SECTION 2: The City Clerk of the City of Pals Desert. California. is hereby directed to cause this Ordinance to be published within fifteen (15) days of adoption in the Pals Desert Post. a newspaper published and circulated within -the City of Pals Desert. CIA M ayor ATTEST ty er City of Pali Desert, California r b1 ARTICLE 25.7 AGRICULTURAL DISTRICT (A) 2S.7.1 Intent and Purpose Agricultural district is included in the toning ordinance to achieve the following purposes: - To permit the conduct of certain agricultural pursuits on land in the City. - To ensure adequate light, air, and privacy for each dwelling unit, and to provide adequate separation between dwellings and facilities for housing animals. 25.7-2 Permitted Uses The following uses shall be permitted: = One -family dwellings and farm employee housing for persons employed on the premises. Not more than one dwelling unit, other than farm employee housing, shall be permitted on each site. • Field and truck crops and•horticultural specialties. • Nome occupations conducted in accord with the regulations prescribed in Article 25.36 (Nome Occupations). Livestock and poultry raising for private, non-commercial use, and private kennels and stables, provided than any building or enclosure in which animals or fowl, except domestic pets, are contained shall be at least one hundred (100) feet from any residential or commercial district. • Nurseries, greenhouses, and botanical conservatories. - Orchards. IL 15.7 (3) M ARTICLE tS.a RESIDENTIAL DISTRICTS 2S.e-1 Intent and Purpose The residential districts are included in the zoning regulations to achieve the following purposes; - To reserve appropriately located areas for family living at a range of population densities consistent with the General Plan and with sound standards of public health and safety. - To ensure adequate light, air, privacy, and open space for each dwelling. - To provide space for semi-public facilities needed to co�aplement urban residential areas and for institutions that require a residential environment. - To minimize traffic congestion and to avoid the overloading of utilities by preventing the construction of buildings of excessive size in relation to the land around them. No trash shall be allowed to extend above or beyond the en- closures. 26.12 (3) (AMENDED 6Y ORDINANCF. 128) ARTICLE 25.13 RESIDENTIAL - MOBILE HOME PARK AND MOBILE HOME JEE ( .,... 25.13-1 Intent and Purpose This district provides for the placement and occupancy of mobile homes for residential purposes on purchased, rented or leased lots. The free standing trash enclosure shall be constructed of masonry block. No trash shall be allowed to extend above or beyond the enclosure. ZS.13-4.15 Signs All signs shall be in compliance with Article 25.38. 25.13-4.16 Provisions for Site Plan Review All uses shall be subject to Site Plan Review as prescribed in Article 25.39-2. " 25.13-5 Special Standards for Mobile Home Parks 25.13-5.01 Private Streets A minimum width of private streets shall be thirty (30) feet as measured from back of curb to back of curb. Said streets shall have curds and be paved with asphaltic concrete or equivalent material. 25.13-5.02 Guest, Parking _ Guest automobile parking areas shall be provided at a minimum ratio of one (1) parking space for each ten (10) mobile home lots. 25.13-5.03 Street Lighting Street lighting shall be provided along the private streets for the safety of pedestrians. 25.13-5.04 Accessory Buildings The minimum distance between an accessory building and the main building or mobile home is ten (10) feet. 25.13-6.05 Community Use Area The minimum ratio% of community use areas shall be four hundred (400) "ore feet ,f such area for each mobile home space. Such land may :-•l-ide m;i land devoted to recreation and service facilities and landscaping not included within lots. 25.11 (3) MOBILE NOME (AN) 25.13-5.06 Exterior Boundaries Abutting a Public Street Exterior boundaries of the park abutting a public street shall be provided with a six (6) foot high masonry wall or fence designed to civet* an attractive border. In addition. a setback of at least ten (10) feet in depth shall be maintained as landscaped open space betum any perimeter street and the required wall. 25.13-5.07 Exterior Boundaries not Abutting a_ Public Street Exterior boundaries of the park which do not abut a public -street shall be bounded by a six (6) foot high masonry wall. 25.13-5.06 Access A minimum of two (2) vehicular entrances shall be provided for each mobile home park. 25.13-5.09 Trailer and Boat Storage Trailer and boat storage area shall be provided at the minimum ratio of fifty (50) square feet of land for each mobile hone space. 25.13-5.10 Recessing All mobil* homes shall be recessed to provide for ground level entry► to the mobile home. 26.13 (6) 8 ARTICLE ISM PLANNED RESIDENTIAL DISTRICT (PR) �- 25.14-1 intent and Purpose It is the purpose of the "PR" District to provide for flexibility in development, creative and imaginative design, and the development of parcels of land as coordinated projects involving a mixture of residential densities and housing types, and community facilities, both public and private. The "PR" District is further intended to provide for the optimum integration of urban and natural amenities within developments. The "PR" District is also established to give a land decleloper assurance that innovative and unique land development techniques will be given reasonable consideration for approval and to provide the City of Palm, Desert with assurances that the completed project will contain the character envisioned at the time of approval. 