AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, ADOPTING BY REFERENCE WITH CERTAIN
DELETIONS, AND AMENDMENTS, THE RULES, REGULATIONS,
PROVISIONS AND CONDITIONS SET FORTH IN THOSE CERTAIN
CODES ENTITLED, 6 CALIFORNIA FIRE CODE".
The City Council of the City of Palm Desert, California DOES HEREBY ORDAIN
as follows:
SECTION 1. FIRE CODE ADOPTION.
A. That Section 15.16.010 of the Code of the City of Palm Desert, California, is
hereby amended to read as follows:
Section 15.16.010 — Adoption of Fire Code.
Those building codes known as the "Uniform Fire Code (UFC)," 1997 Edition,
together with the 2001 California Amendments, promulgated and published by
the Western Fire Chiefs Association, 1260 Lake Boulevard, Suite 250, Davis,
California, 95616-5668, the purpose and subject matter of which, among other
things, is to protect the public health, safety, and property from hazards of fire
explosion, and dangerous conditions arising from storage, and the use of
hazardous materials and devices as set out in Section 101.2 of the California Fire
Code (CFC), are adopted and enacted as the primary fire codes of the City of
Palm Desert and made a part of this Code by reference with the same force and
effect as if fully set forth herein subject to the following amendments, and will be
known as the "Palm Desert Fire Code."
B. That Section 15.16.012 of the Code of the City of Palm Desert, California, is
hereby deleted in its entirety and replaced with the following:
Section 15.16.012 Amendment to the California Fire Code.
CFC Sec. 1003.2 FIRE -EXTINGUISHING SYSTEM — Automatic Sprinkler
System in Certain Occupancies.
An approved automatic fire sprinkler system shall be installed in every building or
portion thereof hereafter constructed for Group A, B, E, F, H, I, R-1, S, and U
occupancies where the total accumulations of gross floor area (existing,
proposed or combination thereof) is 3,000 square feet or more, regardless of
stories. Fire resistive walls shall not be considered for reducing the gross floor
area of the building for the purposes of this section. The floor area shall be
calculated by the building footprint, including all areas normally fire sprinklered
per NFPA13.
Any variation from the above section of the code is subject to the approval of the
Building Official and Fire Marshal.
C. That Section 15.16.030 of the Code of the City of Palm Desert, California, has
been added and hereby amended to read as follows:

Section 15.16.030 Amendment to California Fire Code Appendix.
California Fire Code Appendix Chapters are hereby adopted and shall be part of
Palm Desert Municipal Code with the exception of Appendix Chapters I-C, II-C,
II-D, III-D, VI-B, and VI-F.
D. That Section 15.16.120 of the Code of the City of Palm Desert, California, is
hereby to read as follows:
Section 15.16.120 Violation.
It shall be unlawful for any person, firm, corporation, or association for the
storage and handling and use of hazardous material and devices or to erect,
construct, enlarge, alter, repair, move, improve, remove, convert, demolish,
equip, use, occupy, or maintain any building, structure, or building service
equipment, or cause, or permit the same to be done in violation of this code
and/or any technical codes.
Any person, firm or corporation violating any of the provisions of this Code shall
be deemed guilty of an infraction (or misdemeanor, if so specified) subject to all
the provisions of Chapter 1.12 of the Palm Desert Municipal Code.
The application of the above penalty shall not be held to prevent the enforced
removal of prohibited conditions.
E. That section 15.16.200 of the Code of the City of Palm Desert, California, has
been added to read as follows:
Section 15.16.200 - Copies of codes for public review
FILING WITH THE BULDING OFFICIAL. One certified copy of this Code and of
each of the codes adopted by reference herein is on file in the office of the
Building Official, and all such certified copies of the codes shall be kept at the
office for public review while this Code is in force.
PASSED. APPROVED and ADOPTED by the Palm Desert City Council this
13th day of November , 2003 , by the following vote, to wit:
