HomeMy WebLinkAboutORD 185ORDINANCE NO. 185 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY of PALM DESERT, CALIFORNIA, ADOPTING BY REFERENCE AND EBTASLISHING AND DESIGNATING CHAPTER 20 OF THE PALM DESERT MUNICIPAL CODE AS THE "PALM DESERT UNIFORM SIGN CODE" WITH CERTAIN ADDITIONS• DELETIONS, AND AMENDMENTS. THE RULES, REGULATIONS, PROVI8ION8t AND CONDITIONS SET FORTH IN THAT CERTAIN CODE ENTITLED, "UNIFORM SIGN CODE, 1976 EDITION", INCLUDING THE APPENDICES THEREIN CONTAINED, PROMULGATED AND PUBLISHED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows SECTION I. AMENDMENT. That Chapter 20 of the Palm Desert Municipal Code be and the some is hereby established to read as follows: "CHAPTER 20: UNIFORM SIGN CODE. Section 20..01.010 - Adoption of the Uniform Sign Code. There is hereby adopted by the City of Palm Desert, that certain Code known as the Uniform Sign Code promulgated by the International Conference of Building Officials being particularly the 1976 edition thereof and the whole thereof and not less than three (3) copies have been and now are filed in the Office of the Clerk of the City of Palm Desert and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Palm Desert. Section 20.01,020 • Penalties. (a) Any person who shall violate any of the provisions of this Code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed stat-s nt of specifications, or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to damply with such an order as affirmed -1m :x r Or Wdified by the City Council of the City of Palm Desert or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a Uisde"anor• as more spocifically set forth in Chapter 1.12 of the Code of the City of Pals Desert. (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions." SECTION 2. VALIDITY. The City Council hereby repeals Ordinance No. 41 and declares that should any section, paragraph, sentence, or word of this ordinance or of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 3. CERTIFICATION. The City Clerk of the City of Pala Desert, California, is hereby directed to cause this ordinance to be published once within fifteen days of adoption in the Palm Desert Post, a newspaper published and circulated within the City of Palm Desert, California, and the same shall be in full force and effect thirty days after adoption.