25.14-2 Uses Permitted by Approved Development Plan - Residential Real Estate Devoapments as defined in the Business and Professions Code (State 'of California); - Community Facilities; - 9W Space; - Recreational Uses; C - Related Institutional Facilities;- - Related Accessory Uses; - Other uses or mixtures of residential with Country Club related commercial uses as designated on an approved Development Plan; - Utility Facilities; - Resort Hotels with a maximum of eighteen (18) units to the gross acre, and related auxiliary commercial uses. 2S.14-3 Application Procedures 25.14-3.01 Pre-Filino Procedure Prior to the submittal of the complete official application, an applicant must pre -file a preliminary draft of the required documents and sketch plans for the project with the Director of Environmental Services for review.• It shall be the responsibility'of the Director of Environmental Services to contact interested department and agency personnel regarding neassary meetings with the applicant. After review, the Director of Environmental Services shall furnish the applicant with written comments "rding the project, including appropriate recommendations to Inform • and assist the applicant prior to preparing the final components of the application. •- 25.14 (1) (AMENDED 5Y ORDINANCE 128) w IL 14-3.02 Filing Procedure To initiate the review process, -the applicant shall file a petition for a change of zone to a "PR" District along with a Development Plan and supporting docuaentation as required in Article 25.14-5 with the Planning Commission through the Department of Environmental Services. The Planning Commission shall hold a public hearing to . consider the petitioA for a change to a PR District and the accompanying Development Plan shall be subject to approval by Ordinance of the Palm Desert City Council. 25.14-4 - ftximum Pro3ect_ Densities The maximum project density shall be as expressed in dwelling units' per gross acre of not more than the number following the zoning Symbol PR. The City Council shall determine the densities to be allowed within each PR District at the time the involved groperties are rezoned and.as designated on the zoning map within the following range: 1-18 dwelling units maximum per average gross acre. The density designation shall mean dwelling units per average gross acre. for example: M 7 shall mean a planned residential development with 7 units per gross acre. 25.14-5 Rezonina and Development Plan Requirements - The Planning Commission may initiate at its descretton the rezoning of properties, according to the provisions of Article 25.39-8 of this Ordinance. In uses of City -initiated rezoning, the change of • zone petition may be processed alone; an approved Development Plan ;hall be required prior to any development. Rezoning initiated by a property owner (other than the City of Palm Desert) must be accompanied by a Development Plan as a part of the change -of -zone appiication. Except as specified above, the following materials shall be submitted with all applications: 25.14-5.01 Development Plan A Development Plan shall be filed with the rezoning request for the entire property. The Plan shall set forth the following: 1. written Documents (a) Legal description of the total site pMposed for development, including a statement of present and proposed ownership. (b) A ststwnt of planning objectives to be achieved by the project through the particular approach proposed by the app icant. This statennt shall include a description of 26.14 (2) r the character of the proposed development and the rationale behind the essumptions and choices made by the applicant. (e) A preliminary development schedule indicating the proposed phasing program and the approximate date when construction 13f the• project or the stages of the project can be expected to begin and be completed. (d) A statement of the applicant's intentions with regard to the* -hture selling or leasing of all or portions of the project. (a) Quantitative data for the following: total number and type of dwelling units, parcel size; proposed lot coverage of buildings and structures; approximate gross and net residential densities; total amount of open space including the precise - amount of usable open space; total amount of non-residential construction including justifications of ancillary character of said construction; written indication of compliance or non-compliance to established standards of this article; economic feasibility studies and other studies as required by the City. 2. Site Plan and Supporting Maps (a) The existing site conditions including contours at two -foot intervals, water course, flood plains, unique natural features and any forest cover. (b) Proposed lot lines and plot designs. (c) The location and floor