WHEREAS, the City of Palm Desert, California, has heretofore adopted its Ordinance No. 1, which incorporated all of the Ordinances of the County of Riverside, as Ordinances of the City of Palm Desert, and WHEREAS, there is some question about the applicability of Ordinance No. 499 of said County to City streets without specifically making the same applicable to the City. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: SECTION 1. That Ordinance No. 499 of the County of Fiverside having heretofore been adopted by Ordinance No. 1 of said City is specifically made applicable to the roads, atree s and highways of the City of Palm Desert, California. SECTION 2. The City Clerk is hereby directed to cause this ordinance to be posted in three public places, in accordance with Resolution No. 74-17 and Section 36933 of the Government Code of the State of California. ORDINANCE NO. 4" AN ORDINANCE OF THE COUNTY OF RIVERSIDE, REGULATING ENCROACHMENTS AND EX- CAVATIONS IN COUNTY HIGH- WAYS The Board of Supervisors of the County of Riverside, State of Cali- fornia, do ordain as follows: Section 1. General. Subject to the control of the Board of Supervisors, there is hereby delegated to the County Road Commissioner the ad- ministration of the use of County highways for excavations and en- croachments, the maintenance, planting and removal of trees, and the issuance, modification and revo- cation of permits for such uses. Section 2. Encroachments and Exca- vations. No person, including firm, corporation, public district, public agency or political subdivision, shall make any excavation in, or con- struct, install or maintain any im- provement, structure or encroach- ment in, on, over or under, any County highway or the right of way thereof without first obtaining from the County Road Commis- sioner a permit therefor, or main- tain the same without such permit or in violation of the terms or conditions thereof. Such a permit shall be issued by the County Road Commissioner only upon written ap- plication therefor, and payment of the required fee or fees. Such per- mit shall be issued only if the ap- plicant is a public utility holding a current franchise from the County of Riverside, or a public district or public utility or public service agency having lawful authority to use the right of way or highway for the purpose specified, or the owner of an easement for such purpose within the highway right of way, or if the Road Commissioner is satisfied that the use proposed is in the public interest and that there will be no substantial injury to the eghway or impairment of its use c the result thereof, and that the ase is reasonably necessary for the performance of the functions of the applicant. Every such permit shall be revocable and the uses and installations thereunder shall be subordinate to any prior right of the County to use the right of way for public road purposes. Every such permit shall be conditional up- on the right of the County to re- quire the permittee to relocate or remove the structure or encroach- ment at the permittee's expense for the benefit of the County or to re- locate the structure or encroach- ment at the permittee's expense, where in the opinion of the County Road Commissioner such action is reasonably necessary to avoid a crossing conflict, for the benefit of any public district, public agency or political subdivision, or of any other person or agency having a right to use the County highway for the purpose proposed; but the acceptance of a permit shall not be deemed a waiver by the permittee of any contractual or statutory right against any party for reimburse- ment of the expense of such re- moval or relocation. Every such per- mit shall be subject to such condi- tions as the County Road Commis- sioner determines are necessary to assure the safety of the traveling public and the restoration of the surface of the highway and the foundations thereof, and of the portions outside the traveled road- way. The County Road Commis- sioner may require such surety bond or deposit of money as in his judgment may be necessary to secure performance of the cond!- tions of the permit and the replace- ment or restoration of the surface and the subsurface of the highway nd the right of way, and any survey monuments or other im- provements that may have been disturbed. The County Road Com- missioner may, where convenient to road work he has programmed, or for other reasons of County con- venience, arrange to do the work of replacement to pavement or restoration of the roadway at the expense of the permittee. If any permittee shall fail to refill any excavation or to restore the County highway or right of way to its con- dition prior to the excavation, the County Road Commissioner shall have the right to perform said work and collect in the name of the County the cost thereof. Section 3. Exceptions. An excava- tion or encroachment may be made without first obtaining a permit for repair or replacement of a facility previously installed only when necessary for the immediate protec- tion or preservation of life or prop- erty, and provided that such a per- mit be obtained on the first busi- ness day thereafter, and further pro- vided that said excavation is made in such manner as to give full protection to the users of such highway and the County of River- side. Section 4. Tree Removal. No per- son, firm, corporation, public dis- trict, public agency or political sub- division shall remove or severely trim any tree planted in the right of way of any County highway without first obtaining a permit from the County Road Commis- sioner to do so. Such permit shall be issued without fee, if the County Road Commissioner is satisfied that such removal or trimming is in the public interest or is necessary for the improvement of the right of way or the construction of improve- ments on adjacent land. He may impose such conditions as he deems reasonable or necessary, including requirements for the work to be done only by a qualified tree sur- geon or tree trimmer actually en- gaged in that business, and for bond, insurance or other security to protect person and property from injury or damage. The provisions limiting trimming of trees shall not apply to any public utility main- taining overhead power or com- munication lines pursuant to fran- chise, where necessary to prevent interference of a tree with such installation. A permit for removal of a tree may be conditioned upon its relocation or replacement by one or