The City Council of the City of Palm Desert, State of
Califorsia, do ordain as follows:
a31lCTI0II 1 - DEFINITIONS•
a. City - The term City as used herein shall mean:
The City of Palm Desert, California, and/or its
duly authorized agents or assignees.
b. Contractor - The term Contractor as used herein
ssall mean: Palm Desert Disposal Service. Inc.
and/or its duly authorized agents, contractors,
vendors, and assignees.
c. Solid Runic 'pal wastes - The term Solid Municipal
Wastes ied herein shall mean: The usual cus-
tomary types of household and commercial Garbage,
trash and refuse such as wastes from the prepara-
tion and cooking of foods, waste food, waste paper,
cloth, containers such as bottles, tin cans, cartons
and crates; materials such as wood, plastic, rubber,
metal, glass, grass, tree and plant trimmings and
other refuse items customarily deposited by city
residences, commercial and industrial establishments.

d. Trash - The term Trash as used herein shall mean:

or other aubstances that may accumulate an a result
of repairs to land or buildings or as a result of

operations.
0. Industrial Waste - The term Industrial Waste shall
mean and Include solid waste resulting from indus-
trial processes and manufacturing operations, in-
aludiag but not limited to wholesale and volume
food -processing waste, lumber scraps and shavings,
Petal scraps and shavings and chemical wastes.

taste, human or otherwise, that are within the juris-
diction of the City and/or community services pro-
vided thereto during the term of this contract.

1. Industrial Establishments - The term Industrial
eta s nts as us orein shall mean: Any
organisation, private or civic, of any number of
persons or objects that manufacture, assembles,
combines, grows, harvests, converts, or refines
any substance, liquid element, material or energy
source of any type.
J. Refuse - The term Refuse as used herein shall mean:
Siirsunieipal waste and/or trash.
k. BulkyIte_mss - The term Bulky Items as used herein
*hall mean: Objects of furniture, household or
Industrial appliances, shipping crates and con-
tainers or other large bulky or heavy objects not
normally discarded on regular basis by city resi-
dences, commercial or industrial establishments.
1. Excess Refuse - The term Excess Refuse as used herein
• all mean. That quantity of refuse which is set out
for collection and is in excess of the accumulation
capacity of the container in use.
SECTION 2:
Every person in charge of a residence or residences, whether
single or multiple family, shall make arrangements with the
person authorized by law, to have removed, not less than
once a week, from the property upon which the residence or
residences are located, all refuse created or produced or
brought upon the premises. Every person in charge of a
commercial or industrial building shall not less than twice
a week remove or cause to be removed from the property upon
which the building is located all refuse created or produced
or brought upon the premises; provided, however, that upon
written approval by the Health Officer, refuse created, pro-
duced or brought upon the premises of an industrial or com-
mercial building may be removed not lose than once a week.
This latter provision, however, will not apply to food
handling establishments which shall be removed or caused
to be removed not loss than twice a week.

Every person in charge of a residence, commercial or indus-
trial business shall deposit or cause to be deposited
all refuse in standard containers or commercial bins as
approved by the Health Officer and the Solid Waste Super-
visor. A standard container shall be made of metal or
plastic, watertight and covered with a tight fitting
lid; tapered aides, two handles or bales, and •hall not
exceed 32 gallons in size or 50 pounds gross weight when
filled. If approved by the Solid Waste Supervisor, plastic
or paper bass specifically designed for refuse may be used
In place of standard containers. Garbage shall be separately
bagged or wrapped before placing in container. No person
shall maintain or place for collection any container not

It shall be unlawful for any person other than the person

mess or the person authorired by law to remove any con-
tainer from the location where said container was placed
by person in charge for ntorage or collection, or to
remove any solid wants from the location maid -solid
waste was placed by person in charge for storage or
collection, without prior written approval of the person
In charge. It shall be unlawful to place refuse in any
standard container or commercial bin without prior written
approval of the person in charge of said container.
SECTION b:
No person shall place non-compactable solid waste adjacent
to a street or public right of way for collection or remvval
purposes without prior approval and arrangements with the
Solid Waste Supervisor.
SECTION 6:
Removal,*tc., Unlawful: Exceptions to Section:
No person or resident of the City shall remove, transport
or convey any solid municipal waste upon or along any
public street, alley or place within the City, unless he
shall hold a contract with the City for the collection
and disposal thereof and have a valid or existing permit
from tho county to :caul solid municipal waste, except that
the provisions of this section shall not apply to con-
tractors or builders removing debris, rubbish and trash
from construction sites, any persons holding a valid
city business license to engage in the nursery or gar-
dening business or to any person removing shrubbery,
grass, tree cuttings, tree trimmings or other agricultural
debris from any property owned or occupied by such person,
or any person removing industrial wastes or any person
removing large or oversized items of rubbish from their
premises.
SECTION 7:
a. The contractor shall provide sufficient collection
equipment to maintain a regular schedule of collection.
b. Trucks used for the collection or transportation of
} solid waste shall be leak -proof and equipped with a
close -fitting cover which shall be affixed in a manner
that will prevent spilling, droppinji or blowing of any
solid waste upon the public right of way during collec-
tion or transportation.
c. All trucks used for collection or transportation of
solid waste shall be maintained in a clean and a&nL-
tory condition, neatly and uniformly painted, and
shall carry a shovel, broom and fire oxtinguisher.
d. The person that owns any trucks used for collection or
transportation of solid waste shall have his name,
address, telephone number and truck number printed
on each side of ail trucks in letters not less than
three inches high.

e. All garbage conveying trucks tanka, containers and
other receptacles shall be cleaned end disinfected
both an the inside and outside thereof at least once
daily, and at all times shall be kept free froo any
refuse en the outside thereof.

furnished to business astablishm ants.

Every parson who collects or hauls hazardous or extremely
hazardous waste shall immediately notify the Health Officer,
In writing, listing the following informationt
a. The name, address and telephone number of the collec-
tor or hauler.
b. The neat*, address and telephone number of the facilities
from which the hazardous or extrer.,ely hazardous vast*
is collected.
c. A description of the type of hazardous or extremely
hazardous waste collected, as represented in writing
by the administrator of the facility including the
amounts collected, measured in cubic feet and the
frequency of collection.
d. The name, address and telephone number of the waste
disposal facility, that is used for the final disposal
of the hazardous or extremely hazardous waste.

City of Palm insert, California, on this the 28th day of August,

Rental maintenance expense of
$7.50 per month is included

6. Bulky Household Items
Bulky household items that. because of their size or weight
(such as furniture, T.V.'s, appliances, etc.) cannot be collected
on regular routes shall be collected based on the Special Haul rate.
7. Start Fees
$3.00 to open a new account or reopen a previous account,
or resume service on an inactive waste disposal account, or to trans-
fer as account into a new name. This will be eliminated upon creation
of !Mandatory service.
S. Unusual Conditions
for collections requiring special equipment or otherwise
not set forth in this Agreement. rates may be charged as shall
be agreed upon by the Contractor and the customer..
