HomeMy WebLinkAboutRDA RES 282RESOLUTION NO. 282 A RESOLUTION OF THS PALK D$SSRT RBD$VSLOPMENT AGENCY APPROVING PAYI SNTS ieTITH C$RTAIN AFFECTED TASING AG$NCI$S PURSUANT TO VARIOUS COOPSRATIVE AGRB$I NTS iiITH RSSPl3CT TO PROJECT AREA N . 4 THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The City of Palm Desert and the Palm Desert Redevelopment Agency have undertaken certain proceedings pursuant to the Community Redevelopment Law to adopt the Redevelopment Plan for Project Area No. 4. California Health and Safety Code section 33401 provides that the Agency may pay to any taxinq agency with territory located within a project area, other than the City, any amounts of money which the Agency has found are necessary and appropriate to alleviate any financial burden or detriment caused to the taxinq agency by the project. Section 2. The Executive Director of the Aqency has presented to the Aqency drafts of proposed cooperative agreements pertaining to Project Area No. 4 of the Aqency, with the Desert Sands Unified School District, the Desert Community college District, the Coachella Valley Mosquito Abatement District, the Coachella Valley Recreation and Parks District, the Coachella Valley Resource Conservation Center, respectively. Each of such cooperative aqreements provides for payments to the taxing agency which is a party thereto to alleviate any financial burden or detriment caused by the redevelopment projects contemplated thereby. Section 3. California Health and Safety Code Section 33012 defines "financial burden or detriment" as a net increase in the quality or quantity of a service of the affected taxinq entity caused by the redevelopment project or a loss of property tax revenues by the affected taxinq entity produced by a change of ownership or new construction which would have been received, or was reasonably expected to have been received, by the taxinq entity if the redevelopment project was not established. Representatives of the Agency have consulted with representatives of each of the taxinq aqencies described in Section 2 hereof, and such taxing aqencies have presented substantial evidence of the financial burden or detriment, as defined in California Health and Safety Code Section 33012, caused by the redevelopment projects � RESOLUTION NO. 282 contemplated by the cooperative agreements described in Section 2 hereof. Based on such evidence and other reports and information presented to the Agency, the Agency hereby finds and determines that the Agency's implementation of the redevelopment projects as contemplated by the agreements described in Section 2 hereof will result in a financial burden or detriment to such taxing agencies, and payments pursuant to �uch cooperative agreements are hereby approved. The Agency hereby finds and determines that the payments provided for in each such agreement are necessary to alleviate the financial burden or detriment to the applicable taxing aqency. The respective agreements, which are on file in the office of the Executive Director of the Agency are hereby approved, and the Executive Directar of the Agency is hereby authorized and directed for and on behalf of the Agency to execute and deliver such agreements for and on behalf of the Agency.
