'Coll CITY COUNCIL OF THE CITY OF PALM DESERT, CALtrMNI&O DOES HEREBY ORDAIN AS FOLLOWSt SECTION it REPEALING ORDINANCE No, 4, Ordinance No. 4 is hereby repealed. SECTION Is ESTABLISHING THE PLANNING COMMISSION AS THE CITY PLANNING AGENCY. Pursuant to the provisions of Section 65100 of the Government Code of the State of California, requiring each City to establish a Planning Agency, a Planning Commission is hereby established and designated as the Planning Agency of the City of Palm Desert. California. SECTION 31 FUNCTIONS OF THE PLANNING COMMISSION The functions of the Planning Commission of the City of Palm Desert shall bet (a) Preparing, adopting and recommending to the City Council a General Plan for the City of Palm Dosert; (b) Periodically reviewing, adopting and recommending revisions to the City Council of the General Plan; (c) Preparing. adopting and recommending to the City Council such specific plans as may be necessary or desirable to carry out the objectives of the General Plan; (d) Preparing. adopting and recommending to the City Council drafts of regulations, programs and legis- lation as may in its judgment be required for the systematic execution of the General Plan; (e) Acting as the advisory agency to the City Council in connection with the administration of the State Map Act and Environmental Quality Act of 1970; (f) Periodically reviewing and recommending to the City Council regarding the Capital improvement program of the City; (g) PP:::vming such other functions as the City Council may proviats or as may be imposed by law. SECTION 4t MEMBERSHIP OF '; HE PLANNING COMMISSION The Planning Comtn,it;ion shall consist of five members to be appointed by the City Council by a minimum of 4 affirmative votes, each of whom shall serve a term of fo tr years, or until his successor is appointed, with a maximum of two tet.ns and portion of an unexpired term; provided an unexpired term or other appointment of less than two years shall not be considered a term under the provisions of this section while an unexpired term or other appointment of more than two years shall be considered a term under the provisions of this section; and provided however, of the members first appointed one member's initial term shall be one year, one member's initial term shall be two years. one atembe;4s initial term shall be three years, and two member's initial terms shall be four years. The appointments of the members of the Plan - at" Commission shall start on September 1 of each year with the ex- eeption of the first year. Thereafter• the Chairman and the Vice -Chairman shall be elected by the Planning Commission from its members at the first meeting in Stember or no later than the second Planning Commission meting of September. iepPlanting Commission by resolution shall adopt By-laws for the trans- action of business, shall keep a public record of its resolutions, transactions, Mdings. and determinations and shall hold at least two meetings a month at such time and place as fixed by resolution. Special meetings may be called as established in the Planning Commission By-laws. SECTION St REMOVAL, COMPENSATIONt Alp regular member of the Planning Commission may be re- snoved.by a 4 affirmative votes of the City Council. The expenditures of the Planning Commission shall be within the amounts appropriated for that purpose by the City Council which shall provide the funds. equipment and accommodations necessary for the work of the Planning Commission. When- ever the Planning Commission authorizes, the City Manager approves and appropriations have been made in thebudget, the members of the Planning Commission may attend planning conferences or meetings of planning officials, hearings on planning legislation, or any matters relative to the constituted work of the Commission, and the expense incident to such attend- ance shall be proper charges on the funds appropriated to said Commission. SECTION 7t APPOINTMENT OF EXECUTIVE SECRETARYt The Executive Secretary for the Planning Commission shall be the Director of Environmental Services or hie assigned appointee. The Director of Environmental Services or his assigned appointee shall represent the City before the Planning Commission and shall not be considered employed by the Planning Commission. SECTION 8t Zoning Ordinance No. 348 of the County of Riverside, State of California, to the extent it applies to the City of Palm Desert, County of Riverside, State of California, is hereby superseded by the provisions of this ordinance limited solely to the extent set forth herein. SECTION 9s The City Clerk is hereby directed to cause this ordinance to be posted In three (3) public places in accordance with Resolution No.74-17and Section 36933 of the Government Code of the State of California, and shall tabs effect and be in force thirty days after its adoption.
