HomeMy WebLinkAboutRDA RES 432RESOLUTION NO. 432 A RESOLUTION OF THE PALM DESERT REDEVELOPMENT AGENCY APPROVING A JOINT EXERCISE OF POWERS AGREEMENT BETWEEN THE PALM DESERT REDEVELOPMENT AGENCY AND THE COUNTY OF RIVERSIDE RECITALS: A. The Joint Exercise of Powers Act, California Government Code Section 6500, et seg. (the "Act"), provides that public agencies by agreement may jointly exercise any power common to the contracting parties. B. The Palm Desert Redevelopment Agency (the "Agency") and the County of Riverside (the "County") are "public agencies" within the meaning of that term under Section 6502 of the Act. C. Among the common powers of the Agency and the County are the power to borrow money by the issuance of bonds, notes or other obligations; the power to sell bonds, notes or other obligations; the power to purchase bonds, notes or other obligations; the power to acquire and dispose of real and personal property; the power to pay for the cost of publicly owned improvements; and the power to accept financial assistance from various public sources. D. The Agency desires to enter into the Agreement (as defined herein) in furtherance of the Act. NOW THEREFORE, THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The form of Joint Exercise of Powers Agreement (the "Agreement"), dated as of January 1, 2002, by and between the Agency and the County, is hereby approved, and the Chairman of the Agency is hereby authorized and directed, for and on behalf of the Agency, to execute and deliver the Agreement in substantially the form on file with the Secretary of the Agency and presented to this meeting, with such changes therein as the Chairman of the Agency may approve, such approval to be conclusively evidenced by his execution and delivery thereof. Section 2. The Secretary of the Agency shall cause a copy of the Agreement to be filed with the Califomia Secretary of State pursuant to Section 6503.5 of the Act, and shall cause to be filed with the Califomia Secretary of State and with the County Clerk of the Coun� of Riverside the information required by Section 53051 of the Government Code of the tate of California. _...
