WHEREAS, the Palm Des-ert Redevelopment Agency did on the 14th day of May, 1992, hold a duly noticed public hearing to consider the request of a Negative Declaration of Environmental Impact and a Disposition and Development Agreement (DDA between the Palm Desert Redevelopment Agency (Agency) and Sterlinq Partners, Inc. (Developer) concerning the purchase and conveyance by the Agency of 23 acres for the purpose of facilitating the development by Developer of a 161-uni single-family housing:development {precise Plan 91-12} affordable for low and moderate income households on 23 acres on the north side of Fred Waring Drive, 1400 feet east of Cook Street; and WHEREAS, said Development and Disposition Agreement has complied with the California Environmental Quality Act in that an initial study was completed and a determir ation nade that the DDA will not have a significant adverse impact on the environmental and a Negative Declaration has been prepared. A Negative Declaration __ of Environmental Impact for the project specified in said DDA was approved by the Palm Desert City Council on.March 26, 1992 as part of their approval of Precise Plan 91-12; and WHEREAS, at said public hearing, upon hearing and considering all testimony and argwnents, if any, of all interested persons desiring to be heard, said Redevelopment Agency did find the following facts and reasons to exist to ju5tify approval of said Disposition and Development Agreement: 1. The Construction of the Improvements specified by the DDA will assist in the elimination of blight in the Project Area specified by the DDA, provide affordable housing, provide additional jobs, and substantially improve the economic and physical conditions in the Project Area in accordance with the purposes and goals of the Redevelopment Plan. 2. Agency has determined that the land uses specified in this Agreement and the provisions relating to construction of the Improvements specified in this Agreement are consistent with the provisions of the Redevelopment Plan and each of its applicable elements. RESOLUTION NO. 262 3. Construction of the Improvements constituting the Project pursuant to this Agreement is in the best interests of the Agency, and the health, safety and welfare of the residents and taxpayers of the Project Area, and is in accord with the public purposes and provisions of applicab].e state and local laws. NOW, THEREFORE, BE IT RESOLVED by the Palm Desext Redevelopment Agency Board as follows: 1. � 3. That the above recitations are true and correct and constitute the findings of the Council in this case. That a Negative Declaration of Environmental Impact, Exhibit "A", and DDA, Exhibit "8", are hereby approved. That the Chairperson be authorized to execute DDA Exhibit nBn. NEGATIVE DECLARATION CASE NO./TITLE: Disposition and Development Agreement, PP 91-12 APPLICANT/PROJECT SPONSOR: Palm Desert Redevelopment Agency and Sterling Partners, Inc. PROJECT DESCRIPTION/LOCATION: A Negative Declaration of Environmental Impact and a Disposition and Development Agreement (DDA) between the Palm Desert Redevelopment Agency (Agency) and Sterling Partners, Inc. (Developer) concerning the purchase and conveyance by the Agency of 23 acres for the purpose of facilitating the development by Developer of a 161 unit single family housing development (Precise Plan 91-12) affordable for low and moderate income households on 23 acres on the north side of Fred Waring Drive, 1400 feet east of Cook Street. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
