AN MWINARM OF THE CITY OF PALM DESERT, CALIFORNIA,
ESTABLISHING AND DESIGNATING CHAPTER 17 OF THE PALM
DESERT MUNICIPAL CODE AS THE "PALM DESERT PLUMBING
CODE" WITH CERTAIN ADDITIONS, DELETIONS, AND AMEND-
MENTS, THE RULES, REGULATIONS, PROVISIONS, AND
CONDITIONS SET PORTH IN THAT CERTAIN CODE ENTITLED,
*UMI ORM PLUMBING CODE, 1976 EDITION", INCLUDING
THE APPENDICES THEREIN CONTAINED, PROMULGATED AND
PUBLISHED BY THE INTERNATIONAL ASSOCIATION Or
PLUMBING AND MECHANICAL OFFICIALS.
The City Council of the City of Palm Desert, California,
DOES HEREBY ORDAIN as follows
SECTION 1. AMENDMENT. That Chapter 17 of the Pals
Desert Municipal Code be and the same is hereby established
to read as follows:
"CHAPTER 17. PLUMING CODE.
Section 17.01.010 - Adoption of Uniform Plumbing Code.
Subject to the particular additions and amendments
hereinafter set forth in this Ordinance, the rules,
regulations, provisions and conditions set forth in
that certain Code entitled, 'Uniform Plumbing Code,
1976 Edition', including the Appendices therein contained,
promulgated and published by the International Association
of Plumbina and Mechanical Officials, formerly western
Plumbina Officials Association (a private association
which has been in existence for a period of more than
19 years last past), three full printed copies of which,
printed as a Code in book fors, were by the City
Council ordered filed and which have been actually
filed in the office of the City Clerk, and which as so
on file are hereby referred to and by this reference
expressly incorporated herein and sad* a part hereof
as fully and for all intents +end purposes as though
set forth herein at length, shall be and the same are
hereby established and adopted as the rules, regulations
provisions and conditions to be observed and followed

and amendments hereinafter not forth, said Code with
its said Appendices containing said rules, regulations,
provisions and conditions is hereby established and
adoptedl and the same shall be designated, known and
referred to as the 'Plumbing Code' of and for the said
City of Palm Desert, California. That the City Council
does hereby find that the following provisions,
additions and amendments thereto are necessary for
the proper administration of this Code by the Building
A Safety Division of the City of Palm Desert.
Section 17.01.020 - Plumbin Code: Additions:
Sec. 1.0.
sec. 1.0. Provisions. This Code provides the
minimum standards for the protection of the public health
and safety; the Qualifications of persons engaged in the
trade of plumbing; requiring a permit and inspection for
the installation, alteration or repair of plumbing and
drainage systems and the•inspection thereof; providing
penalties for violations of said Coda and repealing
conflicting ordinances. if any section, subsection,
sentence, clause, phrase or portion of this Code is for
any mason Mid to be invalid or unconstitutional by
the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the
remaining portions of this Code.

sec. 1.3. Valid Plumber's -License and
business License.
a. it shall be unlawful for any parson, firm,
or partnership or corporation to carry on or engage in
the business of contract plumbing unless such person has
had issued to his a valid State Contractor's Plumbing
license. before any person, firm, partnership, or
corporation shall carry on, or engage in the business
of plumbing, he or it shall first procure a business
license from the City and pay to the department having
jurisdiction the annual license fee imposed on such
business.
b. No business license shall be issued to
any person unless such person possesses a valid and
current C-36 State Contractor's License of the State
of California, issued to his pursuant to and in accordance
with the laws of the State of California; provided,
however, that a business license may be issued to any
person, firm, partnership or corporation who sakes
application for such license by or through a bona fide
member or authorised agent thereof, who possesses such
valid C-36 state Contractor's License of the State of
California.
c. whenever a business license has been issued
to any person, firm, partnership or corporation who
applies for such license by or through a bona fide
member or authorised agent or employee possessing such
valid C-36 state Contractor's License of the state of
California, said licensee shall at all times be in actual
charge and eontrol of all plumbing done or to be done
by such person, fists, partnership or corporation.

