AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, IMPOSING BUILDING EXCISE TAX ON NEW
CONSTRUCTION
The City Council of the City of Palm Desert DOES HEREBY
ORDAIN a's followse
Section le In addition to any other fee or fees prescribed
j by law, every person constructing any new building or addition or
11 trailer space in the City shall pay to the City a sum appropriately
computed as follows:
A. For each dwelling unit in a single-family, condominium,
apartment complex or multi -dwelling structure. or in a hotel or
dormitory. 2" per square foot of gross building area under roof
excluding accessory structures or areas such as carport, garages,
recreational buildings, or $250.00 per each dwelling unit, which-
ever is the greater sum.
B. For each trailer space. $250.00;
C. For any other construction not falling within the defi-
nition of "dwelling unit" or "trailer space" or within subsections
A or B above,. 200 per square foot of gross building area under
roof; •
D. Notwithstanding any of the foregoing provisions of this
section, no fee shall be payable on account of construction of
additional space to an existing single family dwelling. which
construction does not exceed $2.000 in valuation.
Section 2. Such fees shall be due and payable upon application
to the City for a building permit for the construction of any dwelling
unit or building or addition; provided, however, that there shall
be a refund of such fees in the event the building permit in not
approved or is not used for such construction.
Section 3. Definitions as used herein;
A. The term "trailer space" means each space, area, or
building, in a trailer park or mobile home park or other place,
designed or intended as a place to accommodate any mobile home,
trailer, van or other vehicle or mobile structure, at a time when
the same is being used as living or sleeping quarters for human
beings. AMENDED

• 8. As used harem4 the tercet "person" includes every person,
firth or eorpowton. engaging in construction activities itself or
*ZMgh the services of any employee, agent or independent con-
tractor.
C. As used herein, the term "dwelling unit" includes each sit..
family dwelling and each habitation unit of an apartment, duplex or
j multiple dwelling structure designated as a separate place for
habitation.
D. As used herein. the term "gross building area under root".
Means the interior of the building from outside wall to outside wall,
excluding accessory structures or areas such as carports, garages,
recreational buildings.
Section 4¢ All of the sums collected pursuant to this Ordinance
shall be deposited in the general fund of this city. Becat se this
Ordinance affects and pertains to taxes for the current and usual
expenses of the City, it shall become effective immediately.
Section 5: The City Clerk is herby directed to cause this
Ordinance to be posted in three public places, in accordance with
Resolution No. 44-27 of the Code of the City of Palm Desert, and
Section 36966 of the Government Code of the State of California.
PASSED, APPROVED AND ADOPTED this 13th day of
June. 1974 by the following vote:
