AN ORDINANCE OP THE CITY COUNCIL or THE CITY
OF PALM DESERT, CALIFORNIA, ESTABLISHING AND
DESIGNATING CHAPTER 18 OF THE PALM DESERT
NUNICIPAL CODE AS THE "PALM DESERT MECHANICAL
CODE" WITH CERTAIN ADDITIONS, DELETIONS, AND
ANENOMENTS, THE RULES, REGULATIONS, PROVISIONS,
AND CONDITIONS SET FORTH IN THAT CERTAIN CODE
ENTITLED, -UNIFORM MECHANICAL CODE, 1976 EDITION",
INCLUDING THE APPENDICES THEREIN CONTAINED,
PROMULGATED AND PUBLISHED BY THE INTERNATIONAL
CONFERENCE OF BUILDING OFFICIALS.
The City Council of the City of Palm Desert, California
DOES HEREBY ORDAIN as foliowss
SECTION 1. That Chapter 18 be and the same is hereby
added to the Palm Desert Municipal Code to read as follows:
-Chapter 18t MECHANICAL CODE.
"Section 18.04.010 - Adoption of Mechanical Code.
"Subject to the particular additions hereinafter
set forth in this Ordinance, the rules, regulations, provisions
and conditions set forth in that certain code entitled, 'Uniform
•1 Mechanical Code, 1976 Edition', including the Appendix and
Standards therein contained, promulgated and published by the
International Conference of Building Officials, three full
printed copies of which, printed as a code in book form, were
by the City Council ordered filed and which have been actually

filed in the Office of the City Clerk and which as so on file
are hereby referred to and by this reference expressly incorporated
herein and made a part hereof as fully and for all intents and
purposes as though set forth herein at length, shall be and
the same are hereby established and adopted as the rules,
regulations, provisions and conditions to be observed and
followed in the erection, installation, alteration, repair,
relocation, replacement, addition to, use or maintenance of
any heating, ventilating, comfort cooling, refrigeration systems,
Incinerators or other miscellaneous heat producing appliances
in the City of palm Desert, California, and subject to said
additions hereinafter set forth, said Code with its Appendix
and Standards containing such rules, regulations, standards,
provisions and conditions are hereby established and adopted

"8eation 11.04.020 • Mechanical Code • Additions -
Sec. 106.
"Section 106 is hereby added to said Mechanical
Code to read as follows:
'Sec. 106. Roof installations and Access to
Equipment
All heating, ventilating, comfort cooling,
or refrigeration systems or other miscellaneous mechanical
systems shall be installed in accordance with this Code
and in addition shall comply with the following require -
mantel
(a) If said unit is installed on the roof,
a platform shall be provided and the design of the platform
tshall be substantially sound and constructed in a work-
manlike manner.
JJJ (b) Each and every mechanical installation in
an attic or on a roof, mezzanine or platform more than
four feet above the ground or floor level shall be made
accessible by a stairway or ladder'permanently fastened
to the building. Such ladder or stairway shall not
be sore than 10 feet in length between landings and not
less than 16 inches in width. Such ladder shall have rungs
spaced not more than 14 inches center to center and not
less than six inches from face of wall.'
"Section 18.04.030 - Mechanical Code - Additions -
Sec. 204.
`beetion 204 is hereby added to Chapter 2 of Part
i of said Mechanical Code to read as follows$
'No. 204. business License Reyuired.
(a) before any person, firm, partnership or
corporation shall carry on or engage in the business of
heating and/or air conditioning work, he or it shall first
procure a business license and pay to the department

having jurisdiction the annual license to* imposed on
such business.
(1) No business license shall be issued
to any person unless such person possesses a valid C-20,
C-38 and C-4 State Contractor's License of the State of
California, issued to him pursuant to and in accordance
with the laws of the State of Californiat provided, however,
a business license may be issued to'any person, firm,
partnership, or corporation which makes application for
such license by or through a bona -fide member or authorized
agent thereof who possesses such valid C-20, C-38 and C-4
State Contractor's License of the State of California.
(2) whenever a business license has been
Issued to any person, firm, partnership, or corporation,
which applied for such license by or through a bona -fide
member or authorized agent thereof, pursuant to the
provisions of subdivision (1) hereof, such member or
authorized agent, or some other member or authorized
agent or employee possessing such valid C-20, C-38 and
C-4 State Contractor's License of the State of California,
shall at all times be in actual charge and control of all
heating and air conditioning done or to be done by such
person, firm, partnership, or corporation.
"Section 10.04.030 - Mechanical Code - Additions -
Sec. 205.
"Section 205 is hereby added to Chapter 2 of mart i
of said Mechanical Code to read as followsi
'Sea. 205. To wham permits May be issued.
(a) No permit shall be issued to any person to
do or cause to be done any heating or air conditioning
Installations, refrigeration installations and boiler
installations, as regulated by this Code, except to a
person holding a valid unexpired and unrevoked City
Business License as required by Section 204 of this Code,
except when and as otherwise hereinafter provided in this
section.

• tb) Any permit required by this Code may be
issued to any person to do installations as regulated
by this Code in a single family dwelling, used exclusively
for living purposes, including the usual accessory
buildings and quarters in connection with such buildings,
In the event that such person is a bona -tide owner of any
such dwelling and accessory buildings and quarters and
that the same are occupied by or designed to be occupied
by said owner, and that said owner shall personally
purchase all material and shall personally perform all
labor in connection therewith.'
"Section 18.04.040 - Mechanical Code - Additions -
Sec. •302 (b) 11.
"Paragraph 11 is hereby added to subsection (b) of
Section 302 of said Mechanical Code to read as follows:
'll. Plans and Specifications. when a plan is
required and the Building Official so requests, a plan
checking fee shall be paid to the Building Department
at the time of submitting plans and specifications for
checking. Said plan checking fee shall be equal to one-half
of the mechanical fee as set forth .in Section 304.
Any person desiring a permit required by this
code, shall, at the time of filing an application therefor,
pay a fee as required by Resolution No. 74-50, adopted by
the City Council of Palm Desert, California, on June 27,
1974, and upon review by the City Council, may be changed
by resolution of said body.'
5ZCTIOM 2. That Ordinance No. 44 and all amendments thereto
and all ordinances or parts of ordinances in conflict with this
ordinacos be and the same are hereby repealed.

. California, is hereby directed to cause this ordinance to be
published once within fifteen days of adoption in the Palm
