PALM DRS%ff, CALIFORNIA, AMENDING CHAPTER 25.92
OF THE PALM DESERT MUNICIPAL CODE TO PROVIDE FOR
A CHANGE OF ZONE FROM PR-5 to PR-6 AND TO APPROVE
A DEVELOPMENT PLAN TO PROVIDE FOR A 166 UNIT CONDO/
HOTEL, 56 CONDOMINIUMS AND 7 SINGLE FAMILY RESI-
DENCES ON PROPERTY GENERALLY LOCATED BET4EEN HIGH-
WAY ill AND CANDLEVOOD STREET AT THE EASTERLY CITY
LIMIT LINE.
CASE NOS. C/Z 10-77 and DP 11-77 A&B .
The City Council of the City of Palm Desert, California,
DOGS REMY ORDAIN, as follows:
SECTION 1: Section 25.92.010 of the Municipal Code, the Zon-
ing flap, is ere y amended to read as shown on the attached exhibit,
labeled Exhibit 'A' Case No. C/Z 10-77. Said Change of Zone encompas-
sing more specifically Assessor's Parcel No. 625-224-10 and the southerly
6.67 acre portion of Assessor's Parcel No..625-15-005.
SECTION 2: Based upon the recommendation of the Palm Desert
Planning oMMUse Use as stated in Resolution No. 295 and pursuant to
Section 25.24.060 of the Palm Desert Municipal Code, said Change of Zone
is hereby made subject to compliance with the development plan known as
Case No. DP 11-77A which is also hereby approved subject to the compliance
to the following conditions:
A. The development of this project shall conform substantially
to all plans submitted in behalf of this case (Exhibits B
Revised, D, E, F & G), and as revised according to the
Design Review Board process and/or City Council Action._. Any
minor changes require approval by the Director of Environ-
mental Services. Any substantial change requires approval
by the Planning Commission.
B. All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government -entity -
shall be complied with as part of the development process.
C. This approval is applicable, subject to the development of
this project, commencing within one year from approval
date•and being promptly completed.
D. Any roof mounted, exhaust, or air conditioning equipment
shall be fully concealed from view from any public rights -
of -way and adjoining properties by architecturally inte-
grated means.
E. Construction plans shall be submitted for approval to the
City Fire Marshal prior to issuance of building permits.
All conditions shall be made a part of construction and no
certificate of occupancy shall be issued until completed.
F. All utility service and distribution lines on or abutting
the•subject property, shall be placed underground prior
to occupancy ciearagoe.
0. Traffic control provisions shall be provided as required by
the City Engineer.
H, Curb, gutter, sidewalk or approved pathways, and tie-in
paving shall be provided in conformance with City Standards
and/or as required by the City Engineer.
I. A landscaping, grading, lighting, amenities, trash storage,
walkway layout, and irrigation "plan shall be submitted
through the Design Review Board. No final inspectign or
occupancy permit shall be given by the Department of Environ-
mental Services to this project until the aforementior.ed
approved plans and construction shall have been completed.

R. Plans and specifications shall conform to the City of
Palm Desert standard specifications, development.•proce-
dures and design criteria. Any modifications, thereof,
shall require approval of the City Engineer.
L. The proposed development shall have a master trash din-
posal agreement acceptable to the Palm Desert Disposal
Company. If said agreement includes trash enclosures,
said enclosures shall be to City 9tandands and subject
to review by the Design Review Hoard as a part of the
construction drawings.
X. Modifications to off -site streets shall be made to pro-
vide for agrees and ingress satisfactory -to the City
-Engineer.
N. Drainage facilities satisfactory to the Citq Engineer
shall be provided.
O. A a foot high decorative block wall shall be provided in
the following areas:
1. Along the boundary Vine between the proposed condo-
minium area and the single family lots along Candle- (.
wood.
.2. East property line where a wall does not presently
exist.
S. West property line, except in the area of the pro-
posed public street connection of Driftwood Drive and
Shadow Hills Road said wail shall be set in five feet
from the proposed right-of-way line and shall be set-
back 15 feet from the proposed main entrance to the
proposed complex. ,.
P. The proposed tennis courts shall be recessed a minimum of
three feet and shall not be lighted except under the fol-
lowing limitations:
1. Any proposed lighting system shall be subject to the
approval of the Design Review Board as a part of re-
view of the construction drawings.
Z. The landscape treatment around the proposed tennis
courts shall consist of tali trees to reduce side
glare.

of any use contemplated by this approval, the applicant

K. Plans and specifications shall conform to the City of Palm
Desert standard spe ifications, development procedures and
design criteria. Any modifications, thereof, shall require
approval of the City Engineer.
L. Approval is hereby limited to 188 hotel units.
M. The proposed development shall have a masters trash disposal
agreement acceptable to the Palm Desert Disposal Company.
If said agreement includes trash enclosures, said enclosures
shall be to City Standards and 4sub ect to review by'the
Design Review Board as a part of the construction drawings.

lf.• Modifications to off -site streets shall be made to'pro-
vide for egress and ingress satisfactory to the City

the City Engineer.
P. if the proposed hotel units are to be sold to separate
individuals, the applicant shall provide, as a part of
the tentative'tract application, proposed covenants, con-
ditions and restrict& limitation of a maximum of thirty
(30) consecutive days of occupancy by the owner and/or
leasor of any unit.
Q. The proposed landscape area adjacent to the proposed
extension of the frontage road shall be increased to a
minimum of 20 feet in width.
E. A 6 foot high decorative block wail shall be provided on
the east, south and west boundary lines of the proposed
hotel complex. Said wall shall be extended along the
north boundary of the project setbacks 15 feet from the
proposed property line with the following exceptions:
1. At approved entrances, said wall shall be reduced
to a maxinmim height of three feet or held back a
sufficient distance to -guarantee adequate eight
distance.
S. The proposed tennis cowhs shall be recessed a minimum
of three feet and shall not be lighted except under the 1
following limitations:
1. Any proposed lighting system shall be subject to the
approval of the Design Review Board as a part of re-
view of the construction drawings.
2. The landscape treatment_ around the proposed tennis
courts shall consist of tall trees to reduce side
glare.
T. The proposed east -west driveways adjacent to the north
boundary of the project shall be limited to 20 feet in
width.
V. The proposed parking shall be increased to a total of 219
spaces by making these changes to the proposed plot plan:
1. Move the eight unit portion of the two southerly most,
east -went oriented building fifteen feet to the north
and add six spaces to the parking bays at the rear
of said buildings.
2. Add two spaces at each end of the parking area on the
southerly, boundary of the complex.
3. Add a total of four spaces to the parking bays
located on the entranct driveway to the complex.
4. Add one space to the parking areas located in the
northeast and northwest corners of the project. -
8. The proposed entrance street shall be widened to 32 ft.
adjacent to the tennis courts to provide for parallel
parking adjacent to the courts.

T. The proposed roof liner for the Hotel buildings shall be
restudied to better tie it into the design of the building.

SECTION b: The City Clerk of the City of Palm Desert, California,
Is hereby directe3 to publish this Ordinance once in the Palm Desert Post,
a newspaper of general circulation, published and circulated in the City
of Pale Desert, California, and shall certify to the passage and adoption
of this Ordinance and the same shall be in full force and effect thirty
(30) days after its adoption.
PASSED. APPROVED, and ADOPTED at a regular meeting of the Palm
Desert City Council on this 8th day of December, 1977, by the following
vote, to wit:
