The Agency's proposed conveyance of the Property to Habitat for the development of a single-family residence has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the Director of Community Development has determined that the project is a Class 3 categorical exemption and no further documentation is necessary. ection 6. The Agency hereby determines that the proposed conveyance of the Property to Habitat constitutes a small housing project as defined in Health and Safety Code Section 33013. Accordingly, the Agency hereby elects not to apply the requirements of Health and Safety Code Section 33433 (a) and 33433 (b). Section 7. The Agency hereby approves the conveyance of the Property to Habitat in accordance with the terms and conditions of the Agreement pursuant to the requirements of Health and Safety Code Section 33433 (c). Section 8. The Agency hereby directs, in accordance with the requirements of Health and Safety Code Section 33433 (c), that the Executive Director of the Agency shall prepare a report to the City Council on or before 30 days after the end of the Agency's present fiscal year disclosing the name of the owner of the Property, the legal description or street address of the Property, the date of the conveyance of the Property, the restrictions imposed by the Agreement on the owner of the Property and the date on which the Agency held a public hearing on the conveyance of the Property. , PASSED, APPROVED AND ADOPTED this 8th day of December, 1994. FOR TH$ DEVSLOPI�NT OF A SINGI�i-FAMILY RESIDSNCB ON SAID PROP$RTY THE PALM DESERT REDEVEI,OPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: SectiQn l. Health and Safety Code Section 33433 requires that before any property of the Agency acquired in whole or in part, directly or indirectly, with tax increment moneys is sold or leased for development pursuant to the redevelopment plan, said conveyance shall first be approved by the Agency by resolution after public hearing. Section 2. on October 27, 1994, the Agency approved an Agreement ("Agreement"} between the Agency and Habitat for Humanity of the Coachella Valley, Inc. ("Habitat") by which, among other things,-the Agency agrees to convey that certain real property located at 44-180 E1 Cercado, Palm Desert, California (the "Property") to Habitat subject to the Agency's compliance with the requirements of Health and Safety Code Section 33433. Se�tion 3. on December 8, 1994, the Agency held a duly noticed public hearing on the approval of the Agency's proposed conveyance of the Property to Habitat at which time all persons desiring to comment on or ask questions concerning the conveyance of the Property to Habitat were given the opportunity to do so , Prior to the public hearing, information concerning the Agency's proposed conveyance o£ the Property to Habitat was available for public inspection in the offices of the City of Palm Desert's Department of Community Development at 73-510 Fred Waring Drive, Palm Desert, California, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Notice of the public hearing was published in the Desert Post on November 23, 1994 and November 30, 1994. S�ction 4. The Agency has reviewed and considered all written and oral comments, questions and concerns regarding the Agency's proposed conveyance of the Property to Habitat received prior to and at the public hearing on said conveyance.
