HomeMy WebLinkAboutORD 1045ORDINANCE NO. 1045 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CHANGE OF ZONE FROM R1- 18000 TO OPEN SPACE TO ALLOW THE CONSTRUCTION OF A 2 (+/-) ACRE PARK WITH A PARKING LOT, RESTROOM, PICNIC PAVILIONS, TOT LOT, BASKETBALL COURT, VOLLEYBALL COURT, PERIMETER WALK, BARBEQUES, FLOWER GARDEN, PUTTING GREEN AND OTHER RELATED FACILITIES AT 73-690 DE ANZA WAY, APNs 627-143- 006, 627-143-007, 627-143-008, 627-143-009. CASE NO. C/Z 03-03 WHEREAS, the City Council of the City of Palm Desert, California, did on the 241h day of April, 2003 hold a duly noticed public hearing to consider the request of the City of Palm Desert, for approval of the above; and WHEREAS, the Planning Commission has recommended approval of Case No. C/Z 03-03 by Resolution No. 2198; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 00-24," in that the Director of Community Development has determined that the project will not have a significant impact on the environment; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to exist to justify granting approval of said change of zone: CHANGE OF ZONE: 1. The Change of Zone is consistent with the General Plan, including the housing element, because the amendment and zone change conform to the Palma Village Neighborhood Specific Plan. 2. The remaining residential sites in the housing element are adequate to accommodate the city's share of regional housing need as the park site was not relied upon by the housing element as a residential site. 3. The land use resulting from the change of zone would be compatible with adjacent existing land uses. 4. The density resulting from the change of zone would not be incompatible with densities permitted in the adjacent areas. ORDINANCE NO. 1045 5. The proposed change of zone will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety or general public welfare. The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN, AS FOLLOWS: 1. The above recitations are true and correct and constitute the findings of the Council in this case. 2. That the C/Z 03-03, is hereby approved. 3. That the City Clerk of the City of Palm Desert, California, shall certify to the passage adoption of this Ordinance and shall cause the same to be published one in the Desert Sun, a newspaper of general circulation, circulated within the City of Palm Desert, and the same be in full force and effect thirty (30) days after its adoption. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm desert City Council, held on this 8th day of May , 2003, by the following vote, to wit: AYES: CRITES, FERGUSON, BELLY, SPIEGEL, BENSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: RACHF.LLE D.
