A RESOLUTION OF THE PALM DESERT REDEVELOPMENT
_ AGENCY DECLARING CERTAIN REAL PROPERTY
NECESSARY FOR PUBLIC PURPOSES AND AUTHORIZING
THE ACQUISITION THEREOF
THE PALM DESERT REDEVELOPMENT AGENCY DOES HEREBY FIND,
DETERMINE, ORDER AND RESOLVE AS FOLLOWS:
Section l. The Palm Desert Redevelopment Agency is a
public body, corporate and politic, in the City of Palm Desert,
County of Riverside, State of California.
Section 2. The property hereinafter described is to be
taken for a public use, namely, for purposes of redevelopment, as
defined in the Community Redevelopment Law, Health and Safety
Code Sections 33000 to 34152, inclusive, and in particular Health
and Safety Code Sections 33020 and 33021, pursuant to the
authority conferred upon the Palm Desert Redevelopment Agency to
acquire property by eminent domain by Health and Safety Code
Section 33391 and Code of Civil Procedure Sections 1230.010 e�
� sea. (Eminent Domain Law), including but not limited to Sections
1240.010, 1240.020, 1240.110, 1240.120, and 1240.610.
Section 3. The property to be taken is located in the
Redevelopment Project Area No. l, in the City of Palm Desert and
is more particularly described on Exhibit A attached hereto.
Section 4. The potential environmental impacts of the
acquisition of the Subject Property were analyzed in connection
with Conditional Use Permit 95-2 and on May 25, 1995 the City
Council approved a Negative Declaration of Environmental Impact
with respect to the project. Pursuant to CEQA Guidelines 15162
those findings are also the appropriate findings with regard to
the proposed acquisition of the Subject Property. The
environmental documentation prepared in connection with the
approved Negative Declaration of Environmental Impact was
reviewed by Staff on July 22, 1997 and it was determined that no
significant changes in the project or in the environment had
occurred and no new information had been obtained since the City
Council determination on May 25, 1995, which would require
further environmental analysis.

Section 5. The governing body of the Palm Desert
Redevelopment Agency hereby finds and determines that:
(a) The public interest and necessity require the
proposed project;
(b) The proposed project is planned and located
in the manner that will be most compatible with the greatest
public good and the least private injury;
(c) The property hereinabove described is
necessary for the proposed project; and
(d) The offer required by Section 7267.2 of the
Government Code has been made to the owner of record.
Section 6. The Palm Desert Redevelopment Agency hereby
authorizes and directs the Agency counsel to take all steps
necessary to commence and prosecute legal proceedings in a court
of competent jurisdiction to acquire the property hereinabove
described by eminent domain.
PASSED, APPROVED and ADOPTED by the Palm Desert
Redevelopment Agency this 9th day of October, 1997.
