HomeMy WebLinkAboutRDA RES 526RESOLUTION NO. 526 A RESOLUTION OF THE PALM DESERT REDEVELOPMENT AGENCY ADOPTING AN AMENDMENT TO THE AGENCY'S THIRD FIVE-YEAR IMPLEMENTATION PLAN (FY 2004-05 THROUGH 2O08-09). RECITALS: WHEREAS, California Health and Safety Code Section 33490 ("Section 33490") requires that redevelopment agencies adopt implementation plans for its project areas every five years, containing the specific goals and objectives of the agency for the project areas, the specific programs (including potential projects), and estimated expenditures proposed to be made during the next five years, and an explanation of how the goals and objectives, programs and expenditures will eliminate blight within the project areas and implement the low and moderate income housing requirements of the Community Redevelopment Law (Health and Safety Code Section 33000, et seq.); and WHEREAS, pursuant to Section 33490, a redevelopment agency may adopt a single implementation plan that includes one or more project areas; and WHEREAS, after a duly held public hearing, the Agency adopted Resolution No. 496, on November 18, 2004, approving and adopting the "Third Five- '"" Year Implementation Plan (FY 2005-05 through 2008-09)" (the "Third Implementation Plan") for the Agency's four project areas: Project Area No. 1, As Amended, Project Area No. 2, Project Area No. 3 and Project Area No. 4(collectively, the "Project Areas"); WHEREAS, Section 33490 provides that an implementation plan, once adopted, may be amended after a public hearing on the proposed amendment; and WHEREAS, the Agency has prepared "Amendment No. 1 to the Third Five-Year Implementation Plan (FY 2005-05 through 2008-09)" (the "Amendment"), attached hereto and incorporated herein by reference; and WHEREAS, the Amendment updates the lists of the proposed programs and projects anticipated to be undertaken by the Agency with respect to the Project Areas during the five years covered by the Third Implementation Plan; and WHEREAS, on June 8, 2006, the Agency held a duly noticed public hearing on the proposed adoption of the Amendment at which time all persons desiring to comment on or ask questions concerning the Amendment were given the opportunity to do so. Prior to the public hearing on the Amendment, copies of the Amendment were available for public inspection in the office of the City Clerk of the City of Palm Desert (which is also the office of the Agency Secretary); and """" WHEREAS, the Agency has reviewed and considered all written and oral comments, questions and concerns regarding the Amendment received prior to and at the public hearing on the Amendment; P6402.00011892 l 84. l RESOLUTTON NO. 526 NOW, THEREFORE, THE PALM DESERT REDEVELOPMENT AGENCY DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The above recitals, and each of them, are true and correct. Section 2. The Agency hereby approves and adopts the Amendment. Section 3. The Third Implementation Plan, as amended by the Amendment, may be further amended from time to time in accordance with Section 33490. Section 4. The Agency hereby directs that the Third Implementation Plan and the Amendment remain on file in the office of the Agency Secretary and be open to public inspection. Section 5. The adoption of the Third Implementation Plan and the Amendment does not constitute an approval of any specific program, project or expenditure and does not constitute a project within the meaning of Section 21000 of the Public Resources Code. Section 6. This Resolution shall take effect immediately upon adoption. The Third Implementation was adopted on November 18, 2004, after a public hearing, pursuant to California Health and Safety Code Section 33490. The Implementation Plan included lists of certain programs and projects anticipated to be undertaken by the Agency with respect to each Project Area during fiscal years 2004-05 through 2008-09. This Amendment updates such lists of programs and projects. About the Proarams and Proiects Generallv a--- Except as expressly stated herein, the programs and projects identified below in this Amendment represent potential programs and projects that the Agency may undertake through fiscal year 2008-09, in addition to (and do not replace) those originally listed in the Third Implementation Plan. These potential programs and projects are consistent with the Agency's goals and objectives with respect to the Project Areas as stated in the Third Implementation Plan. The Third Implementation Plan as originally adopted and this Amendment, together, provide an expansive list of potential Agency undertakings. During the five-year period covered by the Third Implementation Plan and this Amendment, it is possible that the Agency will undertake some but not all of the listed projects. All costs and time frames listed for the programs and projects are estimates only and may differ from the actual costs and time frames. In the event that a program or a project is included in the list for one Project Area but is not included in the list of another Project Area (or other Project Areas), but the Agency later determines that the program or project would also benefit the latter, the Agency may use funds available from the latter Project Area {or Project Areas) to finance all or a portion of such program or project. Specific projects may also be modified or added depending on actual circumstances, including but not limited to changing needs of the Project Areas, actual costs of the projects and the availability of funding. The Third Implementation Plan will not be further amended as the result of any such addition or modification, so long as the projects are: (1) permitted by the Community Redevelopment Law (California Health and Safety Code Section 33000 et seq.), ,�, (2) consistent with the Redevelopment Plan of the related Project Area, and (3) consistent with the goals and objectives set forth in the Third Implementation Plan.
