ADOPTION OF UNIFORM FIRE There is hereby adopted by the City of Palm Desert for the purpose of pre- scribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Uniform Fire Code recommended by the Western Fire Chiefs' Association and the International Conference of Building Offi- cials, belt9 particularly the 106 edition thereof, and the whole thereof, including Appendix A-3 save and except such portions as are hereafter deleted, modified, or amended by Section T of this ordinance of which code not less than three (3) copies have been and are WL.' filed in the office of the Clerk of the City of Palm Desert, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provision thereof shall be controlling within the limits of the City of Palm Desert, California. SECTION Y. ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION (a) The Uniforw Fire Code shall be enforced by the Bureau of Fire Prevention In the Fire Department of the City of Palm Desert which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. (b) The Chief (or Fire Marshal) in charge of the Bureau of Fire Prevention shall be appointed by the Fire Chief. (c) The Chief of the Department may detail such members of the Fire Depart - went as inspectors as shall from time to time be necessary. The Chief of the Fire Department shall recommend to the City Manager the employment of technical inspectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. SECTION 3. DEFINITIONS (a) Whenever the word "jurisdiction" is used in the Uniform Fire Code, it shall be held to mean the City of Palm Desert. (b) Whenever the term "corporation counsel" is used in the Uniform Fire Code, it shall be held to mean the Attorney for the City of Palm Desert. SECTION 4. Section 10.103 "Exit Obstruction, Paragraph "F" is added to read: No person shall install place, keep or maintain any bars, grates or other obstructions across the opening o� any window of any.sleeping room of any building which my deter or hinder an occupant from using the window as a means of escape from a fire origina- ting within the building. Section 13.20S is added to read: In all locations where access for fire apparatus for fir* suppression or rescue purposes is unduly difficult or subject to obstruction, the Chief of the Fire Department may designate Fire Lanes and cause them to be posted as such. No person shall obstruct such Fire Lanes in any manner that would deter or hinder the Fire Department from gaining imeediate access and use of such designated Fire Lane. SECTION S. APPEALS Mhenever the Chief disapproves an application or refuses to grant a permit applied for, the applicant may appeal the decision of the Chief to the City Council within thirty (30) days from the date of the decision. SECTION 9. PENALTIES (a) Any person who violates any of the provisions of this code or fails to comply therewith, or who violates or fails to comply with any order made thereunder, shall severally and for every such violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine of not more than $500.00 or by imprisonment for not more than six months or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to con- tinue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time, and when not otherwise specified, each ten days that prohibited conditions are maintained, shall constitute a separate offense. (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. SECTION 10. OTHER ORDINANCES Ordinance No. 26, No. 85, and No. 109 are hereby repealed and replaced by this ordinance. SECTION 11. VALIDITY The City Council hereby declares that should any section, paragraph, sentence, or word of this ordinance or of the Code hereby adopted be declared for any reason to be invalid. it is the intent of the City Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
