HomeMy WebLinkAboutORD 1019ORDINANCE NO. 1019 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 107, THE PALM DESERT ZONING MAP BY PREZONING PART OF SECTION 5, T5S R6E, PR-5 (PLANNED RESIDENTIAL, FIVE DWELLING UNITS PER ACRE) CASE NO. C/Z 02-03 The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN, as follows: SECTION 1: That a portion of Ordinance No. 107 as amended is hereby amended to read as shown on the attached Exhibit "B." SECTION 2: That a Negative Declaration of Environmental Impact, Exhibit "A" attached, is hereby certified. SECTION 3: The City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Desert Sun, a newspaper of general circulation, published and circulated in the City of Palm Desert, California, and shall be in full force and effect thirty (30) days after its adoption. Ion EXHIBIT A Pursuant to Title 14, Division 6, Article 6 (commencing with Section 15070) of the California Code of Regulations. NEGATIVE DECLARATION CASE NO: C/Z 02-03 APPLICANT/PROJECT SPONSOR: City of Palm Desert PROJECT DESCRIPTION/LOCATION: Prezoning of part of Section 5, T5S R6E, PR-5 to facilitate annexation of the area to the city. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons %, ,. in support of this finding. Mitigation measures, if any, included in the project to avoid potentially significant effects, may also be found attached. �1 24/02 Oj;a_l P ILIP DRELL DATE DIRECTOR OF COMMUNITY DEVELOPMENT 2 INITIAL STUDY CASE NO. C/Z 02-03 OVERVIEW: Ordinance No. 1019 Case C/Z 02-03 is the prezoning of Palm Desert Greens to facilitate its future annexation to the city. The property is developed with a golf course with 1,922 residential lots. The property has been developed and used for residential purposes for many years. In fact, at this time only ten lots remain vacant. The prezoning to PR-5 (Planned Residential five dwelling units per acre) is consistent with the existing developed density and with the City's General Plan land use designation. The future placement of ten additional residential units on recorded lots will not have a significant impact on the environment. Appropriate fees will be collected to mitigate impacts on endangered species unless it is shown that such fees have been previously collected. Based on the above we conclude that this project will have no impact on aesthetics, agricultural resources, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, land use planning, mineral resources, noise, population and housing, transportation / traffic, utilities and service systems. With respect to Public Services (page 11 of the Environmental Checklist Form): XIII. PUBLIC SERVICES FIRE County Fire Department provides services to the city. As indicated in the Plan for Services on file for the area, the area is within the five-minute response time of Station 71 at Portola and Country Club Drive. Part of the mitigation for fire and paramedic service includes payment of the Proposition "A" fire tax which also provides paramedic service. The impact on the Fire Department is not significant. INITIAL STUDY CASE NO. C/Z 02-03 POLICE Ordinance No. 1019 The City contracts with Riverside County Sheriff's Department for service. Staff levels are reviewed on an ongoing basis and the reports on same presented to City Council for funding. Impacts on staffing created by this project will be assessed. Increased personnel will be added as needed. SCHOOLS. PARKS AND OTHER PUBLIC FACILITIES The area is already 99% built out. Any impacts on schools, parks and other public services already exist. Palm Desert Greens is a golf course country club. Residents typically use their own recreational facilities. Impacts on city parks will not be increased. These impacts already exist. �w Planning, Building, Public Works and Code Enforcement services, as provided by the City directly, will be provided on the basis of need. Our experience with existing private residential communities is that they do not create excessive demand for City services. MANDATORY FINDINGS OF SIGNIFICANCE a, b and c. The area is 99% developed. Annexation will not degrade the quality of the environment. The level of any impact and the timing of the imposition of such impact would be similar whether the area remains under the County or is annexed to the city. Cumulative impacts, if any, already exist and will not be affected one way or the other by annexation of the property by the City. The project is the prezoning of the area to facilitate annexation. Future land uses in the area will be similar under either the County or the City. The extent of any adverse impacts on human beings will not be affected by the annexation. 2 aKo
