HomeMy WebLinkAboutORD 1061ORDINANCE NO. 1061 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO CHAPTER 27.12.190 OF THE MUNICIPAL CODE RELATIVE TO ESTABLISHING PAD HEIGHT CERTIFICATIONS WHEREAS, the staff of the Public Works Department in the City of Palm Desert believe it appropriate to have control of a building's top of form location as well as the horizontal location, and WHEREAS, the amendment attached to this ordinance regulates said locations by requiring a top of form certification as well as a horizontal location certification. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The above recitations are true and correct. Section 2. Section 27.12.190 Top of Form Height and Horizontal Location Certification be, and the same as attached hereto is, hereby approved and adopted. Section 3. The City Clerk of the City of Palm Desert, California, shall certify to the passage and adoption of this Ordinance and shall cause the same to be published once in the Desert Sun, a newspaper of general circulation, circulated within the City of Palm Desert, and the same shall be in full force and effect thirty (30) days after its adoption. PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm Desert, California, at its regular meeting held this 11 th day of March , 2004, by the following vote, to wit: AYES: BENSON, CRITES, KELLY, SPIEGEL NOES: NONE ABSENT: FERGUSON ABSTAIN: NONE ROBERT A. KLASSEN, CITY CLER CITY OF PALM DESERT, CALIFORNIA ORDINANCE NO. 1061 Exhibit "A" "27.12.190 Top of form height and horizontal location certification. No inspection or approval on the building or structure's foundation system shall be given by the Building Official until the City Engineer has received, reviewed and approved a certification that the proposed top of form height and horizontal location conform to the approved grading plan. The required top of form height and horizontal location certifications shall be prepared and submitted by a licensed land surveyor or civil engineer."
