HomeMy WebLinkAboutORD 56• C4WINANCE NO. 88 AN ORDINANCE Or THE CITY COUNCIL OF THE CITY 07 PALM DESERT, CALIFORNIA, ESTABLISHING THE REQUIRE- MENTS OF TRASH ENCLOSURES AND CREATING THE STANDARDS FOR CONSTRUCTION OF TRASH ENCLOSURES NOM,,the City Council of the City of Palm Desert. California, does hereby ordain as follows: Section 1. In order to protect persons against hazardous conditions and safeguarding the public welfare by preventing un- sightly storage of trash that may devalue the neighborhood and community, the City Council hereby requires trash enclosures to be provided for all multifamily, office, institutions, commercial and manufacturing uses in any zone district in the City of palm Desert. Refuse storage areas may be combined for more than one use, pro- vided the capacity is adequate for all users. (a) Exception.- the requirement of trash enclosures shall not apply for uses where the refuse container is completely screened from the public by walls, fences, buildings or planting. (b) Exception - temporary use of twelve cubic yard containers j or larger, or temporary compactors for clean up of lots or buildings i! shall not be required to be enclosed. Section 2. Trash enclosures shall be of adequate size to con- tain and view -obscure refuse containers, discarded boxes, and other materials normally discarded by the use involved. Minimum construc- tion standards shall be as determined by the Archite-stural Review Board and by sound construction methods; provided that Lhe caiclo- sure shall be of adequate size, and shall be properly located for functional use by the user and the disposal company and shall be view -obscured from all sides and shall be built of approved materials compatible to the buildings, walls and surroundings (no wood or chain link except for gates shall be permitted). Section 3. The normal trash enclosure area shall be a mini- mum of 8 feet wide by 12 feet deep with a 8 foot high decorative block wall and site -obscuring gate. Deviation in size may be made by the Architectural Review Board. Section 4. All existing developments described in Section 1, shall install approved trash enclosures within one year from the date of approval of this or linance &MNKUthin thirty (30) BY ORDINANCE sI... a p..,»,,,,,,, i a ORDINANCE NO. 56 days of the official notification by the City of any violation to this ordinance. Section S. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be posted In three public places in accordance with Resolution No. 74-17 and with Section 36933 of the California Government Code, and the same shall be in full force and effect thirty (30) days after its adoption.
