 and 3; (ii) cost estimates for future additions to the program; (ill) and projected tax increment revenues from Project Areas Nos. 1, 2 and 3 to be set aside into the Agency's Low and Moderate income Housing Fund. Tax increment revenues are based on conservative assumptions with projected growth rates below actual historical rates. The City of Palm Desert has independently established an affordable housing mitigation fee assessed on all hotel, commercial, office and industrial uses. Although the proceeds of this housing mitigation fee will also be available to assist in the financing of the Agency's affordable housing program and its efforts to meet its obligations under the Stipulation, the Agency has not included proceeds of the fee in its revenue projections. The requirement of the Stipulation that 255 units be acquired by December 1992, of which 21 units are to be occupied by and available at affordable housing cost to very low income households and not less than an additional 78 units are to be occupied by and available at affordable housing cost to lower income households, has already been met. The projections and the pro forma also show that the requirement of the Stipulation that 1359 affordable units be acquired by July 1, 1995, will be met during the 1994-95 fiscal year.