sec. 1.6. Work_ not RecMirine Permit. no
permit shall be required in the case of any repair work
as followes The stopping of leaks in drains, soil,
waste or vent pipe, provided, however, that should any
trap, drainpipe, soil, wash or vent pipe be our becommme
defective and it becomes necessary to remove and replace
the am* with new material in any part or parts, the
same shall be considered as new work and a permit shall
be procured and inspection made as hereinbefore provided.
No permit shall be required for the clearing of stoppages
or repairing of leaks in pipes, valves or fixtures,
when such repairs do not involve or require the re-
placement or rearrangement of valves, pipes or fixtures.

Sec.
section 1.9 is hereby added to said Plumbing Code
to read as follows:
Sec. 1.9. Cost of Permit and Schedule of
• s. Each applicant shall pay for each permit issued
at the time of the issuance a fee in accordance with
the applicable schedule and at the rate provided by
resolution of the City Council.

Sec. 102 -M.-Jackflov-Preventer. A backflow
prewnter is a device or means to prevent backflow into
potable water systems. All backflow devices as installed
under this Code shall also be regulated by Title 17 -
Dealth and Safety Code of the State of California.
Section 17.01.060 - Plumbing Code: Amendments:
Sec. 201(a).
Section 201(a) of said Plumbing Code is hereby
amended to read as follows:
Sec. 201(a). Minimum Standards. Unless
otherwise provided for in this Code, all materials,
fixtures or devices used or entering into the construction
of plumbing and drainage systems or parts thereof, shall
l be submitted to the Administrative Authority for his
J approval and shall conform to approved applicable
standards or to other equivalent standards acceptable
to the Administrative Authority and shall be free
from defects. All pipes, pipe fittings and fixtures
shall be listed or labeled by a listing agency or shall
be approved by the Administrative Authority when listing
or labeling by a listing agency is not available.
Notwithstanding other provisions and material approvals
of this Code, the installation of ADS, PVC, and other
nonmetallic DW systems are prohibited in all occupancies
excepting Group i Occupancy (single and duplex dwellings)
not more than two stories in height.

the issuance of a permit upon plans and specifications
shall not prevent the administrative authority from

plans and specifications or from preventing construction

of this Code or of any other pertinent ordinance or
from revoking any certificate of approval when issued
in error.
Any plumbing system which requires 100 fixture
units for DWV shall be presented for plan check as a
complete engineered plumbing system. H Occupancy as
specified in the Uniform Building Code latest edition,
3-units or over, shall be provided with a schematic
diagram for the plumbing system to be presented to the
Administrative Authority or his Assistant, no later
than the first called inspection under permit.
When a plan is required and the Administrative
Authority so requests, a plan checking fee shall be paid
to the Building Division at the time of submitting plans
and specifications for checking. Said plan checking fee
shall be equal to one-half of the plumbing fee, as set
forth in Section 1.9.

Section 1004(a) of said Plumbing Code is hereby
amended to read as follows:
8 004(a). Materials. (a) Water pipe and
fittings shall be of brass, copper, cast iron, galvanized
malleable iron, galvanized wrought iron, galvanized
steel, lead or other approved materials. Asbestos
Cenment$ PE, or PVC water pipe manufactured to recognized
standards may be used for cold water distribution systems
outside a building including water and drain liras of
private, semi -private and public swimming pools.
Section 17.01.100 - Plumbin Code: Amendments:

Section 1009(b) of said Plumbing Code is hereby
amended to read as follows: .
Sec. 1009(b). installation. Water service
pipes or any underground water pipes shall be installed
12 inches below grade and shall not be run or laid in
the sane trench with non-metallic building sewer or
drainage piping, except as provided in this section.
The water service pipe may be placed in the same trench
with such building drain and building sewer provided
both of the following conditions are met:
(1) The bottom of the water service pipe, at
all points, shall be at least 12 inches above the top
of the sever line.
(2) The water service pipe shall be placed
on a solid shelf excavated at one side of the common
trench.

p3seesa Facilities. Every abandoned building (house)
sewer or part thereof shall be plugged or capped in an
approved manner as designed by the Administrative
Authority. Before any person plugs and/or caps such
sewers or sewage disposal facilities contemplated in
this section, he shall first post a cash bond with the
City in an amount of not less than $50.00 to guarantee
capping of such sewers and/or sewage disposal facilities,
such bond to be returned to the permittee upon completion
and inspection to the satisfaction of the Administrative
Authority.

section 1206(c)-(1) of said Plumbing Code is hereby
amended to read as follows:
Sec. 1206(c)-(1). Rouch Pining Inspections.
This inspection shall be made after all gas piping
authorised by the permit has been installed and before
any such piping has been covered or concealed, or any
fixture or appliance has bean attached thereto. This
Inspection shall include a determination that the gas
Piping size, material and installation meets the
requirements of this Code. Further, this inspection shall
also include an air pressure test, at the discretion of
the Administrative Authority, before any such piping
is concealed or covered.

be established and shall be installed as required by
Chapter 10 of this Code and in Accordance with see.
401(a) and See. 1004(a) as heretofore outlined.
SNOTiOR Z. VZOLATIORS. Whenever brought to the attention
of the Administrative Authority, that any vwRanitary conditions
exist or that any construction or work regulated by this Code
is dangerous, unsafe, unsanitary, a nuisance or menace to life,
health or property or otherwise in violation of.this code, and
after such investigation as described by this authority that
such information is a fact, any person, firm or corporation
using or maintaining any such condition or responsible for the
use or maintenance thereof, shall be ordered to repair, alter,
change, remove or demolish same as he may consider necessary
for the proper protection of life, health or property and in
the case of any gas appliance or gas system, may order any
person, firm or corporation supplying gas to such piping
or appliance to discontinue supplying service thereto until
such piping or appliance is made safe to life, health. or
property.
Every such order shall be in writing, addressed to the
owner, agent and/or person responsible for the premises in
which such condition exists and shall specify the date or
time for compliance with such order.
Refusal, failure or neglect to comply with any such notice
or order shall be considered a violation of this Code and the
error, agent and/or persons responsible for the premises
shall be doomed guilty of a misdemeanor.
When any plumbing system is maintained in violation of
this Code and in violation of any notice issued pursuant to the
previsions of this section or where a nuisance exists in any

Administrative Authority shall institute any appropriate

to prwoa`• restrain, correct, or abate the violation of
nuisance.
My pereaa, tista or corporation violating any of the
provisions, regulations, requirewents, additions and/or
amandaents of this Code shall be does" guilty of a mis-
deeteaaar and the penalty for such a misdemeanor shall be
as set forth in Ordinance No. 57 of the Pala Desert Municipal
Code.
SECTIOK 5. PRESERVATION OF HEALTH. WELFARE AND SAFETY.
That this City Council does hereby find that the adoption
of this Code with the additions, amendments and changes thereto,
are necessary for the preservation of health, welfare and
safety, and is in accordance with Section 17950.7 of the
Health & Safety Code of the State of California, and that a
l copy of this Ordinance shall be forwarded by the City Clerk
1 to the Director of Sousing and Community Development of the
11f state of California.
SECTION 4. REPEAL OF ORDINANCES. That Ordinance No. 64
and all amendments thereto, and all ordinances or parts of
ordinances in conflict with this Ordinance are hereby repealed.
SECTION S. CITY CLERIC'S CERTIFICATION. The City Clerk
of the City of Pala Desert, California, is hereby directed to
cause this Ordinance to be published ones within 15 days of
adoption in the Pala Desert Post, a newspaper published and
circulated within the City of Pala Desert, California, and
the same shall be in full force and effect 50 days after
adoption•