more other trees of a kind or type to be specified in the permit. Section S. Application. Each ap- plication for a permit under this ordinance shall be in writing in the name of the person or agency own- ing the encroachment and control- Iing the excavation and shall be signed by such person or agency or by his or its agent authorized in writing. The application shall be submitted on a form supplied by the County Road Commissioner and shall contain or be accompanied by such information as he may re- quire. Each permit shall be in writing signed by the County Road Commissioner or his representative, on a form to be furnished by him. Section S. Fees. The permit fees and inspection fees required by this ordinance shall be paid at or after the time the application is filed, but in any event before the permit is issued. Said fees for permits, which shall not be refundable, and for inspections shall be as follows: a. For tree removal or tree trimming, no fee. b. For an excavation in a County highway or right of way, with or without installation of an encroachment, a permit fee of $5.00 and an inspection fee at the following rates: For 1 to 100 lineal feet of exca- vation. $5.00. For 101 to 1000 lineal feet of ex- cavation, $10.00. For 1001 to 4000 lineal feet of ex- cavation, $15.0o. For 4001 to 7000 lineal feet of ex- cavation, $25.00. For 7001 to 10,000 lineal feet of excavation, $30.00. For each additional 10,000 lineal feet, $30.00. A series of concurrent exca- vations in the same immediate neighborhood involving a single inspection procedure shall be considered a single excavation for the purpose of determining the inspection fee. c. For an encroachment on or over a County highway, without excavation, a permit fee of $2.00 and an inspection fee of $2.00. d. For each private driveway, a permit fee of $5.00 and ari in- spection fee of $1.50. e. For concrete curbs and gut- ters and concrete driveway aprons for a single commercial development, a permit fee of s10.00, and an inspection fee of 1.50. f. For concrete curb and gut- ter, including driveway, for resi- dential use, no fee. g. For a miscellaneous permit or a permit involving a tempor- ary encroachment for 1 week or less, not involving excavation, a permit fee of $2.00. h. For relocation or removal of an encroachment, existing under permit, when required by the County Road Commissioner, no fee. The County Road Commissioner may waive the inspection fee when in his opinion the public safety or convenience does not require in- spection of an excavation or en- croachment. Section T. Exemptions. a. The following shall be ex- empted from payment of the permit fee for an excavation or encroachment: 1. A public utility which holds and at the time of ap- plication for the permit has held for at least 5 years a franchise from the Court of Riverside or the State ofty li- fornia authorizing the use of public highways, for a public utility installation. 2. Every public district, pub- lic agency or political sub- division having lawful authori- ty to use the right of way or highway for the purpose speci- fied. 3 Street improvements under special assessment or improve- ment district proceedings con- ducted by the Board of Super- visors. 4. Public utility and public service facilities installed pur- suant to specific contract with the County of Riverside and under the control thereof or a County Service Area thereof. b. The following shall be ex- empted from payment of the in- spection fee for an excavation or encroachment: 1. A public utility which holds and at the time of ap- plication for the permit has held for at least 5 years a franchise from the County of Riverside or the State ofCali- fornia authorizing the use of public highways, for (a) a pub- lic utility installation not in- volving excavation in a County highway or right of way other than as usual and necessary for the installation of poles, guys and anchors at locations entirely outside of the traveled portion of the right of way or established sidewalks, im- proved or unimproved; or (b) for a public utility installation involving only a bellhole ex- cavation to install, repair or replace a consumer service connection. 2. Street improvements under special assessment or improve- ment district proceedings con- ducted by the Board of Super- visors. 3. Public utility and public service facilities installed pur- suant to specific contract with the County of Riverside and under the control thereof or a County Service Area thereof. c. Subdivision improvements to be constructed pursuant to agreement with the County of Riverside are exempt from this ordinance. Section B. Blanket Permits. The Road Commissioner may issue to any applicant a blanket permit for a series of excavations or encroach- ments of the same type or types. This provision shall be broadly ap- plied, to reduce administrative costs of both County and applicant. Section 9. Penalties. Any person who does any act for which a per- mit is required by this ordinance without first obtaining such per- mit, or who, having obtained such a permit, violates any term or con- dition thereof and thereby jeopar- dizes or injures person or property, Is guilty of a misdemeanor and shall be punishable by a fine of not more than $500. or by imprisonment in the county jail for not more than 6 months, or by both such fine and imprisonment. Nothing herein shall be deemed to deprive any person of any civil right or remedy he may have against a violator of this or- dinance, nor to deprive the County of Riverside of any cause of action which it may have against such violator, regardless of any prose- cution or conviction under this sec- tion. Section 10. Repeal. Ordinance No. 162-B is repealed, but any permit issued pursuant thereto shall con- tinue in force as if issued pur- suant to this ordinance, and shall be subject to the provisions of this ordinance, unless and until and to the extent that such permit shall be revoked, modified or superseded pursuant hereto. Section 11. This ordinance shall take effect 30 days after its adop- tion, but shall not be operative un- til January 1, 1965. Overnight storage of containers, agri- cultural products or unlicensed vehicles on the shoulder of any county highway or within eight feet of the traveled portion of such highway is prohibited. Bulk manure not in containers may be temporarily stored or stockpiled within the right of way of a county highway only when intended to be used on the abutting agricultural lands as follows: 1.
