HomeMy WebLinkAboutORD 1073PEA ORDINANCE NO. 1073 AN ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING SECTION 3.36.010 OF THE MUNICIPAL CODE, WITH RESPECT TO THE AREA SUBJECT TO THE FIRE PROTECTION FUND WHEREAS, in 1981, the City Council of Palm Desert adopted Ordinance No. 266 establishing a fire protection fund to help fund facilities and equipment required by the demand for services from new developments in the City. Ordinance No. 266 enacted Section 3.36.010 which levied the fire protection fee on "all developments outside of a 5 minute response time as identified in Exhibit "A", attached to the Ordinance..."; and WHEREAS, since the adoption of the fire protection fee, the City of Palm Desert has annexed additional areas, rendering obsolete Exhibit "A" attached to Ordinance No. 266. NOW, THEREFORE, the City Council of the City of Palm Desert, California, does hereby ordain as follows: Section 1: Section 3.36.010 of the Palm Desert Municipal Code is hereby amended to replace the Exhibit :A: adopted by Ordinance No. 266 with the Exhibit "A" attached hereto and reads as follows: "Section 3.36.010 Established Developments Subject to Fee. A Fire Protection Fund is established for providing fire protection sites, facilities, and equipment required by the demand for services from new developments in the City of Palm Desert. All developments outside of a five minute response time as identified in attached Exhibit "A", shall be subject to said fee. Said fee shall be computed and levied as follows: a) $100 per residential unit; b) $100 per 1,000 square foot of non-residential construction." Section 2: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published once in the Desert Sun, a newspaper of general circulation, printed, published and circulated within the City of Palm Desert, and the same shall be in force and effect thirty (30) days after its adoption." -1- DJE\236808.1 ORDINANCE NO. 1073 PASSED, APPROVED, AND ADOPTED by the City Council of the City of Palm Desert, California, at its regular meeting held this 26th day of August, 2004, by the following vote, to wit: AYES: BENSON, CRITES, FERGUSON, KELLY, SPIEGEL NOES: NONE ABSENT: NONE ABSTAIN: NONE ROBERT A.
