That Chapter 16 of the Palm Desert Municipal Code be and the same is hereby established to read as out. .led in the 1973 Edition of the Uniform Building Code, Uniform Code Standards and their appendices with the exception and exclusion of Appendice 70 of the Uniform Building Code, subject to the particular additions, amendments and deletions as contained herein. That the rules, regulations, provisions and conditions set forth in those certain Codes entitled "Uniform Building Code, 1973 Edition" and the "Uniform Building Code Standards, 1973 Edition". therein contained, pro- mulgated and published by the International Conference of Building Officials. three (3) full printed copies of which, printed as a Code in book form, together with additions, amendments and deletions, were by the City Council ordered filed, and which have been actually filed in the office of the City Clerk, and which as so on file, are hereby referred to, and by this reference expressly incorporated as Chapter 16 of the Palm Desert Municipal Code, and for all intents and purposes as though set forth at length, shall be and the save are hereby established and adopted as the rules, regulations. provisions and conditions to be observed and followed for the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, area and maintenance of buildings, structures, and/or improvements, is hereby established and adopted, and the same shall be designated, known and referred to as the Municipal Building Code of and for the City of Palm Desert, California. (6) Section 16.2-2.05 is amended to meet minimum requirements of Sectioe E403, items 1 and 2, Title 19 of the California Administrative Oode. (C) Section 16.2-2.06, 16.3-1.01 and 16.3-1.02. The use of asphalt floors as garage surface material deteriorates and becomes unstable due to extreme surface temperatures, common of lower desert areas. Burn -out, rutting and cracking of surfaces creates maintenance problems not common in other areas. It is the express finding of this Council that short term installa- tions with high maintenance and replacement costs are not in the better Interest or welfare of the general public. SECTION S. CITY CLERK'S CERTIFICATION. The City Clerk of the City of Palm Desert, California, is hereby directed to cause this Ordinance to be published once within fifteen (15) days of adoption in the Palm Desert Post, a newspaper published and circulated within the City of Palm Desert, California, and the same shall be in full force and effect thirty (30) days after adoption. Palm Desert Municipal Code Chapter 16 Building Code April, 1976 Exhibit A Ordinance No. 118 to--*�TICLE 16.1 GENERAL PROVI?OftvlS 16.1-1 Intent and Purpose The provisions of this Chapter shall apply to all types of construction classified as buildings or structural. 16.1-2 Definitions 16.1-2.01 Building and Structural The erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, area and maintenance of buildings, structures, and/or improvements. 16.1-3 Administration The administration of this Code shall be as designated by Ordinance No. 100, Chpater 15, Palm Desert Municipal Code. 16.1-4 Qualification of Amendments and Deletions Express findings of the City Council determining the amendments and deletions to the Uniform Building Code, 1973 Edition included in this Chapter have been made to meet requirements of Section 17958.7 of the Health and Safety Code of the State of California, to protect the public health and safety of the citizens of the community, and to delete the Uniform Building Code sections that require or allow material usage that is unsuitable to the natural conditions found in the local area. lu With the exception of the additions, amendments, and deletions set forth this chapter, the rules, regulations, visions and conditions set th in that certain Code entitled 'Unit Building Code, 1973 Edition', ..1cluding the Appendix and Corrections he. a contained, and the 'Uniform Building Code Standards, 1973 Edition', shall be designated as the Building Code of and for the City of Palm Desert, California. 16.2-2 Additions 16.2-2.01 Section 302(f) shall be added to said Building Code as follows: Construction Site Security. The owner, contractor or responsible party constructing a new building, shall maintain security measures as deemed necessary or as required by the Building Official to control vandalism, fires, blowing dust, sand or debris. Refusal to comply shall be a misdemeanor and punishable as stip- ulated in Section 205 of said Code. 16.2-2.02 Subsection (a) of Section 303 of Chapter 3 of Part 1 of said Building Code is hereby amended to read as follows: a)a) Building Permit Fees. A fee for each building permit shall be paid to t eh Building Division as set forth in Resolution No. 50 expressly incorporated in this section as though set forth at