HomeMy WebLinkAboutRDA RES 286RESOLUTION NO. 286 A RBSOLUTION OF TFIB PALM DBSSRT RBDEVBLOPMSNT AGSNCY APPROVING PAYNBNTS WITH CSRTAIN AFFSGTSD TAXING AGBNCISS PURSUAN'P TO VARIOUS COOPSRATIVS AGRBSI iBNTS hIITH RSSPgCT TO PROJSCT ARSA NO. 4 THE PALM DESERT R$DEVELOPMi;NT AG NCY HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The City of Palm Desert and the Falm Desert Redevelopment Aqency have undertaken certain proceedings pursuant to the Community Redevelopment Law to adopt the Redevelopment Plan for Project Area No. 4. California Health and Safety Code Section 33401 provides that the Agency may pay to any taxing aqency with territory located within a project area, other than the City, any amounts of money which the Agency has found are necessary and appropriate to alleviate any financial burden or detriment caused to the taxing agency by the project. ection 2. The Sxecutive Director of the Agency has presented to the Agency drafts of proposed cooperative agreea ents pertaininq to Project Area No. 4 of the Aqency, with the Riverside County Superintendent of Schools and the Coachella Valley water District. $ach of such cooperative aqreements provides for payments to the taxing aqency which is a party thereto to alleviate any financial burden or detriment caused by the redevelopment projects contemplated thereby. Section 3. California Health and Safety Code 5ection 33012 defines "financial burden or detriment" as a net increase in the quality or quantity of a service of the affected taxing entity caused by the redevelopment project or a loss of property tax revenues by the affected taxing entity produced by a change of ownership or new construction which would have been received, or was reasonably expected to have been received, by the taxing entity if the redevelopment project was not established. Representatives of the Aqency have consulted with representatives of each of the taxing aqencies described in Section 2 hereof, and such taxing agencies have presented substantial evidence of the financial burden or detriment, as defined in California Health and Safety Code Section 33012, caused by the redevelopment projects contemplated by the cooperative agreements described in Section 2 hereof. Based on such evidence and other reports and information presented to the Agency, the Agency hereby finds and determines that the Aqency's implementation of the redevelopment projects as contemplated by the aqreements described in Section 2 hereof will R.SSOLUTION AIO. 286 result in a financial burden or detriment to such taxing aqencies, and payments pursuant to such cooperative agreements are hereby approved. The Agency hereby finds and determines that the payments provided for in each such agreement are necessary to alleviate the financial burden or detriaent to the applicable taxing aqency. The respective agreements, which are on file in the office of the Executive Director of the Aqency are hereby approved, and the Executive Director of the Ager�cy is hereby suthorized and directed for and on behalf of the Aqency to execute and deliver such agreements for and on behalf of the Agency.
