OP PALN DESERT, CALIFORNIA, RESTRICTING DEVELOPMENT.
W HERE:AS, the City Council of the City of Pala Desert, California, is con-
cov with V* protection of the public health, safety, and genera) welfare of the
commity, particularly the need to provide adequate municipal and uttlity services
daring an existing period of rapid growth and development, ands
WHEREAS, the City is presently conducting a major planning study within the
co comity known as the College of the Desert Area Specific Plan and it would be ap-
propriate to prevent any development that would cause irreversible impact on the
designation of land use or acquisition of adequate street rights -of -way within the
study area, ands
WHEREAS, pursuant to the authority contained in Section 65858 of the Govern-
ment Code of the State of California, the City Council of the City of Palm Desert
did on October 13, 1977, consider the subject Urgency Ordinance;
NOW, THEREFORE, BE IT KNOWN, the City Council of the City of Palm Desert,
California, does hereby ordain as follows:
SECTION 1: No new applications for building permits subject to the Design
Review Board process, conditional use permits, development plans, a change of zone,
general plan amendments, and tentative tract or parcel maps shall be accepted or
granted in that portion of the City of Palm Desert designated on the attached map,
labeled Exhibit A, provided, however, if such property is the subject of an accepted
application for a permit for any type of development or a project that has received
the approval of the Planning Commission or City Council, it shall be processed in
the normal manner and in accordance with all other regulations of said City. All
said restrictions shall apply to all areas designated on Exhibit A regardless of
zoning.
SECTION 2: This Ordinance is adopted under the authority created by Section
65858 of the Government Code of the State of California and shall be effective for
a period of four (4) Months from the date of passage unless repealed or extended for
an additional period of time after a public hearing as required by Section 65858 of
the Government Code of the State of California.
SECTION 3: The City Clerk of the City of Palm Desert, California, is hereby
directed to cause this Ordinance to be published once within fifteen (15) days of
adoption in the Pals Desert Post, a newspaper published and circulated within the
City of Palo Desert, California.
PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm Desert,
California, this 13th day of October , 1977, by the following vote, to wit:
