HomeMy WebLinkAboutORD 1007ORDINANCE NO. 1007 ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA AMENDING CHAPTER 8.36 OF THE CODE OF THE CITY OF PALM DESERT, CALIFORNIA RELATING TO REGULATION AND PROHMITION OF SMOKING WHEREAS, the City Council of the City of Palm Desert, California has become more aware of the dangers of smoking and, particularly second-hand smoke, has hereby adopted a regulation prohibiting smoking within certain public areas in the City. Council now desires to expand such restriction on public areas. NOW, THEREFORE, the City Council does hereby ordain as follows: Section 1. Subparagraph B of Section 9.36.020 being the same, is hereby amended to read as follows: "8.36.020 - Definitions. B. "Public Place" means: 1. Any enclosed area to which the public is invited or in which the public is permitted, including, but not limited to, retail stores, retail service establishments, retail food production and marketing establishments, restaurants, theaters, waiting rooms, reception areas, educational facilities, health facilities and public transportation facilities. A private residence or private country club is not a public place. 2. Areas measured a distance of forty (40) feet from the entrances and exits to enclosed City -owned public places. • 3. Outdoor locations owned by City ofPalm Desert which have a designated "no smoking sign" posted at their normal entrances and exits to such outdoor locations, including but not limited to: (a) City -owned parks, playground, restrooms, baseball and soccer fields, excepting therefrom the golf course area of Desert Willow. (b) Outdoor public events including, but not limited to sports events, entertainment, speaking performances, ceremonies, and fairs. Such designated "no smoking" areas may contain specific limited areas posted permitting smoking. Section 2. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published once and the same shall be in full force and effect thirty (30) days after its adoption.
