HomeMy WebLinkAboutRDA RES 576RESOLUTION NO. 576 A RESOLUTION OF THE PALM DESERT REDEVELOPMENT AGENCY RESCINDING RESOLUTION NO. 556 AND DECLARING ITS INTENT TO WITHDRAW ITS OBJECTION TO THE SALE OF TAX-DEFAULTED PROPERTY LOCATED AT 43755 KELSEY COURT (APN 634-241-034), PALM DESERT, CALIFORNIA RECITALS A. On January 22, 2009, the Paim Desert Redevelopment Agency adopted Resolution No. 556 objecting to the sale of the tax-defaulted property located at 43755 Kelsey Court, Palm Desert, California (the "Property") by the County of Riverside Treasurer and Tax Collector (the "County Tax Collector") at a public auction and authorizing the Executive Director of the Agency to submit to the Riverside County Board of Supervisors and the County Tax Collector an application to purchase the Property. B. To complete such application, the Agency is required to execute an agreement to purchase the Property with the Riverside County Board of Supervisors pursuant to the provisions of Chapter 8(commencing with Section 3771) of Part 6 of Division 1 of the Revenue and Taxation Code and in accordance with the California State Controlier's Office County Tax Sale Procedural Manual. C. Prior to executing the agreement to purchase the Property, the Agency anticipated that it would be able to negotiate the terms and conditions of the purchase and that certain federal tax liens recorded against the Property, which exceed the Property's resale price of $114,795.50, would be discharged or would be in the process of being discharged. D. The Agency was informed that the agreement to purchase the Property cannot be amended and that the federal tax liens recorded against the Property cannot be discharged prior to the execution of the agreement. E. After further review of the proposed agreement and in light of the significant risks associated with purchasing the Property subject to the federal tax liens, the Agency finds and determines that pursuing the application to purchase the Property would not effectively serve its interest iri preserving the Property for affordability housing purposes. NOW, THEREFORE, THE PALM DESERT REDEVELOPMENT AGENCY HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The above recitals are true and correct. 1 RESOLUTION NO. 576 Section 2. The Agency hereby revokes and rescinds Resolution No. 556, thereby withdrawing its objection to the tax sale of the Property by the County Tax Collector and discontinuing its application to purchase the Property.
