The City Council of the City of Palm Desert, California,
DORS HBRSSY ORPAIN as fellows:
Section 1. Persons Affected.
No person who knows he or she is infected with active
commmicable tuberculosis shall engage or serve or seek employment
In any work, occupation or employment which requires or occasions the
hurdling of any food or liquid or material intended for food or drink
for human consumption, or the handling of any dishes or other articles
used in the preparation or service of food or drink for human consump-
tion. No owner, manager or agent of such owner, or person in charge
of any establishment or business shall retain, in the employ thereof
for the performance of such services, for a longer period than three
(3) weeks, any person who does not hold and.produce a health certificate
as required by this Ordinance, or for any period whatsoever, any per-
son known or reasonably believed to be infected with active communicable
tuberculosis. This requirement for a health certificate shall not
apply to domestic or household work or to temporary, occasional or
intermittent functions of bona fide religious, charitable or public
service organizations, including fraternal organizations, veterans'
organizations, established youth organizations, parent -teacher associa-
tions and civic or community organizations or groups, the primary pur-
pose of which is the betterment of the cultural, social or economic
welfare and environment of the community.
Section 2. Application for Certificate.
Each person who is engaged or intends to engage in an
occupation or employment for which a health certificate is required
by Section 1 of this Ordinance shall, before or within three (3) weeks
after he begins such work, file with the County Health Officer of the
County of Riverside, an application for a health certificate, in such
form as the County Health Officer may require. Such application must
be accompanied by a signed statement of a physician duly authorized
to practice medicine in the State of California, or a report from an
organization acceptable to the County Health Officer, showing that
the applicant is free of active, communicable tuberculosis. Said
statement or report shall show that within six (6) months of the date
of application the applicant has received either (1) a normal chest
x-ray which shows the applicant to be free of active communicable
tuberculosis, or;,(2) an intradermal Nantoux test, the result of
which was negative. The statement or report must show that in the
Mantoux test no less than five (S) tuberculin units, which is the
eqquivalent of .0001 milligrams intermediate PPD, or one to two thousand
(1000 to 2000) solution of sol tuberculin freshly prepared, have been
used. Induration of six (6) or more millimetera will be construed as
a positive skin test. All positive akin tests reactors to the Hantoux
test will be required to obtain a chest x-ray. Said statement or report
shall bear a date not more than six (6) months before the date of
application.
Section 3. Issuance of Certificate.
If the Health Officer determines from an examination of the
statement or report accompanying such application, or from such other
evidence to he may require that the applicant for a health certificate
is fra from active communicable tuberculosis, he shall immediately

fact, and which shall bear the name of the applicant and the date of
lesuance. such health certificate shall expire one (1) year after
the date tt *as issued. Any person whose health in the opinion of the
County Health Officer requires further investigation nsay be isnued a
t ra health certificate at the discretion of the County Henith
Officer for a period up to three (3) months during which time such
investigation shall be carried out to determine the presence of active
tom micable tuberculosis.
Section 4._ Duplicate Certificate.
The County Health Officer for good cause may issue duplicate
health certificates.
Section S. Substitute Certificate.
A valid and effective certificate of health, indicating that
the applicant is free from active communicable tuberculosis, issued by
any regularly constituted public health department and bearing, a date
of issuance. shall be accepted, in lieu of the health certificate issued
by the County Health Officer, during its period of validity, not to
exceed one (1) year from the date of its issuance.
Section 6. Revocation of Certificate.
The County Health Officer may revoke any health certificate,
whether issued by himself or other authority, and require its surrender,
whenever he determines that the holder thereof is infected with active
coammicable tuberculosis.
Section 7. Display of Certificate.
Each person required to have a health certificate shall
immediately submit such certificate to the employer of such person.
It shall be the duty of every such employer to keep on continuous dis-
play at the place of employment the health certificates of all such
persons employed or engaged there, and to display therewith a current
list of all such persons there engaged or employed, for comparison with
the displayed certificates. Upon termination of employment each un-
expired certificate shall be returned to the holder.
Section S. Penalties.
Any violation of this Ordinance is a misdemeanor punishable
by a fine of not more than Five Hundred Dollars ($5On.00), or by im-
prisonnent in the County jail for not more than six (6) months, or by
both such fines and imprisonment.
The City Clerk of the City of Palm Desert, California, is
hereby directed to cause this Ordinance to be published once within
fifteen (15) days of adoption in the Palm Desert Post, a newspaper
published and circulated within the City of Palm Desert, California.
