A RESOLUTION OF THE PALM DESERT REDEVELOPMENT
AGENCY DECLARING CERTAIN REAL PROPERTY
NECESSARY FOR PUBLIC PURPOSES AND AUTHORIZING
THE ACQUISITION THEREOF
THE PALM DESERT REDEVELOPMENT AGENCY DOES HEREBY FIND,
DETERMINE, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The Palm Desert Redevelopment Agency is a
public body, corporate and politic, in the City of Palm Desert,
County of Riverside, State of California.
Section 2. The property hereinafter described is to be
taken for a public use, namely, for purposes of redevelopment, as
defined in the Community Redevelopment Law, Health and Safety
Code Sections 33000 to 34152, inclusive, and in particular Health
and Safety Code Sections 33020 and 33021, pursuant to the
authority conferred upon the Palm Desert Redevelopment Agency to
acquire property by eminent domain by Health and Safety Code
Section 33391 and Code of Civil Procedure Sections 1230.010 et
seQ. (Eminent Domain Law), including but not limited to Sections
1240.010, 1240.020, 1240.110, 1240.120.
Section 3.
Redevelopment Project
is more particularly
Parcel 1:
The property to be taken is located in
Area No. 2 in the City of Palm Desert and
described as:
The southerly 880 feet of the north half of the southeast quarter
of section 4, township 5 south, range 6 east, San Bernardino base
and meridian;
Excepting therefrom the east 1650 feet;
Also excepting 1/2 of all crude oil, petroleum, gas, brea,
asphaltum, and all kindred substances and other, minerals under
and in said land, as reserved in deed from Henry A. Dustin and
Pearl M. Dustin, husband and wife, dated December 16, 1955,
recorded January 21, 1956, as Instrument No. 1895 in Book 1845
Page 474, of Official Records of Riverside County, California.
Parcel 2:
An easement for ingress and egress over the southerly 30 feet of
easterly 1650 feet of the north half of the southeast quarter of
section 4, township 5 south, range 6 east, San Bernardino base
and meridian;
Excepting therefrom 1/2 of all crude oil, petroleum, gas, brea
asphaltum, an all kindred substances and other minerals as

reserved in deed from Henry A. Dustin and Pearl M. Dustin,
husband and wife, dated December 16, 1955 and recorded
January 11, 1956 as Instrument No. 1901 in Book 1845 Page 471,
Official Records of Riverside County, California.
Section 4. The governing body of the Palm Desert
Redevelopment Agency hereby finds and determines, that:
(a) The public interest and necessity require the
proposed project;
(b) The proposed project is planned and located
in the manner that will be most compatible with the qreatest
public good and the least private injury;
(c) The property hereinabove described is
necessary for the proposed project; and
(d) The offer required by Section 7267.2 of the
Government Code has been made to the owners of record.
Section 5. The Palm Desert Redevelopment Agency hereby
authorizes and directs the Agency counsel to take all steps
necessary to commence and prosecute legal proceedings in a court
of competent jurisdiction to acquire the property interests
hereinabove described by eminent domain.
PASSED, APPROVED and ADOPTED by the Palm Desert
Redevelopment Agency this 24th day of August, 1995.
