AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIlORNIA, AMENDING CHAPTER 25.92
OF THE PALM DESERT MUNICIPAL CODE TO PROVIDE FOR
A CHANCE OF !DONE FOR APPROXIMATELY 240 ACRES FROM
'S' TO PR-$ (CUP 1450E) AND PR-5 (DP 12-77), UPON
ANNEXATION, AND TO APPROVE A DEVELOPMENT PLAN FOR
APPROXIMATELY 220 ACRES REPRESENTING AN AMENDMENT
TO AN EXISTING VALID CONDITIONAL USE PERMIT (CUP
1450E) AND A DEVELOPMENT PLAN FOR APPROXIMATELY
ZO ACRES CONTIGUOUS TO THE 220 ACRE PARCEL TO PRO-
VIDE FOR 786 CONDOMINIUM UNITS, AN 18-HOLE GOLF
COURSE, 10 TENNIS COURTS, A CLUBHOUSE AND RELATED
AMENITIES, GENERALLY LOCATED NORTH OF THE WIIITL-
WATER STORM CHANNEL, BETWEEN MONTEREY AND PORTOLA
CASE NO. C/Z 11-77 and DP 12-77
The City Council of the City of Palm Desert, California; DOES
HEREBY ORDAIN, as follows:
SECTION 1: Section 25.92.010 of the Municipal Code, the Zoning
Map, is re y amended to read as shown on the attached exhibit, labeled
Exhibit 'A' Case No. C/Z 11-77. Said Change of Zone encompassing more
specifically Parcels 1, 2, & 3, Parcel Map 9378 and the south one-half
of the north one-half of the southeast one -quarter of Section 8, TSS,
RSE, SBM.
SECTION 2: Based upon the recommendation of the Palm Desert Plan-
ning Comm+ e-s— on as stated in Resolution No. 306 and pursuant to Section
25.24.060 of the Palm Desert Municipal Code, said Change of Zone is here-
by made subject to compliance with the Development Plan known as Case No.
DP 12-77 which is also hereby approved subject to the compliance to the
following conditions:
GENERAL CONDITIONS - DP 12-77
A. The development of this 780 condominium unit and 6 single
family residence lot development with related recreational
and commercial facilities shall conform to all plans sub-
mitted in behalf of the case (Exhibit A), and to the con-
cept presented in the application as revised according to
the Design Review Board process and/or Planning Commission
action. Any minor changes require approval by the Director
of Environmental Services. Any substantial change requires
approval by the Planning Commission.
S. All requirements of any law, ordinance, or regulation of the
State, City, and any other applicable government entity shall
be complied with as part of the development process.
C. This approval is applicable, subject to the development of
this project, commencing within one year from the date of
annexation and being promptly completed. If the development
under this amendment In not commenced, CUP 1450E remains in
effect.
D. Construction plans shall conform to the requirements of the
City Fire Marshal as expressed in the attached letter dated
November 15, 1977.
SPECIAL CONDITIONS - DP 12-77
A. Prior to the issuance of a building permit for construction
of any use contemplated by this approval, the applicant shall
first obtain permits and/or clearance from the following
agencies:
County Department of Publia Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board M7

S. Plans and specifications shall conform to the City of
Pals Desert standard specifications, development pro
-
eedures and design criteria. Any modifications, thereof,
shall require approval of the City Engineer.
C. Blow sand protection should be maintained for this area,
especially on the north and east sides.
D. ftergency access shall be provided to Portola Avenue on
the south end of this development.
E. Construction of improvements shall conform to the City
of Palm Desert Ordinance No. 125.
F. Stacking space for a minimum of eight vehicles shall be
provided off Monterey at the entrance.
0. There shall be a minimum of a 20 foot setback between
buildings except said setbacks may be reduced to a mini -
nun of lb feet to provide for more interesting building
placement and to provide for better vistas from the road-
ways to the proposed golf course.
H. Final construction drawings including a final landscaping,
grading, lighting, trash storage, walkway layout, and
Irrigation plan in addition to a proposed sign program and
tennis court lighting proposal or any other ammeniyies pro-
posed shall be submitted to the Design Review Board. The
final landscaping plan shall include information with regard
to the relocation of existing trees and blowsand control
measures proposed. No final inspection or occupancy permit f
shall be given by the Dept. of Environmental Services to
this project until the aforementioned approved plans and
construction shall have been completed.
I. Site plan shall reflect a variation in setbacks.
J. Proposed elevations shall be submitted with color material
and sample boards prior to submittal of final construction
drawings to the Design Review Board.
K. A preliminary landscaping plan shall be submitted prior to
submittal of final construction drawings to the Design Review
Board.
SECTION 4: The case number of this approved Development Plan
shall beretindicated on the Official Zoning Map to clearly indi-
cate to the general public that an approved development plan does exist
on the property in question.
SECTION S: The City Clerk of the City of Palm Desert, California,
is bore y rec ed to publish this Ordinance once in the Palm Desert
Post, a newspaper of general circulation, published and circulated in
the City of Palm Desert, California, and shall certify to the passage
and adoption of this Ordinance and the same shall be in full force and
offset thirty (30) days after its adoption.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm
Desert City Council on this 12th day of January 1978, by the follow -

Gentlemen. -
Prior to construction of any of the proposed buildings, the following
conditions must be met:
1. Install a water system capable of delivering 2500 GPM fir* -flow for a
two (2) hour duration in addition to domestic or other supply. The
computation shall be based.upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at -the time
of measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along approved
vehicular travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire Marshal
for review. Upon approval, one copy will be sent to the Building Department,
and the original will be returned to the developer.

4. The water system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certiTTcation: "I certify
that the design of the water system in Case NoCCP�PP�--12-77, is in accordance
with the requirements prescribed by the Fire Mir�hal."

S. Main clubhouse shall be fully protected by a completely automatic fire
sprinkler system.
6. Provide an emergency access road to Portola Avenue. The access road shall
be a Minimum of fifteen feet wide, and subject to approval of the City
Fire Marshal.