area size of all existing and proposed buildings, structures and other improvements in- cluding maximum heights, types of dwelling units, density per type and non-residential structures including preliminary architectural renderings of typical structures. (d) The location and size in acres or square feet of all areas to be conveyed, dedicated, or reserved as common open spaces, public parks, recreational areas, school sites, and similar public and seimi-public uses. (o) The existing and proposed circulation system of arterial, • collector, and local streets including off-street parking areas, service areas, 1r Aing areas, and major points of access to public rights -of -way. flotations of proposed owner- ship - public or private. (f) The existing and proposed pedestrian circulation system, including its interrelationships with the vehicular circulation system. (g) The existing and proposed utility systems. 16.14 (S) Q, �1.. (h) A general landscape plan indteating the treatment of materials Ur private and common open areas. (1) preliminary grading plan. (1) Enough information on lands adjacent to the project to indicate 'the relationships between the proposed development and adjacent areas. (k) The proposed treatment of the perimeter of the project including interials and techniques used such as mounding, screens, fences and wells. (1) Any additional information as required by the City necessary to evaluate the character and impact of the proposed development. (m) The above information must be submitted for all of the land intended to be included in tM application. Where projects are developed in stages, the detail information shall be submitted for those stages to be developed immediately. Sketch plans including the bare essentials - land uses, densities, site design, adjacent uses, circulation, shall be submitted for the remaining lends to be developed in future stages of the project. Subsequent phases shall be evaluated in terms of these plans. If substantial deviation exists, the applicant shall file all the information as required above for the subsequent phases as an amended develop- ment plan or a new development plan as appropriate. 25.14-5.02 Amendments to Development Plan Minor changes to the location, siting, and height of buildings and struc- tures maybe authorized by the Planning Commission without additional public hearings if required by engineering or other circumstances not forseen at the time the development plan was approved. No change authorized by this subsection may cause any of the following: (1) A change in the use or character of the development. (2) An inchase of greater than ten (10) percent in overall coverage of structures. (3) An Increase in the intensity of use. (4) An increase in the problems of traffic circulation and public Utilities. sp (5) A reduction of more then ten (10) percent of the area1hown as open space. (5) A reduction of mare then ten'(10) percent of the approved off-street parking. • (7) A reduction in required pavement widths, 15.14 (4) i All other changes in use, or rearrangement of lots, blocks, and building tracts, or any changes other then listed above must be made by the City Council after a rew ere dation by the Planning Commission. IS.14-S.03 Design Review of Protect 1lithin one year following the final approval of the development plan, the applicant shall file for the Design Review of the project by filing . the information required in Article 25.39-2. The Design Review process, in addition to its normal finding, shall deem the precise construction plans and precise landscape plans in substantial compliance with the development plan, provided.modification by the applicant does not involve a change of one or more of the following: (1) Violate any provision of the Zoning Ordinance. (2) Vary the lot area requirement by more then ten (10) percent. (3) Involve a reduction of more than ten (10) percent of the area' reserved for the common open space and/or useable open space. (4) Increase or decrease the floor areas proposed by more than ten (101 percent. (5) Increase the total ground area covered by buildings by more than five (5) percent. If it is deterwi ned that the plans are -not in substantial compliance, an am aliment and/or a new development plan sha11 be processed through the City as appropriate. 25.14-6.04 Development Plan Processing as Separate Matter *dn the City has initiated the rezoning procedures and has established a "PR" zoning designation on property, no development shall occur on said property until a development plan has been processed and approved by the City. Said plan shall be processed as a Conditional Use Permit by the pi urea established in this Ordinance. The submitted require- mients shall be as specified in Article 25.14-5.01. 