AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, AMENDING SECTION
6.04.140 OF THE CODE OF THE CITY OF PALM DESERT,
CALIFORNIA, RELATING TO OWNER'S RESPONSIBILITY
FOR ANIMALS.
The City Council of the City of Palm Desert,
California, DOES HEREBY ORDAIN as follows:
SECTION 1: That Sub -Sections E, F, G and H be and
the same are hereby added to Section 6.04.140 of the Code of
the City of Palm Desert, California, to read as follows:
"Section 6.04.140 Owners' Responsibility:
E. For any person to keep or harbor more than
four (4) dogs or cats, other than puppies and kittens under
the age of four (4) months, upon any residential premises in
the City.
F. For the owner or person in charge of any dog
to permit such dog to be present in any public park in the
City, unless such dog is securely restrained by a leash or
chain not exceeding six (6) feet in length. Under no
circumstances or conditions shall such dog be allowed in
those areas set aside for children's play areas. Any Police
Officer, Animal Control Officer or City Code Enforcement
Officer may order the owner or person in charge of any dog
determined to be in violation of this section or other
related section of this Chapter to immediately remove the
dog from the park.
G. For the owner or person in charge of any dog
to allow animal excreta deposited by his/her dog(s) to
remain on public walks,•.recreation areas, or private property.
H. (1) For the owner or other person in charge
of any dog or other animal including fowl,
to knowingly permit or suffer such dog or
other animal, including fowl, by barking or
other noise or sound, to disturb any other

person's peace and quiet. This section
shall not prevent the keeping of any
watchdog, provided the keeper thereof
takes immediate steps to quiet such dog
whenever it barks, howls or whines, and
provided such keeper never leaves such
dog unattended on the premises where its
barking, howling or whining, if prolonged
or if repeated an undue number of times,
disturbs any other person's peace and
quiet.
(2) No person, after being notified orally
or in writing that his dog or other animal,
including fowl, has by barking or other
noise or sound, disturbed any other person's
peace and quiet shall fail, refuse or neglect
to take whatever steps or use whatever means
are necessary to assure that such other
person's peace and quiet is not disturbed
again.
SECTION 2. The City Clerk of the City of Palm
Desert, California, is hereby directed to cause this
ordinance to be published once within fifteen days of adoption
in the Palm Desert Post, a newspaper published and circulated
within the City of Palm Desert, California, and the same shall
be in full force and effect thirty days after adoption.
