AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
- PALM DESERT, CALIFORNIA, APPROVING AN
AMENDMENT TO CHAPTER 19 BY ADDING SECTION
19.01.055 REGARDING DRAINING OF SWIMMING POOLS.
WHEREAS, the staff of the Public Works Department in the City of Palm Desert
believe it appropriate to have knowledge of and control the discharge of water into the
public streets to attempt to prevent damage downstream, and
WHEREAS, the amendment attached to this ordinance regulates said drainage
by requiring a permit before such discharge can occur.
The City Council of the City of Palm Desert, California, DOES HEREBY
ORDAIN, AS FOLLOWS:
Section 1. The above recitations are true and correct.
Section 2. Section 19.01.055 Draining of Swimming Pools — Permit Required be,
and the same as attached hereto is, hereby approved and adopted.
Section 3. The City Clerk of the City of Palm Desert, California, shall certify to
the passage and adoption of this Ordinance and shall cause the same to be published
once in the Desert Sun, a newspaper of general circulation, circulated within the City of
Palm Desert, and the same shall be in full force and effect thirty (30) days after its
adoption.
PASSED, APPROVED, AND ADOPTED by the City Council of the City of Palm
Desert, California at its regular meeting held on the 24thday of April , 2003, by the
following vote, to wit:
AYES: FERGUSON, KELLY , SPIEGEL, BENSON
NOES: CRITES
ABSENT: NONE
ABSTAIN: NONE

19.01.055 Draining of Swimming Pools — Permit Required.
No person shall drain or permit to be drained, to a public street, any swimming pool
owned or controlled by such person, unless and until a permit so to do has been
obtained from the Public Works Department. Such permits shall be issued upon
appropriate application therefore, accompanied by such fee as may have been
prescribed by resolution of the City Council, and upon the Public Works Department
determining that the time and place when and where such pool draining will be allowed
will not be detrimental to the public interest or welfare, will not result in any undue
hazard or inconvenience to the public, and will not result in any damage to public or
private property.
