CONTROLLING PUBLIC NUISANCES IN SAID CITY AND

"30c"On 1 Definitions. As hereinafter set forth in this
Ordinance, the materials, conditions and situations as set forth
in subparagraphs Q) through (k) inclusive are defined as public
nuisances.
(a) Fire Hazard. All dry, dead shrubs, dead trees, combustible
refuse and waste, or any material growing around the streets, side-
welks or upon private property within the city, which by reason of
its size, manner or growth or location constitute a fire hazard to
any building, improvements, crops, or other property, property, or when
dry, will in reasonable probability constitute a hazard, is a
Cpublic nuisance. � (b) Polluted water. Any swimming pool, and or other P body of
water which is abandoned, unattended, unfiltered, or not otherwise
maintained, resulting in the water becoming polluted, constitutes a
public nuisance.
(c) Polluted water defined. Polluted water is defined for
the purpose of this chapter, as water contained in a swimming pool,
pond, or other body of water, which includes but is not limited to
bacterial growth, including algae, remains of rubbish, refuse,
debris, papers or any other foreign matter of which, because of
Its nature or location, constitutes an unhealthy, unsafe, or
unsightly condition.
(d) Public burning. The intentional outdoor burning of any
watarial, structure, matter, or thing is a public nuisance unless
authorised by the Pal■ Desert Fire Department or authorized
representative by permit. There shall be no burning on.Priday,
Saturday and Sunday.
(a) Rsfuse and Waste--. Refuse and waste matter as defined in
subsection (f) of this #action, which by reason of its location

M Refuse and waste definition. Refuse and waste matter is
defined for the purpose of this chapter as unused or discarded
matter and material having no substantial market value, and which
consists of rubbish, garbage, weeds, palm fronds, refuse, debris,
and matter of any kind including but not limited to rubble,
asphalt, concrete, plaster, tile, rocks, bricks,soil, building
materials, crates, cartons, containers, boxes, machinery or parts
thereof, scrap metal and other pieces of metal, ferrous or non-
ferrous, furniture or parts thereof, inoperative vehicles, vehicles
bodiesfor trimming from plants or trees, cans, bottles, barrels or
similar matter.
y (g) Construction problems. Any dust, sand, gravel, trash,
or other debris which is allowed to interfere with the reasonable
enjoyment of property by neighbors, or detrimentally affect property
values in the surrounding neighborhood or community and resulting
from construction within the City of Palm Desert, is declared to
be a public nuisance.
(h) Any violation of the zoning ordinance, building code,
uniform housing code, sign ordinance, uniform fire code, as the
same currently exists or as it may be hereinafter enacted or
amendedisa public nuisance.
(1) Excessive plant growth. Any trees, shrubbery or plants
permitted to grow out, into or over the streets and sidewalks
where pedestrian or vehicular traffic is impaired, or when

vehicle operators cannot clearly observe safety signs and lights,
cocstitutea,a safety hazard and are a public nuisance.
(j) Deteriorating and defective structures. Any structure
within the city is a state of substantial deterioration, such as

(k) Property maintenance The substantial lack of maintenance
of grounds within the city On which structures exist where said
grounds are viewable by the public from a public tight -of -way or
viewable from the sites of neighboring properties, is a public
nuisance. The shrubs, plants, vegetation or debris found to exist -
on the grounds in a state and to the extent that such a condition
would tend to depreciate the aesthetic and property values of
surrounding property is a public nuisance."
SECTION 2. The City Clerk is hereby directed to cause this
ordinance to be posted in three public places, in accordance with
Resolution No. 74-17 of the Code of the City of Palm Desert, and
Section 36933 of the Government Code of the State of California.