26.14-6 Development Standards Applicable All areas on the Development Plan shall be subject to the following: • The Standards for Development of "PR" Districts set forth in this Article of this Ordinance and any supplemental standards for the Planned Community designated in the Development Plan. ` In additfon, the foilowing. Devblopment Standards shall apply: lS.14 (6) A IS.14-6.01 . General Standards (1) Off -Street Parking and Loading Requirements All parking and loading shall comply with the provisions. --of Article 25.33 of this Ordinance. (2) utilities See Article 25.32-6. (3) Signs All signs shall be in compliance with Article 25.38. (4) Outside Storage No outside storage shall eitied the height of actual perimeter screening. (5) Screening Till screening requirements for developments within the "PR' district shall be determined by the Design Review Board during its Site Plan Review proceedings. (6) Trash Handling Trash handling facilities shall be provided for all developments within the "PR" district with the exception of single family detached dwellings. A trash enclosure wilt be provided for all but excepted uses, un"ss the proposed location of the trash area is completely enclosed y walls or buildings. The free standing trash enclosure shall be constructed of masonry block. No trash shall be allowed to extend above or beyond the enclosure. (7) Site Plan Review Site Plan Review as prescribed in Article 2S.39-2 shall be required before a building permit is issued for any development in the "PR" District. 25.144.02 Special Standards In addition to requiring all Oevelopment Plans to comply to the following spscisl standards, the City Council and/or Planning Commission may impose such otMr conditions to the Development Plan as it dews necessary or - desirable in carrying out the general purpose and intent of this Article. �_ 15.14 (6) C (1) Minimum Project Area - Projects of less than 7 dwelling units per acre - 6 acres. - Projects of 7-18 dwelling units per acre - 10 acres. (2) Minimum Project Width - Projects of less than 7 dwelling units per acre - 250 feet. - Projects of 7-18 dwelling units per acre - 500 feet. (3) Minimum Project Perimieter Setback • 20 feet from all property lines adjacent to existing or proposed public streets. - (4) Maximum Project Building Coverage - Projects of less than 7 dwelling units per acre - 40 percent. - Projects of 7-18 dwelling units per acre - 50 percent. (5) Minimum Lot Area - Single family detached'- as approved by the development plan. - - Single family attached - 2,500 square feet. - Two family dwelling - 3,000 square feet. - Multiple family buildings - as approved on the Development Plan. (6) Minimum Front Side and Rear Yard - As approved on the Development an. However, there shall be a separate private yard with a total area of at least 320 square feet adjacent to each dwelling unit unless equivalent alternative arrangement of patios are approved and provided. - (7) Minimum Separation bet9ken Sides of Buildings - Single family detached - 10 feet. , - Other - 20 feet. (8) Ninisxaa Common Open Space - - Projects of less than 7 dwelling units per acre - 60 percent of the net oru. , - ( . - Projects of 7-18 dw.iling units per acre - 40 percent of Of met area. 16.14 (7) (a) At least 50% of all required common open space shalt be approximately level defined as not more than 1V grade. (b) The common open space shall be land within the total _ development site used for recreational, including buildings used for recreation purposes, parks or environmental purposes for enjoyment by occupants of the development and their guests, or dedicated to the City -for public parks. (c) Comaan open space shall not include public or private streets, driveways, private yards, or patios and parking • areas. (9) Maximum Building Height - 30 feet -or two-story whichever is less. (10) Maximum Dwelling Units Per Building - as approved. .s- (11) Required Width of Private Roads - With no parking - 30 feet. = With parking on one side - 32 feet. • With parking on two sides - 40 feet. Said roadways shall be a minimum of asphaltic concrete with concrete curbs hnd gutters as approved by the Director of Environmental Services. Standards of design and construction of roadways, both public and private, within the project may be modified as is deemed appropriate by the City, especially where it is found that the development plan provides for the separation of vehicular and pedestrian circulation patterns and provides for adequate off-street parking facilities. (12) Exceptions - The above standards shall be required unless iEUYTe_TTy the Development Plan. 25.14-7 BuildinaSetbacks from the Planned Street Line the Planned Street Line The minion setback in all residential developments within the "PR" District shall be the designated distances form the ultimate right-of-way line of the streets hereinafter specified unless otherwise provided herein: Freeway - 50 feet Artuirial - 32 feet Secondary - 32 feet _ i. 111.14 (d) Collector - 20 feet Local - to feet ls.14-e Approval Criteria The Planning Commission and/or City Council may approve a Development Plan only after finding that the requirements of this ordinance and other ordinances affecting the property have been satisfied. In granting such approval, the City Council may impose and enforce such specific conditions as to site development, phasing and building construction, maintenance and operation as it deems necessary to carry out the purposes of this Ordinance and the General Plan. All development within the "PR" District shall comply with the _ Development Plan as approved and adopted by the City Council. r