length; and, further, when an inspection is requested wherein no permit has been obtained and/or where it must be determined by the Building Official if a structure or a portion thereof complies with safety requirements, a fee in the amount of fifteen and no/100ths ($15.00) Dollars shall be paid to the Department for such inspection, which shall be referred to as a "Special Inspection". The determination of value or valuation under any of the provisions of this Code shall be based on the building valuation data as prepared and published in the "Monthly Building Standard % Magazine" by the International Conference of Building Officials, or determined by the Director of Building & Safety. The valuation of all work, including painting, roofing, electrical, plumbing, heating, air conditioning, elevators, fire extinguishing systems and any other permanent work or permanent equipment shall be determined by the Director of Building & Safety. 16.2-2.03 The following paragraph is hereby added to Section 303(a) of Chapter 3 of Part 1 of said Building Code to read as follows: A permit shall be obtained for each demolition or removal of buildings or structures within the City and a fee in the amount of five and no/100ths ($5.00) Dollars shall be paid to the Building Division for each structure or building removed or demolished, and, in addition thereto, there shall be deposited with the City a bond or other guarantee, satisfactory to the Director of Building & Safety or City Attorney, in an amount of ten (10t) cents per square foot per floor level of each building, and, in no event, no less than a minimum of Two Hundred ($200.00) Dollars shall be paid to guarantee c an -up satisfactory to the Building Division. Such deposit shall be returned upon the completion of all work including the demolition, removal of debris, and grading of the lot or parcel of land. 16.2-2.04 Section 303(b) of said Building Code shall be amended as follows: (b) Plan Checking Fees. Notwithstanding any other provisions of this Code, a plan checking fee will be charged regardless of valuation, wherein it is deemed necessary to check plot plans, site plans, drawings, engineering, specifications, and/or any other requirements or exhibits at the time the applicant files for a permit. Said plan checking fees for buildings of Groups I and J Occupancies shall be one-half or 50% of the building Kermit fees. Plan checking fees for all other occupancies, uses, engineering, specifications and/or other requirements shall be sixty-five (65%) percent of the building permit fees as set forth in Section 16-1.05 of this Ordinance. New subdivisions utilizing plans of construction previously approved and where continuity of construction is not delayed by more than six (6) months, i shall pay plan check fees as follows: (A) Full plan check fee for one of each basic floor plans. (B) Repeated use of plans with elevation changes shall pay : or 50% of full plan check fee. Where plans are incomplete, or changed so as to require additional plan checking, an additional plan check fee of not less than $15.00 per hour, or fraction thereof, shall be charged by the Director of Building & Safety. 16.2-2.05 Section 402 of Chapter 4 of Part II of said Building Code is hereby amended by amending the definition of "Assembly Building" to read as follows: Assembly Building. Is a building, or a portion of a building, used for the gat Bring together of fifty (50) or more persons for such purposes as de- liberation, education, instruction, worship, entertainment, amusement, or awaiting transportation, or of fifty (50) or more persons in drinking and dining establishments, as stipulated in Section B403, Items 1 and 2, Title 19 of the California Administrative Code, required by Section 17958.5 of the Health and Safety Code. This is an expressed finding deemed necessary for the protection of the public health and safety of citizens of the community. 16.2-2.06 Section 1505 of Chapter 15 of Part III of said Building Code is hereby amended to read as follows: Gara a Floor Surface. In areas where motor vehicles are stored or operated, floor surfaces shall be nominal 4" portland cement concrete. 16.2-2.07 Subsection (a) of Section 3501 of Chapter 35 of the Appendix of said Building Code shall include the following addition: The Director of Building & Safety and/or his Deputies shall inspect the material, construction and workmanship for sound transmission control, but shall not be held responsible for and/or guarantee the performance of such controls. Due to local and conditions with annual rainfall of 2.5" and humidity average of 16 to 2S%, the use of weep screed only increases costs and does not serve its general purpose to prevent effenwesuance and degenera- tion of stucco. Trapped water may be dissipated by use of chamfer stripping. •f
