A RESOLUTION OF THE PALM DESERT REDEVELOPMENT
__ AGENCY APPROVING THE LEASING OF APPROXIMATELY 22
ACRES OF REAL PROPERTY LOCATED ON SOUTHEAST
CORNER OF COOK STREET AND GERALD FORD DRIVE, PALM
DESERT, CALIFORNIA, TO RONALD ODEKIRK AND RICK
ODEKIRK
THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS,
: DETERMINES, RESOLVES AND 4RDERS AS FOLLOWS:
Section 1. On December 14, 1995, the Agency held a duly noticed public
hearing on the approval of the Agency's proposed lease of certain real property (the
"Property") described in that certain Disposition and Development Agreement (the "DDA"
or the "lease") between the Agency and Ronald Odekirk and Rick Odekirlc (collectively, the
"Developer"), at which time all persons desiring to comment on or ask questions
concerning the lease of the Property to the Developer were given the opportunity to do so.
Prior to the public hearing, information concerning the Agency's proposed lease of the
Property to the Developer was available for public inspection in the o�ces of the City of
Palm Desert at 73-510 Fred Waring Drive, Palm Desert, California 92260, between the
hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Notice of the public hearing was
_ published in the Desert Sun on November 29, 1995 and December 6, 1995.
S c i n . The Agency has reviewed and considered all written and oral
comments, questions and concerns regarding the Agency's proposed conveyance of the
Property to the Developer received prior to and at the public hearing on said conveyance.
ion . The environmental impacts of the Agency's proposed lease of the
property to the Developer for the development of the improvements thereon was analyzed
by the City's Planning Commission on December 6, 1994, and has found that the
described project would have no significant effect on the environment. The environmental
findings with respect to the project are attached hereto as Exhibit "A" to the Agency's
Resolution being adopted concurrently herewith, entitled "A Resolution of the Palm Desert
Redevelopment Agency Approving the Leasing of Approximately 22 acres of Real Propecty
Located on the Southeast Corner of Cook Street and Gerald Ford Drive, Palm Desert,
California, to Ron Odekirk and Rick Odekirk", and the City concurs with such findings.
Section 4. The DDA requires the Developer to construct certain
improvements on the Property as therein described, including, among other things, a
softb�ll complex containing three softball fields; four sand volleyball courts for league �nd
tournament play; and a multi-purpose covered structure containing three basketball courts,
convertible to one indoor soccer or hockey field, and a stage area.

ti n. The Agency has obtained an evaluation of the fair rental value of
the Property from Real Estate Analysis Services Co., who has determined that: (1) the
consideration ($3.39 per sq. ft.) is not less than the fair market value of $1.69 per sq. ft.;
and (2) the consideration ($3.39 per sq. ft.) is not less than the fair reuse value of $3.22
per sq. ft..
S c ion . The Agency hereby finds that the sale of the Property pursuant
to the DDA will assist in the elimination of blight due to the obligation of the Developer to
construct thereon the improvements described in the DDA.
Se " n 7. The Agency hereby finds that the consideration to be paid by the
Developer is not less than the fair rental value of the Property at its highest and best use
in accordance with the Redevelopment Plan for Project Area No. 2 of the Agency.
S ion . The Agency hereby approves the lease of the Property to the
Developer in accordance with the terms and conditions of the DDA pursuant to the
requirements of Health and Safety Code Section 33433 (b).
PASSED, APPROVED AND ADOPTED by the Palm Desert Redevelopment
Agency, Palm Desert, California, at its regular meeting held on the 2stn day of

PROJECT DESCRIPTION/LOCATION: A 25+/- acre multi-use, pay for play,
recreation facility to be located on approximately 25 acres of city
owned property at the southeast corner of Gerald Ford and Cook Street.
The Director of the Department of Community Development, City of Palm
Desert, California, has found that the described project will not have
a significant effect on the environment. A copy of the Initial Study
has been attached to document the reasons in support of this finding.
Mitigation measures, if any, included in the project to avoid
potentially significant effects, may also be found attached.
