TM City Council of the City of Palm Desert, California, ODES HEREBY OI A1N as follows: TM 20-scra, M-unit portion of the Planned Residential Development known as Desert Air, located on property described as follows: The north % of the northeast 4 of the southeast % of Section is Range 6 East, Township S South San Bernardino Base 6 Meridian is approved subject to compliance with SECTION 4 of the Ordinance. SECTION 2: In granting this approval, the City Council of the City of Palm Desert, California, did make the following findings, justifying said approval: 1) The project meets all requirements of the applicable sections of the adopted Palm Desert Zoning Ordinance. 2) The project with required conditions attached meets the goals and policies of the Palm Desert General Plan. 3) The Planning Commission of the City of Palm Desert, California, has reviewed and recommended approval of the project subject to compliance with conditions. SECTION 3: This application has complied with the requirements of the "City of Palm Desert Envirw mmto) Quality Procedure Resolution Number 74-140, in that a final Environmental Impact Report was presented at a duly noticed public hearing held before the Rancho Mirage Planning Commission on January 21, 1976, and said report was certified by the Rancho Mirage City Council on January 27, 1976, as a final Environmental Impact Report. The City of Palm Desert does hereby accept the City of Rands Mirage's status as lead agency. Prior to the isswnce of a building permit, for any condominium structure, it subdivisiom shall be recorded Umfonsing substantially with said Eaiibit `A'. 3. Prior to the issuance of a building permit for construction of any use to teoplated by this approval the applicant shall first obtain permits and/or elaarance from the following public agencies: County Dept. of Public Wealth Dept. of Fire Protection (Indio) tMtY Road taps,bw t Coachella Valley County Water District Palm Desert Design Review Board Regional Water Quality Control Board #7 Evidence of said permit or clearance from the above agencies shall be presented to the Building and Safety Division of the Department of Environmental Services at the time of the issuance of a building permit for the use ooenenplated herewith. 4. A landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Process. The building permit when issued shall include the grading, lighting, amenities, trash storage, walkways, swimming pool equipment, and irrigation systems. No final inspection or occupancy shall be iven by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. S. The following Fire Protection Requirements shall apply: The applicant shall conform to all requirements and improvements e deemed necessary by the Riverside County Department of Fire Protection and Planning and the City of Palm Desert. 6. Construction of the development permitted hereby may be done progressively in stages, provided adequate vehicular access is constructed for all dwelling units and further provided that such stage development conform substantially with the intent and purposes of this approval for the provision of open areas, recreation facilities, and off-street automobile parking. 7. The sewage disposal system shall be submitted to and approved by the Coachella Valley County Water District prior to issuance of a building Paw t. S. This approval shall be used within I year after final proceedings before the City Council, otherwise it shall become null and void and of no affect whatsoever. By "use" is meant recordation of a subdivision map and beginning of construction of a portion of the project. !. Said miinor re -positioning of buildings shall be considered during the Design Review Process. I. A masonry wall shall be required along the full frontage of Monterey and shall be integrated into a landscaping and berming concept. Said wall sMil vary in height and setback. Any encroachment into the public right-of-way shall be subject to irrevocable encroachment permtit. A detailed design of said wall and landscaping system shall be submitted for review and approved as a part of the Design Review Process. The combination bikeway and equestrian trail system along Monterey and the southerly property line shall be partially depressed and improved for the full frontage along Monterey Avenue and for the first 300 feet westerly along the southerly property line, as approved by the Design Review Process. The remwinder of the trail along the south property line shall include a low split -rail fence on the property line to demark the horse trail. B. The landscaping plan for the project shall include the development of a windbreak system along the westerly boundary of the project in conformance with the Moderate hind Area designation specified in the City's Adopted General Plan. 9. The C.C.& R's for the project shall contain provisions for the daily ' sanitary maintenance of the horse trails along both Monterey Avenue and the southerly property line. The City Clerk of the City of Palm Desert, California, is hereby directed to am this Ordinance to be published once within fifteen (15) days of adoption in the Palms Desert Post, a newspaper published and circulated within the City of Palm Desert, California. The applicant has submitted preliminary plans of the trail system along Monterey Avenue and be has indicated that said design would be continued along the southerly property line of the subject property. Staff is re- commending that these plans be rejected for the following reasonst a. The actual horse trail should be further depressed along Monterey. and said depression should be extended westerly along the southerly property line for at least 300 feet. b. Other conditions require that the proposed wall along Monterey Avenue have a variation. is height and setback which has not been reflected in the preliminary plans.
