HomeMy WebLinkAboutORD 33ORDINANCE NO. 33 All ORDINANCE Of f8l CITY COUNCIL Of THE CITY Of PALK DESERT, RESTRICTING DEVELOPMENT AND AMENDINO ORDINANCES NO. 12, 19 AND 22 Of SAID CITY The City Council of the City of Palo Desert, California, DOES NEREEY RESOLVE as follows$ SECTION 1. That Section 18.30 of Ordinance No. 348 of the County of Riverside be and the same is herein amer.led to read as followst "SECTION 18.30t Approval of a Plot Plan. Notwithstanding any other provisions of this Ordinance, the following procedure and standards are established for all "Uses Permitted" in all zones and for the approval of a plot plan that is required by any section of this ordinance as hereinafter set forth. (2) Requirement for Plot Plan. Plot plans shall be submitted to the Planning Commission for all uses except those set forth in subparagraph (f) hereof. Plot plans for single family homes shall be submitted to the City Manager or designated /// representative for review and approval in accordance with the t provisions of this ordinance. 11 (b) Application. Prior to issuance of a building permit and prior to any use permitted, applications for approval of a plot plan shall be made to the Planning Commission on the forms provided by the Department of Environmental Services and shall include such information and documents as may be required, in addition to the following: (1) Name and address of the applicant and all persons that own any part of the subject property, including evidence that all owners agree to the application. (2) Location or address, and legal description of subject Property. (3) A plot plan, drawn to scale, that shows RESCINDED followingt �r BY ORDINANCE # ..1.1....... ....... (a) Boundary and dimensions of the p party. (b) Existing topography of the proper DATED:.....- proposed grading. (c) Location of adjacent streets, easements, drainage, structures, utilities, buildings, signs, and other features that may affect the use of the property. (d) Proposed development, including planned buildings and structures, access, drainage, yards, drives, parking areas, loadsceping, signs, and walls or fences. (a) Building elovations. (f) Floor plane. (g) Street and road improvements. (h) Fire protection facilities -and -capacities. (c) Approval of Plot Plan. The Planning Commission shall approve, conditionally approve or disapprove a plot plan within thirty (30) days after receipt of a completed application and they shall give notice of their decision, by mail, to the applicant, together with any required conditions of approval, based upon the following standards. (1) The proposed use must conform to all the requirements of the none in which it is located and all other applicable requirements of this ordinance. (2) The over-all development of the land shall be designed ( to insure the protection of the public health, safety, and general `t welfare, to conform to the logical development of they land and to be compatible with the present and future logical development. character, and design of the surrounding property, including the consideration of view, location of streets, the avoidance of traffic congestion and topographical, drainage conditions, and architectural appearance. (d) Appeals. An applicant or any property owner located within 300 feet of the subject property may appeal from the decision within 30 days after the date of the mailing of the Planning Commission's decision. The decision shall be appealed In writing to the City Council, on the forms provided by the City. The City Council may assume jurisdiction over the applica- tion for permit for the purpose of reviewing the action of the Planning Commission. Upon receipt of a completed appeal or the Imposition of jurisdiction in the City Council. the Clerk of the City shall set the matter for bearing before the City Council not less than five days nor more than 30 days thereafter and shall give written notice of the hearing to the applicant, the 2 appellant and the Director of Nnvironmantal Services. The City Council shall render its decision within 30 days following the close. of the hearing on the appeal. (a) Deleted. (f) Approval -Period. The approval of the plot plan shall be valid for a period of one (1) year from its effective date, within which time the construction authorized must be substantially begun or the occupancy authorized be in use; otherwise, the approval shall be void and of no affect. (g) Exceptions. Permits mar be issued notwithstanding the requirements of (a) hereof for the following: (1) Single family houses so long as there is only one active building permit gar applicant and plot plan has been approved by the Director of Environmental Services in accordance with (a) hereof. (2) Additions to single family houses. { (3) Swimming pools. y (4) Septic tanks. ` (5) Repair or remodeling of an existing structure other than single family residence where such repair or remodeling does not exceed $1,500.00. (6) New construction other than single family residence (exclusive of moving in a structure) not exceeding $1,500.00 in value. i (7) Pence* not a xceedinx six feet in height. (6) Signs not exceeding $1,500.00 in value. SECTION II. Any action, civil, or criminal or otherwise taken bythe:City pursuant to prior ordinances of the City of Palm Desert, shall continue in force and effect and shall not be discontinued or effective by virtue of the enactment of this ordinance, nor shall this ordinance affect any permit fees accrued under prior ordinances nor shall this ordinance affect any permits previously granted by the Planning Commission. 3 21MICM itt. the City Clark is hereby directed to taus,, this Ordinaate to be posted in three (3) public places in ateordauto with Resolution No. 74-17 and Section 36933 of the Oovernseat Code of the State of California, and shall to - f effect and be in force thirty (30) days after its adoption.
