HomeMy WebLinkAboutRDA RES 283RESOLUTION NO. 283 A RESOLUTION OF THE PALM DESERT REDEVELOPMENT AGENCY APPROVING PAYMENT BY THE AGENCY FOR ALL OR A PART OF THE COST OF TiiE INSTALLATION OF MEDIAN LANDSCAPING THE PALM DE5ERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. Pursuant to provisions of the Community Redevelopment Law (California Health and Saiety Code Section 33000, et seq.), and in particular Section 33445 thereof, the Palm Desert Redevelopment Agency proposes to pay all or a part of the cost of the installation of landscaping in the Country Club Drive median between Cook Street to the east and Oasis Club Drive to the west. The subject median is located partially in Project Area No. 2 of the Agency. The installation of the landscapinq will provide beautification, thereby enhancing the desirability of the surroundings. The installation of the landscaping will also improve water conservation by replacinq the existing landscapinq with drought tolerant landscaping and improve aesthetics by providing for landscaping which is consistent with the City's landscaping design theme. The installation of the landscaping will also correct a hazardous condition; the existing sprinkler system causes wet street pavement which creates a traffic hazard and contributes to pavement deterioration. The installation of the landscaping will improve the aesthetics of the area, conserve water, prevent deterioration and correct a hazardous condition, all for the benefit of the health, safety and welfare of the residents and taxpayers of Project Area No. 2 and the immediate neighborhood. Section 2. The Coachella Valley Water District proposes to contribute approximately 20 percent of the cost of installing the landscaping. The budget constraints of the City prevent the City from financinq the remaining cost of such installation by any means. Traditional methods of financing such improvements such as general obligation bonds are not available as a practical matter because of the extraordinary voter approval requirement. Special assessment or special tax financing could overburden benefitting properties with assessments or taxes which would be added to existing taxes and assessments. Section 3. The Agency hereby finds and determines that, based upon the foregoing and other information presented to the City Council: (i) the landscaping described in Section 1, above, is of benefit to Project Area No. 2 of the Agency and to the immediate neighborhood in which the Pro ject is located; and ( ii ) no other reasonable means of financing such landscaping is available to the City. RESOLUTION N0. 3 Section 4. The Agency hereby approves payment of all or part of the cost of the installation of the landscaping from any funds of the Agency lawfully available therefor.
